HomeMy WebLinkAboutReso 240-1985RESOLUTION NO. 240-85 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ORDERING THE VACATION OF A PORTION OF A PUBLIC UTILITY AND FIRE ACCESS EASEMENT WITHIN PARCEL "E" OF THE PARCEL MAP OF CENTURY PLAZA BE IT RESOLVED by the City Council of the City of South San Francisco as fo11 ows: 1. The City Council on the adopted Resolution No. 217-85 9th day of October , 19 85 , entitled "A Resolution of intention to Vacate a Portion of a Public Utility and Fire Access Easement within Parcel "E" of the Parcel Map of Century Plaza which Resolution recited that the proceedings were undertaken to the Public Streets, Highways and Service Easement Vacation Law (commencing with Section 8300 of the Streets and Highways Code) and which Resolution of Intention was duly published as required by law, and notices of hearing were duly posted in the time, manner and form provided by law, all as appears from the affidavit of publication and the affidavit of posting on file in the office of the City Clerk of said City. 2. Wednesday , the 13th day of ~!ovember , 19 85 at the hour of 7:30 p.m. in the Community Room of the Municipal Services Building, 33 Arroyo Drive, South San Francisco, Californa, was fixed in said Resolution of Intention as the time and place when and where any and all persons interested in, or having any objections to, said proposed vacation, were to appear before said Council and be heard. 3. No objections of any kind or character have been or were made or filed against vacation. 4. The City Council finds that the public utility and fire access easement which is described in the Resolution of Intention and which is more particularly described in Exhibit "A" attached hereto which is hereby incorporated by reference as though set forth verbatim herein, is unnecessary for present or prospective public use. 5. The public utility amd fire access easement which is described in said Resolution of Intention and more particularly described in Exhibit "A" attached hereto and previously incorporated by reference, is hereby ordered vacated. 6. The City Clerk shall cause a certified copy of this Resolution and Order, attested under the seal of the City, to be recorded in the office of the Recorder of the County of San Mateo. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 13th day of November , 19 85 , by the following vote: AYES: NOES: ABSENT: Councilmembers Mark N. Haffey, Gus Nicolopulos; and Roberta Cerri Teglia None None EXHIBIT "A" ~0 RESOLUTION NO. 240.-85 EXHIBIT A Legal description of easement area to be vacated: The portion of the P.U.E. and fire access easement, (66 M 5, G, 7 San Mateo County Records)' which is located in Parcel E (~ M 23 San Mateo County Records) which is described as follows: Commencing at the northern most corner of Parcel E (55 M 23) thence South 24°17'18'' East, 20.3g feet to the true point of be§inning, thence from said Point Of Beginning South §~°~0'§2", 302.33 feet along a line parallel to and 20 feet southeasterly of the westerly property line of Parcel E, to the northern right way line of El Camino Real; thence South 26°3g'q6'' East, 29.93 feet to a ta~.ent point of a 29 foot radius reverse curve, the center o! which bears North 63 21'1~" East; thence along the arc of said curve in a northerly direction feet through a central angle of g1°19'38'' to a tangent point o! a line parallel to and 24 feet southeasterly of the afore~.entioned westerly property line of Parcel E; thence along said line North J)Q z~0'~2", 280.63 fee~ to the northerly line o! Parcel E; thence along said northerly line North 24 17'18" West, 4.08 feet to the true point of be§inning.
