HomeMy WebLinkAboutReso 165-1985 RESOLUTION NO. 165-85 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING APPROVAL AND EXECUTION OF AN AGREEMENT BETWEEN THE UNITED STATES COAST GUARD AIR STATION SAN FRANCISCO AND THE SOUTH SAN FRANCISCO FIRE DEPARTMENT FOR EMERGENCY MEDICAL TECHNICAN TRAINEES BE IT RESOLVED by the City Council of the City of South San Francisco that: 1. Approval of Agreement. The Agreement by and between the U.S. Coast Guard Air Station San Francisco and the South San Francisco Fire Department for the purposes of providing training and experience for the United States Coast Guard Emergency Medical Technican Trainees, entitled "Agreement" is hereby approved, and a copy of said Agreement is attached hereto as Exhibit "1". 2. Execution of Agreement. The City Manager is hereby authorized to execute said Agreement on behalf of the City, and the City Clerk attest his signature thereto. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a reqular meeting held on the 14th day of Auqust , 19 85, by the following vote: AYES: Councilmembers Mark N. Addieqo, Emanuele N. Damonte, Gus Nicolopulos; and Roberta Cerri Teqlia NOES: None ABSENT: Councilmember Richard A. Halley City Clerk EXHIBIT "1" TO RESOLUTi,.-.,N ~'~-~ 165'-~5' THIS AGI{J']EMENT made and entered into this 21st day of August___, 1985, by and between U. S. Coast Guard Air Station San Francisco, hereinafter referred to as "U.S.C.G.", a[ld South San Francisco Fire Department, hereinafter referred to as "S.S.F.D.": WITNESS ETH WHEREAS, U.S.C.G. requires special facilities and programs for the purposes of providi ng trat rd ng and experie ncc for i ts Emerge ncy Medical Technictar] Trainees, and WHEREAS, S.S.F.D. has facilities and programs for such training and experience, and as a community and professional service is willing, under conditions hereinafter set forth, to allow the U.S.C.G. to utilize those facilities and programs hereinafter set forth for training and experience purposes. NOW, THEREFORE, it is mutually agreed as follows: 1. S.S.F.D. shall: a. Provide certain facilities for instructional service purposes for a period from 25 July ].985 to 19 Dece~nber 1985. b. Designate a liaison person to coordinate and integrate programs and personnel of U.S.C.G. with progra~:s and personnc]_ of S.S.F.D. c. The on-duty Fire De ~.~r tree nt Senior Paramedic will directly supervise the work of the Coast Guard Emergency Medical Technician (EMT) trait~ces. The EMT trainees will only perform such procedures as tl{ey are certified to perform in the field, and they will perform these procedures ord. y u~der the direct supervision of the or~-duty Fire Department Senior Paramedic. 2. U.S.C.G. shall: a. Provide qualified EMr trainees and shall administer, supervise a~ coordinate the personnel and traiain~ needs of said EMT trainees. b. Designate a liaison person to coordinate and integrate programs and personnel, including EMT trai~me.~, ~.~i[~h programs and personnel of S.S.F.D. 1 3. Both U.S.C.G. and S.S.F.D. agree that no persom, patients, clients, staff or students of U.S.C.G. or S.S.F.D. shall' on the ground of race, color, religion, national origin, sex, age or handicapping condition be excluded from part~cipation in, be denied the benefits of, or be subject.ed to discrimination under any program defined within this agreement. 4. Neither U.S.C.G. nor S.S.F.D. is liable for an exchange of money or other consideration for the normal components of this agreement.~ 5. Neither the U.S.C.G. EMT trainees nor its liaison person shall by virtue of this agreement be deemed an ..employee of S.S.F.D. for any purpose whatsoever, nor shall it or they be entitled to any of the rights, privileges or benefits of S.S.F.D. 6. The term of this agreement shall commence on 25 July 1985, and shall continue until 19 December 1985 or untiI terminated by either party in writing effective seven days from the date of written notification. 7. S.S.F.D. assumes no responsibility for illness or injury incurred by EMT trainees while working with S.S.F.D., whether on paid duty or not, unless such illness or injury is proximately caused by the act or omission of S.S.F.D., its agents, or employees. 8. To the extent permitted by Federal law, including the Federal Tort Claims Act (28 USC S2671 et seq.), U.S.C.G. assumes liability for and agrees to hold the S.S.F.D. harmless for damages resulting from injury, death, damage to persons or property that are proximately caused by the acts or omissions of its EMT students and staff in the performance of this Agreement.
