HomeMy WebLinkAboutReso 173-1985 RESOLUTION NO. 173-85 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING THE SOUTH SAN FRANCISCO POLICE DEPARTMENT TO ENTER INTO AN AGREEMENT TO SHARE AN AUTOMATED FINGERPRINT IDENTIFICATION SYSTEM BE IT RESOLVED by the City Council of the City of South San Francisco that: 1. Approval of Agreement. The Agreement by and between the South San Francisco Police Department and the San Francisco Police Department entitled "Agreement Form" for the pur- poses of sharing in an automated fingerprint identification system (A.F.I.S.) with the City of San Francisco is hereby approved and a copy of said Agreement is attached hereto as Exhibit "A." 2. Execution of Agreement. The Chief of Police is hereby authorized to execute said Agreement on behalf of the City, and the City Clerk attest his signature thereto. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 14th day of August , 1985, by the following vote: AYES: NOES: ABSENT: Councilmembers Mark N. Haffey EXHIBIT "A" TO RESOLUTION NO. 17~-85 AGREEMENT FORM The following terms are agreed upon as a condition of South San Francisco Police Department's submission of prints for search in the San Francisco A.F.I.S. System. Already trained latent print examiners of the South San FRancisco Police Department shall prepare, enter and check their own cases at a time mutually convenient to the San Francisco Police Department and the South San Francisco Police Department. 2. Periodic Updates of l0 print cards shall be made by South San Francisco personnel at a mutually convenient time. The number of South San Francisco Police Department's l0 print cards in the data base shall not exceed !O,O00. The South San Francisco Police Department shall be responsible for establishing criteria for purging fingerprint cards if the number exceeds 10,000. 4. Charges shall be as follows: $150 per computer hour Hours will be computed automatically by A.F.I.S. and a copy of the job log will be sent to the South San Francisco Police Department at the first of each month with the monthly billing. The South San Francisco Police Department shall submit a check payable to the San Francisco Police Department for the total amount due for the previous month within 30 days of receipt of the bill. 6. This agreement will be in effect through July l, 1987. 7. This agreement may be canceled by either party on 90 day's notice. It is'understood and agreed that the South San Francisco Police Department shall fully defend, indemnify and hold harmless the City and County of San Francisco, its officers, employees, agentw and servants, for any and all liability caused by the negligence or wrongful act on the part of the South San Francisco Potqce Department and its employees arising from the use of the Automated Fingerprint Identification System, and shall pay all claims, damages, judgments, legal costs, adjuster and attorney's fees related thereto. It is understood and agreed that the San Francisco Police Department shall fully defend, indemnify and hold harmless the City of South San Francisco, its officers, employees, agents and servants, for any and all liability caused by the negli- gence or wrongful acts on the part of the San Francisco Police Department and its employees arising from the use of the Automated Fingerprint Identification System, and shall pay all claims, damages, judgments, legal costs, adjuster and attorney's fees related thereto.
