HomeMy WebLinkAboutReso 98-1985RESOLUTION NO. 98-85 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING PLANS AND SPECIFICATIONS, CALLING FOR SEALED PROPOSALS AND FIXING LIQUIDATED DAMAGES FOR FAILURE TO COMPLETE THE WORK WITHIN TIME SPECIFIED - PRODUCE AVENUE WIDENING IMPROVEMENTS - PROJECT NO. ST-83-5 BE IT RESOLVED by the City Council of the City of South San Francisco that: WHEREAS, on July 7, 1982, this Council adopted Resolution No. 74-82, A Resolution of Intention to Make Acquisitions and Improvements, and plans and specifications suitable for calling for bids for construction of a portion of said improvements have been sumbitted for approval by this Council; NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows: 1. That said plans and specifications for the construction of said portion of said improvements (ProduCe Avenue Widening Improvements - Project no. ST-83-5), on file in the office of the City Clerk of this City, are hereby approved. 2. Said Clerk is hereby directed to publish once a week for two weeks in the South San Francisco Enterprise-Journal, a newspaper published and circulated in the City of South San Francisco, a notice inviting sealed proposals or bids for the construction of said portion of said improvements, and referring to the plans and specifications on file in the office of said Clerk, the first publi- cation of which notice shall be at least fourteen (14) days prior to the time fixed for opening bids. 3. All proposals or bids shall be accompanied by cash, a cashier's or certified check payable to the order of the City of South San Francisco amount- ing to ten percent (10%) of the bid, or by a bond in said amount and payable to the City of South San Francisco signed by the bidder and a corporate surety or by the bidder and two sureties who shall justify before any officer competent to administer an oath, in double said amount and over and above all statutory exemptions. The amount so posted shall be forfeited to this City in case the bidder depositing the same does not, within fifteen (15) days after written notice that the contract has been awarded to him, enter into the contract to construct said improvements. 4. Pursuant to Section 1773 of the Labor Code of the State of California, the City of South San Francisco has obtained from the Director of the Depart- ment of Industrial Relations the general prevailing rate of per diem wages and the general prevailing rate for holidays and overtime work for each craft, classification, or type of workman required to execute the contract. A copy of said prevailing rate of per diem wages is on file in the principal office of the City of South San Francisco, to which reference is hereby made for further particulars. Said prevailing rate of per diem wages will be made available to any interested party upon request, and a copy thereof shall be posted at the job site. 5. In the event the contractor does not complete the work within the time limits specified in said specifications, or within such further times as this Council shall have authorized, the contractor shall pay to the City of South San Francisco liquidated damages as specified in said specifications, the provisions of which are hereby referred to and incorporated herein by reference. 6. Said sealed proposals or bids shall be delivered to the City Clerk of this City on or before 2:00 p.m. on June 25, 1985, said time being not less than fourteen (14) days from the time of the first publication of said notice. Bids will be publicly opened, examined and declared on said day and hour, and referred to and considered by this Council at its meeting at 7:30 p.m. on July 10, 1985.
