HomeMy WebLinkAboutReso 51-1985 RESOLUTION NO. 51-85 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION OF INTENTION TO VACATE TEN FOOT (10') WIDE PEDESTRIAN WALKWAY LOCATED BETWEEN 139 DUVAL DRIVE AND 88 ARLINGTON DRIVE BE IT RESOLVED by the City Council of the City of South San Francisco as follows: 1. Notice is hereby given that Wednesday , the lOth day of April , 19 85 , at 7:30 p.m., which time is not less than fifteen (15) days from the date of passage of this Resolution, in the Community Room of the Municipal Services Building, 33 Arroyo Drive, South San Francisco, California, is hereby fixed as the time and place when and where all persons interested in, or having objections to, the proposed vacation of a ten foot (10') wide pedestrian walk- way located between 139 Duval Drive and 88 Arlington Drive as hereinafter des- cribed, may appear before said Council and be heard. 2. A copy of this Resolution shall be published for at least two (2) successive weeks prior to the hearing date in the Enterprise-journal, a news- paper of general circulation printed and published in said City in the manner prescribed by law for publishing ordinances in said City. 3. Notices of the vacation, stating the passage of the Resolution of Intention and the time and place of hearing shall be posted conspiciously along the line of the pedestrian walkway, or part thereof, proposed to be vacated at least two (2) weeks before the date set for the hearing and not less than three (3) notices shall be posted. 4. The public interest and convenience require, and it is the intention of this Council to vacate a ten foot (10') wide pedestrian walkway located between 139 Duval Drive and 88 Arlington Drive as shown on the map entitled "Vicinity Map" which is on file in the office of the City Clerk, and which is more particularly described in Exhibit "A" attached hereto. 5. The public interest, convenience and necessity require the reservation of a public service easement over the entire area to be vacated which is more particularly described in Exhibit "A" attached hereto and by this reference incorporated herein as though set forth verbatim, and the vacation proceedings are taken subject to such reservation. The City Council does hereby reserve and except from such proceedings the public service easement described above through the entire area described in Exhibit "A". 6. This vacation proceeding is conducted pursuant to Chapter 3 of the Public Streets, Highways and Service Easements Vacation Law (commencing with Streets & Highways Code Section 8300 et. seq.) I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 13th day of March , 1985 , by the following vote: AYES: Cou~ilmembers Mark N. Haffey, Gus Nicolopulos; and Roberta Cerri Teglia NOES: None ABSENT: None City Clerk -2- DESCRIPTION OF 10' WIDE PEDESTRIAN WAY TO BE VACATED 10' wide "Pedestrian Way" located between Lot 20 and Lot 21, Block I as shown on the. Final Map of the Winston Manor Sub- division, filed for Record at Book 32, of'Maps, at Pages 28 and 29 of the San Mateo County Records. "EXCEPTING AND RESERVING THEREFROM PURSUANT TO THE PROVISIONS OF Section 8340 of the Street and Highways Code and for the benefit of Pacific Bell, Pacific Gas and Electric Company, and the California Water Services Company the permanent easement 'and the right at any time or from time to time to construct, maintain, operate, replace, remove, renew and enlarge linesof pipe, conduits, cable, wires, poles and other convenient structures, equipment and fixtures for the operation of tele- graphic and telephone lines' and other communication and elec- tric facilities, gas mains and water mains and facilities including access and the right to keep the property free from inflammable materials and wood growth, and otherwise protect the same from all hazards, in, upon, over and across all of the Pedestrian Way described above."
