HomeMy WebLinkAboutReso 59-1985 RESOLUTION NO. 59-85 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION OF INTENTION TO VACATE MAGNOLIA AVENUE FROM NORTH CANAL STREET TO RAILROAD AVENUE BE IT RESOLVED by the City Council of the City of South San Fracisco as follows: 1. April Notice is hereby given that Wednesday , the 24th day of 1985 , at 7:30 pm., which time is not less than fifteen (15) days from the date of passage of this Resolution, in the Community Room of the Municipal Services Building, 33 Arroyo Drive, South San Francisco, California, is hereby fixed as the time and place when and where all persons interested in, or having objections to, the proposed vacation of Magnolia Avenue from North Canal Street to Railroad Avenue as hereinafter described, may appear before said Council and be heard. 2. A copy of this Resolution shall be published for at least two (2) successive weeks prior to the hearing date in the Enterprise-Journal, a news- paper of general circulation printed and published in said City in the manner prescribed by law for publishing ordinances in said City. 3. Notices of the vacation, stating the passage of the Resolution of Intention and the time and place of hearing shall be posted conspicuously along the line of the street, or part thereof, proposed to be vacated at least two (2) weeks before the date set for the hearing and not less than three (3) notices shall be posted. 4. The public interest and convenience require, and it is the intention of this Council to vacate Magnolia Avenue from North Canal Street to Railraod Avenue as shown on the map entitled plat map which is on file in the office of the City Clerk, and which is more particularly described in Exhibit "A" attached hereto. 5. The public interest, convenience and necessity require the reservation of public service easements, which are more particularly described in Exhibit "B" attached hereto and by this reference incorporated herein as though set forth verbatim; and the vacation proceedings are taken subject to such reservations. The City Council does hereby reserve and except from such proceedings the public service easements within the areas described in Exhibit "B." 6. This vacation proceeding is conducted pursuant to Chapter 3 of the Public Streets, Highways and Service Easements Vacation Law (commencing with Streets & Highways Code Section 8300 et. seq.) I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 27th day of March , 1985, by the following vote: AYES: Councilmembers Mark N. Addiego, Emanuele N. Damonte, Richard A. Avenue as shown uponthat certain Subdivision Map of "Plat No. 2, Subdivision of Blocks 98, 99, 119 $ 122,. South San Francisco, Cal." recorded November 10, 1900 in Volume 3 of Subdivision Maps at Page 4: official records of San Mateo County; thence south 15° 35' west, 100.00 feet to a point on the southerly right-of-way line of the Southern. Pacific Transportation Company right-of-way, as described in the deed from the South San Francisco Tmnd and Improvement Company to the Southern Pacific Company dated September 21,1893, recorded December. 1,~1893 at Book 67 of Deeds at Page 21, officia!records of San Mateo County, being also the True Point of Beginning.
