CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING ISSUANCE OF A PER- MIT TO CONSTRUCT AND OPERATE A SPUR TRACK ACROSS BUTLER ROAD EAST OF THE INTERSECTION OF ECCLES AVENUE BE IT RESOLVED by the City Council of the City of South San Francisco that a spur track permit is hereby issued to Southern Pacific Company, a corporation, to construct and operate a spur track across Butler Road immediately east of the intersection of Eccles Avenue in the City of South San Francisco, said track to connect to the existing tracks along Butler Road at the intersection of Eccles Avenue and cross- ing Butler Road in a southeasterly direction along a curve having a radius of 328 feet plus or minus and crossing the southerly right-of-way line of Butler Road approximately 250 feet east of the center line of Eccles Avenue, the location of which is delineated on the map attached hereto marked Ex- hibit "A". BE IT FURTHER RESOLVED that said permit be issued on the following terms and conditions: 1. That the trackage shall be constructed as nearly as possible level with the present street grading of Butler Road. 2. That the permittee, Southern Pacific Company, a cor- poration, shall maintain and keep in repair the trackage and street crossings by said trackage extending two (2) feet on each side of said trackage. 3. That in the event said trackage is abandoned and no longer required for service, permittee shall remove the trackage, or cause it to be removed, at is own expense, and at no cost to the City of South San Francisco, and shall re- store the surface of the street and the bed in accordance with specifications of the City of South San Francisco. 4. That permittee, Southern Pacific Company, a cor- poration, shall hold City harmless from any claims, suits or demands arising out of personal injury or property damage caused by construction, operation, mmintenance, repair or condition of said trackage and area contained between lines two (2) feet on each side of said trackage, and shall fur- ther defend any and all suits, claims or demands brought be- cause of personal injury or property damage. 5. That permittee, Southern Pacific Company, a corpor- ation, shall install, maintain and operate sufficient safety signals, or other precautions, required to keep said crossings safe for the public to travel over and across; and should the original installation of crossing signals prove inadequate be- cause of increased traffic or because of other matters, per- mittee shall modify or install safety precautions or signals adequate to meet said increase in traffic or other matters. That the original installation shall be reflectorized crossing signs. 6. That this trackage shall be used as industrial track- age and not as a main line or any portion thereof. I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 6th day of Aoril , 1964 , by AYES, COUNCILMEN the following vote: Patrick E. Ahern, Emilio Cortesi, Andrew Rocca, G. J.
