HomeMy WebLinkAboutReso 3933-1964RESOLUTION NO. 3933 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION PROPOSING EXCHANGE OF LAND AND OTHER CONSIDERATION FOR MAGNOLIA SCHOOL PROPERTY BE IT RESOLVED by the City Council of the City of South San Francisco that: WHEREAS, the plat entitled "INGRESS AND EGRESS STUDY CIVIC CULTURAL ARTS CENTER (MAGNOLIA SCHOOL)", attached here- to as Exhibit "A", generally shows the Magnolia School site and the respective parcels of the City of South San Francis- co, hereinafter designated "City", and the South San Francis- co Unified School District, hereinafter designated "District", and, WHEREAS, District by Deed dated September 4, 1956, a copy of which is attached hereto as Exhibit "B", conveyed to City Parcel I as shown on Exhibit "A'"'together with right of access thereto over existing sidewalks, walkways and driveways of grantor", for which City paid a consideration of One Hundred and Fifty Thousand Dollars ($150,0OO), and, WHEREAS, District at the time of said conveyance contem- plated the use of the portions of Parcel II and/or Parcel III for a District facility with provisions for joint use of the remaining portion of Parcels II and III for joint parking facilities to accommodate the proposed Cultural Arts Center of City and proposed District facility, and City is informed that District no longer intends to construct said proposed facility, and, WHEREAS, City owns a parcel of land set forth in the des- cription entitled "SOUTHWOOD TOT LOT" attached hereto as Exhibit "C" which is currently being used by District for the purposes of an entranceway and parking lot to service the Southwood School, and, WHEREAS, City desires to acquire the underlying fee in Parcel II and all of District'm right, title and interest in Parcel III as shown on Exhibit "A" attached hereto in exchange for City's conveyance to District of City's right, title and interest in the parcel designated as "SOUTHWOOD TOT LOT" described in Exhibit "C" attached hereto, and the payment by City to District of Forty Thousand Dollars $40,000), and, WHEREAS, City proposes to schedule the appropriation of approximately Two Hundred and Fifty Thousand Dollars ($250,000) to convert the Magnolia School Building into a Civic Cul- tural Arts Center in accordance with plans entitled "South San Francisco Cultural Arts Center", which plans are marked as Exhibit "D" and submitted herewith, and therefore desires to acquire Parcels II and III as shown on Exhibit "A" to provide space for parking facilities to serve said Center. NOW, THEREFORE, BE IT RESOLVED that the City Council does by this Resolution 1. Request that the Board of Trustees of the South San Francisco Unified School District consider the conveyance to City of the underlying fee in Parcel II and the District's right, title and interest in Parcel III as shown on Exhibit "A" attached hereto in exchange for City's conveyance to District of the parcel designated as "SOUTHWOOD TOT LOT" as described in Exhibit "C" attached hereto, and the payment by City to District of the sum of Forty Thousand Dollars ($4O,OOO). 2. Request that the Board of Trustees of the South San Francisco Unified School District authorize the negoti- ation of an agreement between the City and District to develop and formally express the terms for such an exchange, should the Trustees concur with the suggestions herein con- tained, and include in said negotiation the necessary con- ferences with the Local Allocation Division of the State of California, and upon completion of such negotiation submit drafts of an agreement to the respective Boards for formal action.
