HomeMy WebLinkAboutReso 3970-1964RESOLUTION NO. 3970 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA RESOLUTION OF INTENTION TO VACATE A PART OF OLD SAN BRUNO ROAD BE IT RESOLVED by the City Council of the City of South San Francisco as follows: 1. This Resolution of Intention is adopted pursuant to the Street Vacation Act of 1941. 2. The public interest and convenience requires, and it is the intention of this Council to vacate the right of way for street and highway purposes over a part of Old San Bruno Road described as follows: All that certain real property situate iu the City of South San Francisco, County of San Mateo, State of California and more particularly described as follows: BEGINNING at a point on the Easterly line of the former San Bruno Road, which point is the North- westerly corner of that certain 3.341 Acre portion of Parcel 26 as described in the deed from the City and County of San Francisco to Ed R. Guerin and wife, dated November 3, 1948 and recorded November 24, 1948 iu Book 1596 of Official Records of San Mateo County at page 544, which is also the Southeasterly corner of Parcel 8, Lowrie Avenue Improvement, Right of Way Acquisition Map; t~euce proceedin~ iua Southwesterly direction South Iv 22' 54" West ~or a distance of 43.54 feet to a point; thence proceeding in a South- westerly direction ou the arc of a curve to the left having au angle of 17° 36' 59", a radius of 696.15 feet and au arc length of 215.82 feet to a point which meets the arc of a reverse curve bearing to the right with a radius of 25.10 feet, a central angle of 39° 32' 30" and proceeding on the arc of this curve for a distance of 17.32 feet to a point which is ou the east property line of the Ken E. Royce property; thence turnin~ and proceeding in a Northeasterly direction North ~o 22' 54" East, a distance of 389.12 feet to a point ou the southerly property line of the present Lowrie Avenue; thence turning and proceeding in a South- easterly direction on the ~rc °f4a"curve7 to the left with a central angle of 34v 55' , a radius of 150 feet and au arc length of 91.44 feet to a point which will be the end of the arc and the beginning of a tangent. Pro~ ceedin~ on this tangent iua Southeasterly direction South ~0© 21' 22" E~st for a distance of 3.57 feet to a point ou the easterly line of old San Bruno Road and then turning and proceeding in a Southwesterly direction South lO 22' 54" West, a distance of 5?.42 feet to the true point of beginning. The entire area being approximately 0.343 Acres. 3. The public interest convenience and necessity requires the reservation of easements and right of way here- inafter set forth and the vacation proceedings are taken subject to such reservations and exceptions. The City intends to and does reserve and except from the vacation the following: A. No structure shall be constructed on the afore- going parcel which will obstruct the view of Lowrie Avenue from San Mateo Avenue iu said City, or vice versa. B. Public easements for the construction or re- construction' improvement, maintenance and operation of water mains, sewer mains and other utilities and, wighout limiting the generality of the foregoing exception, there is specifically reserved au easement for water mains and appurtenances and for the construction, re- construction and maintenance of same in, over, across and upon said parcel as required by the City and County of San Francisco. C. Au easement over Parcel 9 and 12, Block 1, (Lowrie Avenue Improvement Right of Way Acquisition Map) to accommodate the 27-inch V. C. P. sanitary sewer line owned by the City of South San Francisco and the 4-inch high pressure gas line owned by the P.G.&E. Co., both facilities running easterly of the property of Ken E. Royce Co. described as follows: All that certain real property situate iu the City of South San Francisco, County of San Mateo, State of California, more particularly described as follows: Starting at the Southwesterly corner of Lot 29, Block l, as said lot and block are shown ou that certain map entitled "Person & Swanson Industrial Tract", South San Francisco, San Mateo County, California, as filed for record ou September 5, 1961 in Book 55 of Maps at pages 12 and lB iu the office of the County Recorder of San Mateo Couut~; thence proceeding in a Southwesterly direction South 89 51' 34" v West 66.02 feet to a point; thence turnium and proceedinm in a Northeasterly direc- tion, North 1O 22' 54" East ~or a distance of 125.33 feet to a point which is the true point of beginning; thence turnin~ and proceeding in a Southeasterly direction ou the arc of a curve to the left having a radius of 150 feet, a~ arc length of 49.0 feet and a central angle of 22 44' 22"~to a point on the Northwesterly property line of Lowrie Avenue, which point is on the arc of the curve and the easterly easement easement line; thence turniu~ and ~roceedin~ in a Southwesterly direction South 4© 57' 54~ West fo~ a distance of 122.5 feet to a point; thence turning and proceeding iua Southeasterly direction South 3© 04' 36" East for a distance of 105.8 feet to a point (which point is on the westerly property line of San Mateo Avenue); thence turning iua Southwesterly direction ou the arc of a curve to the left, with a radius of 696.15 feet, a central angle of 9© 19' 00" and au arc length of 109.3 feet to a point, this point being the beginning of a reverse curve bearing to the right having a radius of 25.10 feet, a central angle of 39© 32' 10" and au arc length of 17.32 feet to a point ou the easterly line of the Ken ~. Royce property; thence turning and proceeding in a Northeasterly direction North 1© 22' 54" East 389.12 feet to the true point of beginning, this easement as set forth above is to include the existing 2?-inch V. C. P. sanitary sewer and manhole owned by the City of South San F~ancisco and also the 4-inch high pressure gas main and appurtenances owned by the Pacific Gas & Electric Company. D. An easement 5 feet on either side of the 2-inch Water Service, from California Water Service 8-inch main to the Ken F~ Royce Co. property in South San Francisco described as follows: All that certain real property situate in the City of South San Francisco, County of San Mateo, State of California, more particularly described as follows: Starting at the Southwesterly corner of Lot 29, Block l, as said lot and block are shown on that certain~ map entitled "Person & Swanson Industrial Tract", South San Francisco, San Mateo County, California, as filed for record on September 5, 1961 iu Book 55 of Maps at pages 12 and 13 in the office of the County Recorder of San Mateo Couut~; thence proceedin~ in a Southwesterly direction South 89° 51' 34" - West for a distance of 30 feet; thence turuiu~ and ~roceediu~ iua Southwesterly direction South 1° ~2' 54' West fo9 a distance of 92.2 feet to a point, which is the true point of beginning; thence from this point the easement will be 5 feet ou either side of the following described line, from the true point of be~inniu2 proceeding iua Southwesterly direction South 89© 51~ 34" West for a distance of 36.0 feet to a point on the easterly property line of the Ken F. Royce property described as follows: All that certain real property situate iu the City of South San Francisco, County of San Mateo, State of California, more particularly described as follows: BEGINNING at the Southwesterly corner of Lot 29, Block l, as said lot and block are shown on that certain map entitled "Person & Swanson Industrial Tract", South San Francisco, San Mateo County, California, as filed for record on September 5, 1961 iu Book 55 of Maps at pages 12 and lB iu the office of the County; thence proceeding iua Southwesterly direction South 1© 22' 54" West for a distance of 43.54 feet to a point; thence turning and proceeding along the arc of a curve which bears left, with a radius of 696.15 feet, a central - 18" an~le of 6v 39~ and au arc distance of 81.53 feet to a point; thence turning and proceeding in a North- easterly direction North 1° 22' 54" East for a distance of 197.72 feet to a point; thence turning and proceeding in a Southeasterly direction on the arc of a curve to the left with a radius of 150 feet an arc distance of 32.60 feet and a central an~le~ of ~2° 27' 55" to a point; thence proceeding in a Southeasterly direction South 60° 21' 22" East for a distance of 3.57 feet to a point; thence turning and proceediu~ in a Southwesterly direction South 1° 22' 54" West, 57.4~ feet to the point of beginning. 4. Notice is hereby given that Monday, the 20th day of July , 1964 , at 8:00 o'clock p.m. iu the Council Chambers, City Hall, South San Francisco, is hereby fixed as the time and place when and where all persons inter- ested in, or having objections to the proposed vacation of a part of old San Bruno Road as hereinbefore described, may appear before said Council and be heard. 5. Reference is hereby made to the map or plan entitled "portion of old San Bruno Road to be vacated, dated 7-23-63" which is on file iu the office of the City Clerk for parti- culars as to the proposed vacation. 6. Notice of the Vacation of the part of old San Bruno Road shall be posted conspicuously along the line of said road or part thereof to be vacated at least ten (10) days before the date set for hearing and said notice shall be posted not more than 300 feet apart and not less than three (3) of said notices shall be posted. 7. A copy of this resdlutiou shall be published once iu the Enterprise Journal, a newspaper of general circulation printed and published iu said City herein within fifteen (15) days after adoption. 0 I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the re2ular meeting held , 1964 , by City of South San Francisco at a this ]55h day of June the following vote: AYES, COUNCILMEN NOES, " ABSENT, " Patrick E.
