HomeMy WebLinkAboutReso 3991-1964RESOLUTION NO. 3991 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION VACATING A PUBLIC SERVICE EASEMENT FOR SEWER AND STORM DRAIN PUR- POSES OVER THE DEVINCENZI PROPERTY BE IT RESOLVED by the City Council of the City of South San Francisco that: WHEREAS, a public service utility easement for sewer and storm drain purposes over, across, through and under the parcel over property hereinafter described was dedicated to the City of South San Francisco on the ~Obh day of Januarw , 19 64 , and filed for record on the 3rd day of February, 1964, Document 85633-W, in Volume 4639~ at page 155, San Marco County Records, and, WHEREAS, except for the portion hereinafter reserved and excepted, said five-foot public service easement has not been used for the purposes for which it was dedicated nor is it necessary for present or prospective public use. WHEREAS, the public interest, convenience and necessity requires the reservation of the easement hereinafter set forth and these vacation proceedings are taken subject to such reservation and exception. NOW, THEREFORE, IT IS ORDERED that: I. The public service easement for sewer and storm drain purposes granted by Emanuele Damonte, and Emanuele Damonte as Attorney in Fact for Maria Musante, also known as Marie Bacigalupi, Mary Devincenzi, also known as Marie Casalini, Alfred Berretta, Frank Devincenzi, Anthony Berretta, Lillian Casentini on the 17th day of January, 1964 (recorded the 3rd day of February, Document 85633-W, in Volume 4639, page 155, San Mateo County Records)over, across, through and under the following land situate in the County of San Mateo, State of California is hereby vacated and abandoned: A 5-foot strip of land lying Southwesterly of, and parallel and adjacent to, the Northwesterly property line of the Devincenzi property extending from the Southwesterly property line of Mission Road to the Northeasterly property line of the Southern Pacific Company's right of way and more particularly described as follows: A.Long the sald line of Mission Road North 40°54' West 277.20 feet; th~nce North A9°C9' W~st ~q2.1>i feet to the Wesger£y line of said Devincenzi property; thence leaving said City corporate limit line of the City of SoUth San Francisco and the Southwesterly line of Mission Road South 42°36' West 146.52 feet to a point in the Northeasterly right of way line of the Southern Pacific Company; thence Southeasterly on and along said Southern Pacific Company right of way line 337.26 feet to a point of intersection of the divi- sion fence line mentioned above; thence on and along said division fence line North 42o36' East 106.26 feet; returning to the existing corporate limit of the City of South San Francisco and the point of beginning. Said area contains approximately one acre. II. The public interest, convenience and necessity re- quires the reservation of the easement hereinafter set forth and these vacation proceedings are taken subject to such re- servation and exception; and the City does hereby reserve and except from aforegoing vacation and abandonment the following: A public service easement for sewer and storm drain purposes over, across, through and under the following land situate in the County of San Mateo, State of California: A 5'-0" wide strip of land located Southeasterly of, and parallel and adjacent to, the Northwesterly property line of the Devincenzi property extending from the Southwesterly right of way line of Mission Road to the Northeasterly property line of the Southern Pacific Company's right of way and more particularly described as follows: BEGINNING at a point that is the intersection of the Southwesterly right of way of Mission Road and North- westerly property line of the Devincenzi property as said property line is described in that deed recorded in Book 195 of Deeds at page 244, San Mateo County Records, thence from said point of beginning in a Southwesterly direction on and along said Northwesterly property line South 42o36' West 146.52 feet to the Westerly corner of Devincenzi parcel; thence South- easterly South 50o33' East 5.01 feet along the South- westerly property line of the Devincenzi property; thence leaving sai~ property line in a Northeasterly direction North 42 36' East 146.40 feet to the South- westerly line of Mission Road; thence Northerly along said Mission Road right of way line North 49 09' West 5.00 feet to the point of beginning. III. Said vacation and abandonment shall not release, vacate or abandon any other easement granted or in use over said parcel and particularly shall not vacate and abandon the easement for street and highway purposes conveyed by the same Grantors tO City in the Grant, dated 17th day of Januar~ , 196~ . IV. The City~Clerk of said City shall cause a certified copy of this resolution, attested under the seal of said City to be recorded in the office of the County Recorder of the County of San Mateo.
