HomeMy WebLinkAboutReso 80-2011 RESOLUTION NO. 80 -2011 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ESTABLISHING INCREASED SEWER RATES EFFECTIVE FISCAL YEAR 2011 -2012, AMENDING THE MASTER FEE SCHEDULE TO INCLUDE THE RATES; AND ADOPTING A REPORT OF ANNUAL SEWER RENTALS OR CHARGES FOR FISCAL YEAR 2011 -2012 WHEREAS, by Chapter 14.12 of the South San Francisco Municipal Code the City Council is authorized to establish sewer rates by resolution; and WHEREAS, on June 24, 2009, the City Council reviewed the implementation of the 5- year rate increases of 20% for 2009 -2010, 10% for 2010 -2011, 5% for 2011 -2012, and 0% for 2012 -2013 and 2013 -2014, after a properly noticed public hearing at which there was not a majority protest, the City Council approved the sewer rate increase to finance improvements to the City's sewer collection, pumping and treatment facilities; and WHEREAS, in June of 2011, as required by law, notice of the proposed increase and the public hearing was published in a newspaper of general circulation; and WHEREAS, the City Council has given notice and on June 22, 2011, held a public hearing as required by law on the subject sewer rates; and WHEREAS, the rates reflected in the report of Annual Sewer Rentals and charges are consistent with the five -year financing plan. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of South San Francisco hereby approve the schedule of rates set forth in the attached Exhibit "A" which implements the previously approved financing plan, and herby amends the City's Master Fee Schedule to include the rates. BE IT FURTHER RESOLVED that the City Council hereby adopts the Report of Annual Sewer Rentals and Charges for Fiscal Year 2011 -2012, and directs that the rates so established shall be collected on the official tax assessment roll, together with real property taxes, and that the amount shall constitute liens upon the properties which shall be effective at the same time and to the same extent as is provided for by law in the case of real property taxes, with like penalties for delinquencies. * * * * * I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 22 day of June 2011 by the following vote: AYES: Councilmembers Mark Addiego and Pedro Gonzalez, Vice Mayor Richard A. The user will be reclassified to the light strength use classification if it adequately demonstrates to the City Engineer it is discharging only segregated or wastewater equivalent in strength to residential wastewater. The City is proposing to increase sewer rates. The purpose of the proposed increase is to finance improvements to the City's sewer collection, pumping and treatment facilities. The improvements are necessary to comply with State and Federal water quality requirements, to reduce the overflow of raw sewage during the wet weather season events and to provide additional reliability of the City's facilities. The improvements include rehabilitation of sewer collection lines, upgrades to pump stations, and upgrades to the treatment plant as well as all related administrative and incidental costs, including the costs of financing the sewer improvements. 2. A description of how the rates are calculated and the proposed schedule of rate increases are available at the Water Quality Control Plant located at 195 Belle Air Road, South San Francisco. If the rate increases are approved, it is proposed that they will commence to be collected with the property taxes beginning with Fiscal Year 2011-12 and will continue to be collected until otherwise modified by the City. The sewer rates will not exceed the maximum amounts shown without another written notice to the property owners. 3. Before taking final action on the proposed rate increase, the City Council will hold a PUBLIC HEARING on Wednesday, June 22, 2011, at 7:00 p.m. in the City Council Chambers, Municipal Services Building, 33 Arroyo Dr., So. San Francisco. The Public Hearing will be for hearing public testimony on the proposed sewer rate increase. The Council may continue the hearing from time to time without further written notice. 4. Any property owner may file with the City Clerk, at any time before the end of the Public Hearing, written comments regarding the proposed rate increase which will be made present and heard at the public meeting. 5. Rates for residential properties are calculated by multiplying the number of dwelling units on each property by the annual rate. The dwelling unit rate for Single Residential and Multiple Residential assumes an "average" annual effluent flow of 8,400 cubic feet, The trailer unit rate assumes an "average" annual effluent flow of 7500 cubic feet. Commercial and Institutional Rates. Restaurant, Institutional and Commercial Rates are calculated by: A) Measuring the annual water use at each property and multiplying this usage by the inflow rate; or by B) Measuring the annual sewer flow from each property and multiplying by the effluent rate, Industrial Rates. Industrial Rates are calculated based on the annual amount of flow, chemical oxygen demand and solids from each property. Separate sewer rates are calculated for each component and then added for the total sewer fee per assessor's parcel. Annual measurement and testing are performed at each assessor's parcel to confirm the flow and loading. Septage Rates. Septage rates are calculated by multiplying the gallons of flow discharged from the septic pumper by the septage rate. The report describes the procedure of charging those parcels of real property. which directly receive the benefits of municipal sanitary sewer services and the amount of the annual charge or rental. which will be imposed against each parcel for Fiscal Year 2011-2012. 1. Summary of Rentals or Charges. The following is a summary of the annual rental or charges for 2011-2012. Sewer Rental Account File.
