HomeMy WebLinkAboutReso 4158-1965RESOLUTION NO. ~158 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STA%E OF CALIFORNIA A RESOLUTION GRANTING VARIANCES RECOMMENDED IN PLANNING COMMISSION RESOLUTION NO. 1834 FOR CAESAR-CALLAN HOMES, INC. BE IT RESOLVED by the City Council of the City of Sough San Francisco that: WHEREAS, the City Council has received the Planning Commission's written findings of fact, showing that the qualifications under Section 6.31(a) of the Zoning Ordin- ance as amended, apply to the land, buildings a~d use for which the variance was sought, and that the variance will be in harmony with the general purpose of the O~dinance and the recommendations of said Commission, all contained in Resolution Noo1834 , passed the llth day of January 1965 and attachments thereto, and WHEREAS, the City Council duly considered :~ame and the effect of said variances; NOW, THEREFORE, IT IS ORDERED that 1. The City Council finds ao That ~here are exceptional or extraordinary circumstances or conditions applying to the land, building or use referred to in the application, which circumstances or conditions do not apply generally to land, buildings or uses in the same district. bo That the granting of the application is necessary for the preservation and enjoyment of sub- stantial property rights of the petitioner. Co That the granting of the application will not, under the circumstances of the particular case, materially affect adversely the health or safety of persons residing or working in the neighborhood of the property of the applicant, and will not, un- der the circumstances of the particular case, be materially detrimental to the public welfare or in- jurious to property or improvements in said neighbor- hood. d. That by providing common green areas, the normal yard areas required in the conventional sub- division are not necessary° eo That in order to carry out the intent of the planned unit concept, the grant of this variance is essential° fo That the variance will be in harmony with the general purpose of this Ordinance. 2. The City Council orders that the variance as re- commended by the Planning Commission in Resolution No..!834, passed the llth day of January , 1965 , on the terms and conditions set forth in said Commission's recom- mendation, be granted. I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a meeting held on the 1st day of 19 65 , by the following vote: AYES, COUNCILM~N re~u[ar_ March Patrick E.
