HomeMy WebLinkAboutReso 4169-1965RESOLUTION NO. 4169 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION GRANTING VARIANCES RECOMMENDED IN PLANNING COMMISSION RESOLUTION NOS.1840, 1841 AND 1842 - WESTBOROUGH UNIT #5 BE IT RESOLVED by the City Council of the City of South San Francisco that: WHEREAS, the City Council has received the Planning Commission's written findings of fact, showing that the qualifications under Section 6.31(a) of the Zoning Ordin- ance as amended, apply to the land, buildings and use for which the variances were sought, and that the variances will be in harmony with the general purpose of the Ordin- ance and the recommendations of said Commission, all con- tained in Resolutions Nos.1840, 1841 and 1842, passed the 25th day of January, 1965, and attachments thereto, and, WHEREAS, the City Council duly considered same and the effect of said variances; NOW, THEREFORE, IT IS ORDERED that: 1. The City Council finds a~ That there are exceptional or extraordinary circumstances or conditions applying to the land, building or use referred to in the application, which circumstances or conditions do not apply generally to land, buildings or uses in the same district. b. That the granting of the application is necessary for the preservation and enjoyment of substantial property rights of the petitioner. c. That the granting of the application will not, under the circumstances of the particular case, materially affect adversely the health or safety of persons residing or worki.§ in the neighborhood of the property of the applicant, and will not, un- der the circumstances of the particular case, be materially detrimental to the public welfare or jurious to property or improvements in said neighbor- hood. d. That by providing common greens, the normal yard areas required in the conventional subdivision are not necessary. e. That in order to carry out the intent of the planned unit concept, the grant of this variance is essential. 2. The City Council orders that the variance as re- commended by the Planning Commission in Resolutions Nos. 1840, 1841 and 1842, passed the 25th day of January, 1965, on the terms and conditions set forth in said Commission's recommendation, be granted. I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of regular March , 19,.65, the City of South San Francisco at a meeting held on the 15th day of by the following vote: AYES, COUNCILMEN Patrick E.
