HomeMy WebLinkAboutReso 4197-1965RESOLUTION NO. 4197 A RESOLUTION APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY TO THE CITY OF SOUTH SAN FRANCISCO ANNEXATION OF WESTBOROUGH HOMES LANDS - 1965-1 (PARCEL l) RESOLVED, by the City Council of the City of South San Francisco, California, that WHEREAS, on the 5th day of April, 1965, said Council did pass and adopt its Resolution No. 4171 giving notice of the proposal to annex certain uninhabited territory to the City of South San Francisco, said territory being therein designated as "Annexation of Westborough Homes Lands - 1965-1 (Parcel 1)", and said action being taken by the Council of said City as the legislative body of the City pursuant to a written Petition and Consent signed by the owners of all of the land therein described, said resolution describing the bounda- ries of the territory so proposed to be annexed to said City~ WHEREAS, said resolution did contain a notice of the day, hour and place when and where the said Council of said City would hear protests made by any person owning property within the City who does not also own property in the territory proposed to be annexed, the time of said hearing being not more than thirty days from the date of the passage of said resolution~ WHEREAS, on the 19th day of April, 1965, at the hour of 8:00 o'clock P. M., in the Council Chambers, City Hall, South San Fran- cisco, California, said time and place being the day, hour and place fixed in said resolution for hearing protests to said annexa- tion, the said Council of said City did hear and pass upon all protests made to said proposed annexation~ and WHEREAS, said territory is contiguous to the City of South San Francisco and is uninhabited territory within the territory of the City of Daly City, which City has heretofore consented to said territory's detachment therefrom, and all of the applicable procedural requirements of the Annexation of Uninhabited Territory Act of 1939 (commencing at Section 35300 of the Government Code), and particularly Sections 35304 and 35310.1 thereof, have been fully complied with; NOW, THEREFORE, IT IS HEREBY ORDERED, as follows: 1. That the said Council of the City of South San Francisco does hereby approve the annexation of said territory, hereinafter described, to the City of South San Francisco and does hereby further resolve that the said territory be, and is hereby, annexed to the City of South San Francisco. 2. That said territory, the annexation of which to the City of South San Francisco is hereby approved, is all that territory situate in the County of San Mateo, State of California, more particularly described in Exhibit "A" hereto attached and by reference made a part hereof. 3. That the City Clerk is hereby directed to prepare under seal a certified copy of this resolution, giving the date of its passage, and transmit it to the Secretary of State of the State of California. I hereby certify that the foregoing resolution was regularly intro- duced and adopted by the City Council of the City of South San Francisco at a reqular meeting held this 19th day of April 1965, by the following vote: AYSS, COUNCIL~N NOES, " ABSENT, " Frank J. Rozzi None None ATTEST: CITY~ CL~RK -2- EXHIBIT "A" ANNEXATION OF WESTBOROUGH HOMES LANDS - 1965-1 (PARCEL 1) BEGINNING at the northwesterly corner of the 94.91 acre tract allotted to John Brooks by Decree in Partition in Action entitled, "Ansel I. Easton, et al, vs. Charles Lux, et al," recorded in Volume l0 of Deeds, at Page l, in the Office of the Recorder of the County of San Mateo, State of California, said point also being on the northerly boundary line of the land conveyed to Style Kraft Homes, Inc., by Deed dated November 3, 1958, and recorded in Volume 3516 of Official Records, at Page 529, Records of San Mateo County; thence from said point of beginning North 28° 59' West 94.12 feet to a point; thence northeasterly on an arc of a curve to the left, the center of which bears North 7° 51' 04' West 840 feet from the last mentioned point, with a radius of 840 feet, a central angle of ll° 56' 24", an arc distance of 175.05 feet to said northerly line conveyed to Style Kraft Homes, Inc.; thence along said northerly line South 45° 00' West 175.46 feet to the point of beginning. CONTAINING 7,405 SQ. FT.
