HomeMy WebLinkAboutReso 4245-1965RESOLUTION NO. 42%5 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION GRANTING A USE PERMIT TO SOUTH CITY LUMBER AND SUPPLY COMPANY TO ESTABLISH A DRIVE-IN THEATER IN AN M-1-H DISTRICT ON THE PARCEL BOUNDED BY SPRUCE AVENUE AND RAIL- ROAD AVENUE, PARTICULARLY DESCRIBED AS ASSESSOR'S PARCEL NO.14-O61-1, 2, 3. BE IT RESOLVED by the City Council of the City of South San Francisco that: WHEREAS, the City Council has received the report and recommendations of the Planning Commission set forth in the Commission's Resolution No.1909, passed May 24, 1965, and also the Planning Officer's report, Findings of Fact, and Summary of Hearings, and has also received several and various documents and com~munications and received oral pre- sentations from several persons now present, each and all of which have been considered and made part of the record of this proceeding, and, WHEREAS, the Council has duly considered same and evaluated the proposed use and its effects. NOW, THEREFORE: 1. The Council does find, upon the report and recom- mendations of the Planning Commission set forth in Resolution No.1909, passed May 24, 1965, and the Planning Officer's re- port, S,~mmmry of Hearings and Findings of Fact, and the several and various documents and co~nications received and the oral presentations made by the several persons now present, all of which have been considered and made part of the record of the proceeding herein, that said use will not under the circumstances of the particular case be detrimental to the health, safety, peace, morals, com- fort and general welfare of persons residing or work- ing in the neighborhood of such proposed use and will not be detrimental or injurious to property and improve- ments in the neighborhood or the general welfare of the City. 2. The Council does order that: a. A Use Permit issue to South City Lumber and Supply Company to establish a Drive-In Theater in an M-1-H District on the parcel bounded by Spruce Avenue and Railroad Avenue, particularly described as Assessor's Parcel No.14-061, 2, 3; on the terms and conditions as recommended by the Planning Com- mission in its Resolution No.1909, passed May 24, 1965, which conditions are as follows: 1. The Railroad Avenue exit be at right angle to the street and have a 40' turning radius. The Spruce Avenue entrance have 11' storage lanes, and a 40' turning radius with a 75' ingress and egress lane on Spruce Avenue. 3. Grading drainage and improvement plans be filed and approved by the Director of Public Works prior to issuance of a Building Permit. 4. Necessary fire prevention measures such as fire plugs, water supply and sprinkling sys- tems be shown on improvement and/or building plans and shall meet the specifications of the Fire Chief and be approved by the Fire Chief prior to issuance of a Building Permit. 5. The flood lights be located so as not to shine into the residential area. 6. The improvement and landscape plans show a sprinkler~system, or similar, for landscape maintenance. 7. That landscape plans indicating type, size and number of plants, be submittedwith build- ing plans for Architectural approval showing: (a) Ground cover, shrubs and trees alon8 Railroad Avenue across from the resi- dential area. This planted, area will be on the theater property or permis- sion be obtained and documented with the City from the railroad company to use a portion of their R/W. (b) Show more planting area at the Spruce Avenue entrance. (c) Show low type planting around the ser- vice buildings in the center of the parking area. The screen be located at the westerly edge of the property with the driveways in front instead of behind the screen. No advertising signs will be allowed on the inside or outside of the fence. 10. If a serious police problem should arise, the Police Chief shall request a review of this Use Permit before the Planning Comission to show cause why the permit should not be revoked. b. These further conditions and qualifications are hereby designated by the Council: That South City Lumber and Supply Company, Permittee herein, shall install at its sole cost and expense a standard curb, gutter and sidewalk on the east side of Spruce Avenue from Railroad Avenue to the proposed theater entrance. That this Use Permit may be revoked for cause or for violation of any of the terms and con- ditions thereof upon appropriate proceedings pursuant to the applicable section of the Zoning Ordinance.
