CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION AUTHORIZING NEGOTIATIONS OF
AN AMENDMENT EXTENDING THE AGREEMENT WITH
UTAH CONSTRUCTION CO. FROM SAN BRUNO
SHOALS AND THE TRANSMISSION OF THE PRO-
POSED AMENDMENT TO THE COUNCIL FOR APPROVAL
BE IT RESOLVED by the City Council of the City of
South San Francisco that
WHEREAS, the City of South San Francisco and Utah
Construction Co., by agreement dated the 7th day of Janu-
ary, 1957, the terms of which were extended pursuant to
options therein contained to the 7th day of January, 1967,
provided for dredging and fill materials from San Bruno
shoals and,
WHEREAS, Utah Construction Co. has proposed an ex-
tension of the term to and including the 7th day of Janu-
ary, 1972, and City desires to approve such extension, pro-
viding certain terms and conditions are negotiated and
submitted to the City Council for approval;
NOW, THEREFORE, IT IS ORDERED that:
1. The City Council does hereby declare its intention
to negotiate an extension of the term of the agreement
between City and Utah Construction Co. dated the 7th
day of January, 1967, and
2. The City Council authorizes the City Manager to
negotiate with Utah Construction Co. for the inclusion in
the extension agreement of terms which will provide for
a. The guaranteed removal of not less than
one million cubic yards per year at not less than
five cents (5¢) per cubic yard for five (5) years,
and,
b. Performance of the dredging operation in
such a manner as not to leave dangerous or hazard-
ous conditions or unstable slopes, and,
c. A satisfactory method of computing and
establishing th~ number of cubic yards removed from
the site.
3. The negotiated proposal be submitted to the City
Council for approval.
I hereby certify that the foregoing Resolution was
regularly introduced and adopted by the City Council of
the City of South San Francisco at a regular
meeting held on the 20%h day of SeD%embe~ ,
