HomeMy WebLinkAboutReso 4384-1966RESOLUTION NOo 4384 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ORDERING THE VACATION OF PORTIONS OF FOURTH LANE BETWEEN SPRUCE AND WALNUT AVENUES BE IT RESOLVED by the City Council of the City of South San Francisco that this Council does hereby find, order and determine that: 1. The City Council on the 20th day of December , 19 65 , adopted its Resolution No. 4339 entitled "A RESOLUTION OF INTENTION TO VACATE PORTIONS OF FOURTH LANE BETWEEN SPRUCE AND WALNUT AVENUES". 2. Said resolution recites that the proceedings were undertaken pursuant to the Street Vacation Act of 1941. 3. Said Resolution of Intention was duly published as required by law and Notices of Hearing were duly posted in the time, manner and form provided by law, all as appears from the Affidavit of Publication and the Affi- davit of Posting on file in the office of the City Clerk of said City. 4. Monday, the 17th day of January , 19 66 , at the hour of 8:00 o'clock p.m. in the Council Chambers, City Hall, Grand and Maple Avenues, South San Francisco, California, was fixed in said Resolution of Intention as the time and place when and where any and all persons interested in, or having any objection to, said proposed vacation could appear before said Council and be heard. 5. No objections of any kind or character have been, or were made or filed against said vacation. 6. The public interest, convenience and necessity requires the vacation and abandonment of a street and highway easement over portions of Fourth Lane and the Council does hereby order the vacation and abandonment of the street and highway easement over portions of Fourth Lane between Spruce and Walnut Avenues described as follows: PARCEL f/1 OF FOURTH LANE: A four foot Wide strip of Fourth Lane south of and adjacent to Lot 29, Block ll6 as said Fourth Lane and Block are shown on that certain map entitled "South San Francisco", (Sheet 2 of 2), San Mateo County, California, filed in the Office of the Recorder of the County of San Mateo, State of California, on March 1, 1892, in Volume 2 of Maps at Page 52, and more particularly described as follows: Beginning at the southwesterly corner of Lot 29, said point being the true point of beginning; thence proceeding in a southeasterly direction along the southwesterly line of Lot 29, said line also being the northeasterly line of Fourth Lane, and proceeding along said line South 74° 27' East. 50.00 feet to a point; thence turning and proceeding in a southwesterly direction along the northwesterly line of ¥1alnut Avenue South 1S° $3' West 4.00 feet to a point; thence turning and proceeding in a northwesterly direction North 74° 27' ~st 50.00 feet to a point; thence turning and proceeding in a northeasterly direc- tion North 15° 33' East 4.00 feet to the true point of beginning. PARCEL ~/II OF FOURTH LANE: A portion of Fourth Lane, in Block 116, as Said Fourth Lane and Block are shown on that certain map entitled "South San Francisco", (Sheet 2 of 2), San Mateo County, California, filed in the Offfice ~:~ the Recorder of the County of San Mateo, State'of Califo~nim, ~ Hatch l, 1892, in Volume 2 of Maps at Page 52, and more ~_~icularly described as f~llows: Beginning at the southwesterly corner of Lot 24 which is :rue point of beginning; thence proceeding along the south- ~erly line of Lots 24, 25, 26, 27 and 28, said line also being ~,~ northeasterly line of Fourth Lane, proceeding along said line :~u~h 74° 27~ Eas~ 250.00 feet to a point, said point being the ..-:.~hezsteri¥ corn.;~ of Lot 28; thence turning and proceeding in ...~hwesterly ~:'~ction South 15° 33"'West 20.00 feet to a poxnt, said point '~:~-~ the northeasterly corner of Lot 13; ~hence turning and proceeding along the northeasterly line of ..':,s _~, 14, -o~ l;~ and 17, said line also being the southwesterly ~:. ,~e of Fourth Lana~ proceeding along said line North 74° 27' ~.~.'est .i. The public interest, convenience and neces- sity requires the reservation of easements and rights of way hereinafter set forth and the vacation pro- ceedings and the vacation proceedings are taken subject to such reservations and exceptions. The City does hereby reserve and except from the vacation of the portion of Fouth Lane described hereinbefore as Parcel II the easements for the construction, reconstruction, improvement, maintenance and operation of public utility pipes, lines, conduits, poles and appurtenances thereto, and water mains, sanitary sewer lines, storm sewer mains and appurtenances thereto. 8. The City Clerk of said City shall cause a cer- tified copy of this Resolution and order, attested under the seal of said City, to be recorded in the office of the County Recorder of the County of San Mateo. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held the 21 day of February 19_~_, by the following vote: AYES, COUNCILMEN NOES, " ABSENT, " Prank J.
