A RESOLUTION APPROVING CHANGE ORDER NO. 12
AND DENYING OTHER CLAIMS
CABOT, CABOT & FORBES INDUSTRIAL PARK

RESOLVED, by the City Councml of the City of South San
Francisco, California, that
WHEREAS, this Council has heretofore awarded a contract
for the construction of improvements to Baldwin Warren Company,
Inc., in proceedings conducted pursuant to Resolution of
Intention No. 3939 adopted May 18, 1964;
WHEREAS, said Contractor has filed claims with this City
totalling $234,697.07 for alleged extra work and damages in
connectmon with said contract, and samd claims have been care-
fully analyzed by the Engineer of Work and the City Engineer,
and a report of said analyses submitted to this Council;
NOW, THEREFORE, IT IS ORDERED, as follows:
1. That said claim, to the extent of and in the amounts
set forth in Change Order No. 12, prepared and approved by
Wilsey, Ham & Blair, Engineer of Work, in form a copy of which
is hereto attached and incorporated herein by reference, is
hereby allowed and approved and payment thereof authorized to
be made to said Contractor; subject, however, to the express
conditmon that the total amount thereof, to-wit: $9,585.61,
be tendered to said Contractor in full satisfaction of the
items claimsdas extras and set forth on page 2 of said Change
Order, but without prejudice to any position which the Con-
tractor may have or may allege in connection with the other
items of his claim.

Wilsey, Ham & Blair dated December
29, 1965.

Additional work and pumping
required when Gradall hit exist-
ing sewer line which was not
indicated on the plans near Man-
holes 21 and 47.
$ 414.00
are approved in principle but subject to the providing by
said Contractor of an itemized statement of the precise
amount thereof in form satisfactory to Wilsey, Ham & Blair,
Engineer of Work.
3. That all other items set forth in said claim are
hereby denied.
I hereby certify that the foregoing resolution was regularly intro-
duced and adopted by the City Council of the City of South San Francisco
at a regular meeting held on the 16th day of ~ay, 1966, by the following
