HomeMy WebLinkAboutOrd. 1447-2011 ORDINANCE NO. 1447 -2011 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA AN ORDINANCE ELIMINATING SECTION 3.12.010 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE "POSITIONS," AND AUTHORIZING CITY MANAGER TO PREPARE AND MAINTAIN JOB CLASSIFICATION SYSTEM WHEREAS, the Municipal Code presently requires that every job classification created in the competitive and non - competitive service be listed in the Municipal Code, along with general descriptions of types of non - regular employees and service producers; and WHEREAS, it is inconsistent with a City Manager form of government for the City Council to authorize creation of each job classification and use the Municipal Code for position control; and WHEREAS, staff recommends that City Council adopt an ordinance eliminating Section 3.12.010 of the South San Francisco Municipal Code requiring a listing of all job classifications in the City, and authorizing the City Manager to prepare and maintain a job classification system consistent with efficient administration of the City. NOW, THEREFORE, the City Council of the City of South San Francisco does ORDAIN as follows: SECTION 1. AMENDMENT The City Council hereby amends the South San Francisco Municipal Code by eliminating Section 3.12.010 "Positions;" and authorizes the City Manager to prepare and maintain a City of South San Francisco job classification system consistent with efficient administration of the City. SECTION 2. SEVERABILITY If any provision of this ordinance or the application thereof to any person or circumstance is held invalid or unconstitutional, the remainder of this ordinance, including the application of such part or provision to other persons or circumstances shall not be affected thereby and shall continue in full force and effect. To this end, provisions of this ordinance are severable. The City Council of the City of South San Francisco hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase hereof irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses, or phrases be held unconstitutional, invalid, or unenforceable. SECTION 3. PUBLICATION AND EFFECTIVE DATE This Ordinance shall be published once, with the names of those City Councilmembers voting for or against it, in the South San Francisco Examiner, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption. * * * * * Introduced at a regular meeting of the City Council of the City of South San Francisco, held the 13 day of July, 2011.
