HomeMy WebLinkAboutReso 4625-1967 RESOLUTION NO. 4625 A RESOLUTION ORDERING EXCLUSION OF PORTION OF ASSESSMENT DISTRICT AND MODIFICATION IN SAID BOUNDARIES CABOT, CABOT & FORBES INDUSTRIAL PARK UNIT NO. 2 RESOLVED, by the City Council of the City of South San Francisco, California, that WHEREAS, this Council has received a petition from the owners of property within the assessment district formed pursuant to Resolution of Intention No. 4236, adopted by the City Council of said City on June 28, 1965, for the exclu- sion of a portion of the assessment district formed in said proceedings~ 'WHEREAS, this Council has heretofore expressed its intention, in Resolution No. 4612, adopted by this Council on January 16, 1967, to order a modification in the bounda- ries of the assessment district formed pursuant to said Resolution of Intention; WHEREAS, all of the conditions and events set forth in said Resolution No. 4612 as being prerequisite to the order- ing of said modification have been fulfilled and have hap- pened in due time and form required by law, and this Council has acquired jurisdiction to order said modification; NOW, THEREFORE, IT IS ORDERED, as follows: lo That the portion of said assessment district formed pursuant to said Resolution of Intention, designated Cabot, Cabot & Forbes Industrial Park Unit No. 2-A on the map dated January, 1967, entitled "Map of Boundary of Cabot, Cabot & Forbes Industrial Park Unit NOo 2-A", on file in the office of the City Clerk, is hereby excluded from said assessment district° 2. That the boundaries of said assessment district are hereby modified to conform to the map referred to in said Resolution No. 4612 on file in the office of the County Recorder of the County of San Mateo. 3. That the estimate of cost is hereby modified to show that one-half of the total estimated cost of $3,500,000, or $1,750,000, is to be paid from the Cabot, Cabot & Forbes Industrial Park Unit No. 2 proceedings, and the remaining one-half, or $1,750,000, is to be paid from Cabot, Cabot & Forbes Industrial Park Unit No. 2-Ao 4o That the total assessment is hereby reduced to $1,750,000. 5- That said changes shall be made in the Engineer's Report by filing a new modified report in the office of the City Clerk° 6° That.said Resolution of Intention and said proceed- ings and the estimate of cost are amended to provide that the right is reserved to make contributions to and receive contributions from the assessment proceedings to be under- taken for Cabot, Cabot & Forbes Industrial Park Unit No. 2-A, to the end that all of the costs of the acquisitions and improvements described in each of said proceedings shall be divided and assessed equally therein. 7. That the adoption of this resolution is without prejudice to the right of the Council to initiate and con- summate proceedings forthwith for the formation of a new assessment district, comprised of the area excluded from the present district and to be formed for the purpose of financ- ing one-half of the cost of the acquisition and construction of the work described in said proceedings, together with expenses incidental thereto, pursuant to the original peti- tion and the petition~referred to in this Resolution, and shall not affect in any way the boundaries and existence of Cabot, Cabot & Forbes Industrial Park Unit No. 2 Maintenance 2 District heretofore formed and now existing pursuant to said Resolution of Intention, nor any guarantees heretofore given by the owners to the City, nor in any way affect the Agree- ment for Acquisition of Improvements, dated June 15, 1966, nor in any way affect the Agreement Between Landowners and Declarations Concerning Responsibility in Connection with Improvement Work, EstaBlishing Covenants Running with the Land, dated June 28, 1965, which agreements shall remain in full force and effect. I hereby certify that the foregoing resolution was regularly intro- duced and adopted by the City Council of the City of South San Francisco at a regular meeting held this 20th day of February, 1967, by the following vote: AYES, COUNCILMEN NOES, ABSENT, Frank J. Bertucelli, Patrick E. Ahern, ~milio~. Cortesi, Andrew Rocca and Guido J. Rozzi None None ATTEST: City
