HomeMy WebLinkAbout1978 Parking Place MinutesREGULAR MEETING PARKING PLACE COMMISSION CITY OF SOUTH SAN FRANCISCO TUESDAY, DECEMBER 12, 1978 .TIME: PLACE: CALL TO ORDER: OLD BUSINESS: #1 Acquisition of Property on 300 Block of Miller Ave. 3:00 p.m. Small conference room, City Hall. The meeting was called to order at 3:00 p.m. by Chairman Penna. Present: Chairman Penna, Commissioner Rosaia, Finance Director Anderson. Absent: Commissioner Ruggeri. Finance Director Anderson explained to the Commission that he had not received an answer from the City Attorney regarding the Commission's role in buying and selling property as a result of his involvement in two litigation suits against the City. Planning has requested that Public Works estimate the costs of demolition and clearing of the lot plus putting gravel to level the lot. We hope to have an answer in time for the January Commission meeting. The City Engineer is putting together the Capital Improvement Budget, and the acquisition of this lot being one of the items in the budget he must know what the funding source will be. The Capital Improvement Fund does not have adequate funds to provide.for this expenditure without borrowing from other City funds. In the long run the Parking Place Commission would have to fund this acquisition. A suggestion was made by the Finance Director to give the City Engineer a figure of $80,000 to cover the purchase of the property, clear the lot and put some gravel on it - but not to exceed this figure. #1 Acquisition of Property on 300 Block of Miller Ave.-Cont. #2 Status of Uniform Policy and Cost for Previti ADJOURNMENT:' A discussion followed on possible revenue alternatives after the building is demol- ished and the lot cleared. It was pointed out that on December 14th the City will put a check in escrow for the closing - then the lot will belong to the City. The Commission agreed this item should be held over until the January meeting when there should be more information available from the City Attorney and Public Works to make a determination on funding. Finance Director Anderson suggested buying Mr. Previti some wash-and-wear uniforms that he could maintain himself. The rental business is exorbitant when you have a weekly single pickup and delivery. A discussion followed on the Commission purchasing 2 jackets (one lightweight, one heavyweight), 4 short sleeved shirts, 2 pairs of pants, 6 shoulder patches for identification for Mr. Previti to maintain at an approximate cost of $260-$275. Commissioner Rosaia made a motion to buy the uniforms for Mr. Previti. Chairman Penna seconded the motion and it.was regularly carried. A discussion followed on the various reactions from the merchants concerning the 2-hour free parking for the Christmas holidays. The meeting was adjourned at 3:25 p.m. by Chairman Penna. ' The meeting was called to order at ll:13 a.m. by Chairman Penna.' Present: Chairman Penna, Commissioner Ruggeri, Commissioner Rosaia, City Planner Costanzo City Treasurer Bona!anza, Finance Director Anderson The minutes of the October 10th meeting was approved as written. The minutes of the cancelled meetings of November 14th and November 21, 1978 were noted and signed. The Finance Director stated that following the Commission's last meeting the City Council had an Executive Session on whether an offer would be made on the property. In that Executive Session, Council did authorize the City Attorney to make an offer on the basis of the appraised price, and within a week it was accepted for $73,500. A discussion followed amongst the Commission, Finance Director, City Planner regarding the accepted price of $73,500, and the source of funding; Staff's recommendation for the Parking Place Commission to provide the funds; whether the Commission woUld approve funds to acquire the lot plus funds for closing escrow - approximately $76,000. In response to Commissioner Ruggeri's inquiry the Finance Officer stated the Commission had $124,000 in funds which would be supplemented within the year by another $40-50,000. City Planner Costanzo explained what affect the Redevelopment Agency would have on the Parking Place Commission. A discussion followed to the effect that the Redevelopment Agency would have the power to acquire land, and out of the District's boundries. #1 Acquisition of Property on 300 block of Miller Avenue-Cont. There followed a discussion of the boundaries of the district - end at Walnut, and the Redevelopment boundaries will go to Baden and to Spruce. So, lots that have been outside the district will then be able to be acquired on Baden and Spruce by the Redevelopment Agency. City Treasurer Bonalanza expressed concern that if the boundaries are changed it will affect the bond holders - he was assured by the Commission they would not change the boundaries. A discussion followed on the Brentwood~ parking lot, the alternatives available, i.e. sell it; meter the lot and put it under the District's jurisdiction, turn it over to the merchants and let them maintain it. City Treasurer Bonalanza informed the Commission that he remembered a clause that read, if the Commission went out of the District any revenue must be given to the original district until the bonds are paid off. In response to Commissioner Rosaia's query the City Planner related that he expected a preliminary report in January on the Down- town Master Plan, called "Problems and Opportunities Document". This in turn will call for a meeting to ask for site problems that the Commission might perceive, then there will be a preliminary schematic and based on that a final design which will incorporate all of the problems and opportunities that were discussed. A discussion followed on the City's budget and the capital improvement fund in the current year with the Commission and the Finance Director in reference to money for the acquisition of the Schumann lot. Commissioner Ruggeri posed the question, "Can the Commission dispose of property in the District?" Finance Director Anderson said he would get an opinion from the City Attorney for the next meeting. - 2 - '11/28/78 #1 Acquisition of Property on 300 block of Miller Avenue-~Cont. #2 Grand Avenue Bus Stops A discussion followed concerning selling new bonds today on the basis of revenues. The new bonds and the old bonds would have equal parity. In response to Chairman Penna's query as to what would be done with the Schumann lot, City Planner Costanzo stated that the building cannot be rented. A discussion followed as to the alternatives, inasmuch as it could not be occupied, such as clearing the lot and renting it out, clearing and asphalting the lot and putting i n meters. A suggestion was made to make it a free lot for the merchants and their employees or a reduced monthly fee could be charged. City Planner Costanzo said he would get back to the Commission with a report from Hugo Stoppoloni on the costs of demolishing the building and putting a gravel surface in preparation for all day parking lot. Finance Director Anderson explained to the Commission they could put $76-80,000 (which would cover the acquisition and clearing of the lot) in the Capital Improvement Budget with the funding source being the Parking Place Commission. After further discussion and their being'~no obj'ection from the Commission, Chairman Penna asked that this matter be held over to the next meeting until the Finance Director can get a legal opinion as to the following: "As a Commission, in our Charter, can we declare p~operty surplus and go ahead and dispose and can it be done for original property and/or property that was purchased since the Commission was founded." The Commission agreed they had a tentative approval of purchasing the lot. Finance Director Anderson showed the response from the City Engineer indicating - 3 - 11/28/78 #2 Grand Avenue Bus Stops-Cont. #3 Qualifications of Commissioners #4 Handicapped Parking - 218 Cypress Avenue NEW BUSINESS: #1 Financial Reports #2 Status of Uniform Policy and Cost for Previti that the lengthened bus stops would reduce the hazards to motorists and pedestrians and alleviate congestion. A discussion followed of the financial loss of the 4 spaces in the four bus locations: Linden Ave., SW corner; Linden Ave., NW corner; Maple Ave. SE corner, Spruce Ave. SE corner. Commissioner Ruggeri made the motion to remove the four meters in order to enlarge the bus stops. Commissioner Rosaia seconded the motion. Roll call vote was as follows: Ayes, unanimous. Noes, none. Absent, none. A memo from the City Attorney was shown to the Commission by the Finance Director. This stated the requirements were as follows: residency, qualified elector of the City and a person whose business experience and ability reasonably assure that the affairs of the District will be administered in the interests of the District. The Finance Director presented a request received from Mr. Julian Aramburn, of J&J Orthopedics - 218 Cypress Avenue, for one metered parking space in front of his store be designated handicapped parking only with the curb painted blue and a sign to this effect for his customers. Chairman Penna said a letter should be drafted to Mr. Aramburn indicating that the Commission chose to delay the handling of this request until after the Downtown Master Plan had been completed for they are going to give consideration to requests of this nature. - Finance Director Anderson presented two Budget Reports, one through September 14, 1978 and one through October 12, 1978. Commissioner Rosaia expressed concern, in view of the meter collection scandals in San Francisco that our meter collection man is not readily identifiable as belonging to the City. This is causing various businessmen to be suspicious when seeing a man in civilian clothes taking -4- #2 Status of Uniform Policy and Cost for Previti ADJOURNED: money from the meters. Finance Director Anderson stated he would inves- tigate the City's policy and the related costs for purchase and maintenance and get back to the Commission. The meeting was called to order at 3:07 by Chairman Penna. Present: Chairman Penna, Commissioner Rosaia, Director of Finance Mr. Anderson Absent: Commissioner Ruggeri The minutes of the September 12th meeting was approved as written. Mr. Anderson explained that this was on the agenda because a neighboring City uses a card inside the meter, over the time dial, as opposed to using bags that are ripped off by kids and droop in rainy weather. The cost of using the cards is a third or a fourth of the cost of the bags, which have spoilage problems in printing. The cost of the bags is $500 as opposed to $100 for the cards. Permission was requested of the Commission to adopt the cards for meter use. A discussion followed on the particular wording to be put on the cards which will be seen from both sides of the meter. Commissioner Rosaia asked if someone would be marking the tires so the two hour free parking would not be abused. Mr. Anderson replied that A1 would be going around checking on the cars. Commissioner Rosaia commented that a good advantage in using the cards was that they could be used year after year. The meeting was reopened at 3:40 p.m. Chairman Penna ~sked what the requirement was for a Commissioner to' be appointed. Must he be a property owner or a merchant? Mr. Anderson replied that he would consult the City Attorney for this information. Mr. Anderson explained that he had written a memo to the City Engineer On this subject, however, he had not had a response to date. A discussion followed on this matter to acquaint Chairman Penna with the request from SAMTRANS for wider bus stops on Linden in front of Piewald Drugs, at the northwest, then Spruce at the southeast corner just before the liquorstore. Mr. Anderson explained that the bus company wanted 80-85' for their bus stops rather than the 39-44 feet they now have because of the problem of blocking traffic. With more room they could have angle parking. That is why the memo was written to the City Engineer to get a recommendation. This was placed on the agenda to indicate an answer was due. Mr. Anderson informed the Commission that the contract has been entered into with D'Amico for $5,000 for the Master Plan Study. We have engaged D'Amico to go ahead with that. This was the item that was in the budget and the Commission approved it and it is in progress. In response to Chairman Penna's query on Staff's position on this subject, Mr. Anderson - 2 - 10/10/78 #2 Acquisition of Property on 300 Block of Miller Avenue - Continued explained the following. The property is either going to be developed into something intensive and we would be locked out or we should buy it now. In the Ma~ter Plan it is probably one of the locations you would like to have because it is adjacent to two of your lots. If you allow them to develop, you cannot buy it and and it is a desirable lot. Mr. Anderson further pointed up the~,fact that the acquisition could tie i'ntO the concept of the rear entrances from the businesses, as people do not want to park and walk a quarter mile. This would be one of those locations that would be convenient for shopping. Commissioner Ruggeri expressed concern over the parking lot behind Bay View which is primarily empty, why couldn't this happen as well with the new acquisition. When you still don't have a lot on the 400 block of Grand Avenue, if you spend money for the acquisition you don't have money if property opens up on the 400 block of Grand Avenue. · Mr. Anderson had heard the suggestion of taking one line of meters out in the one lot and turning it into permit parking to get more usage. Commissioner Rosaia commented on the revenue report showing the lots had gone down in revenue. Mr. Anderson stated that people complained they do not shop in an area because there is no parking. Chairman Penna stated that people come into an area to buy merchandise - not to shop for parking. Mr. Anderson stated that in the consumer attitude survey it was indicated that the parking was inadequate. Chairman Penna stated there were 7-50 foot parking lots between Miller and Baden, the bulk of the parking is already there. - 3 - 10/10/78 #2 Acquisition of Property on 300 Block of Miller Avenue - Continued Mr. Anderson replied that when D'Amico runs that Master Plan downtown the Commission should be establishing priorities If you can get this one for the appraisal, then thisyear after you have your priorities you can afford something on Grand Avenue. You are starting this year with $125,000, as of June~30, and you will be picking up money this year - probably another $60,000. The appraisal is $73,500 for the Schumann property, then with escrow fees and other costs, the total would be $75,000. City Planner Costanzo is asking for a total of $76,000, that would leave $49,000 and then you would pick up another $60,000 this year and at the end of the year $100,000. A discussion followed on the outlay of cash and the balance being increased in the current year. You could also sell more bonds and and whatever that would be part of the bonding cost. City Planner Costanzo arrived at 3:40 p.m. Chairman Penna said he understood there was a request in Planning to build on the Schumann lot. City Planner Costanzo said no, a few people came forward, but we indicated that we didn't know'whether we were going to issue a permit because there has not been a final resolution on this problem of the Commission purchasing this property. As a result people do not want to buy it and hold it in light of the fact that they might go through condemnation. The appraiser says the property is worth $73,500 and I estimate we will need some money for legal work and processing, so I have preliminarily requested $76,000. I think we will have to go through condemnation proceedings because Schumann is asking $96,000, and I think he will disagree with the appraisal. Then he will get his own appraisal and he has his attorney involved already. I would like to see the City take on a condemnation proceeding that they can win because of not dealing with an occupied structure for additional parking. In the 400 block I think they will have to go through at least two buildings with condemnation. - 4 - 10/10/78 #2 Acquisition of Property on 300 Block of Miller Avenue - Continued A discussion followed on the Baroni family, whether they might be interested in selling or any other families on the 400 block of Grand Ave. City Planner Costanzo said anyone interested in selling should be put in contact with his department. City Planner Costanzo said we are going to be buying two lots in the 300 block, the Schuman lot and the John Penna, Sr. lot on Miller. He has talked to the people on the Master Plan and they concur that in buying the two lots we can double the size of the parking lot, because of the way the park is designed. City Planner Costanzo went to the blackboard and outlined the Miller Ave. parking lots and the property subject to acquisition. A discussion of the lots followed, concerning ramps, 90 degree angles, diagonal parking, etc. The different types of structures for diagonal and 90 degree plus herringbone parking and what the different designs entail. A discussion followed on the lot next to the post office, the Lautze Ford lot and the Lautze lot on the corner of Miller and the lot on Baden as being available for purchase. Chairman Penna suggested picking up the Kornberg lot with the money in the fund as that would be cheaper than a commercially zoned lot on Baden then trade or exchange with maybe a contractor. Then when Schumann cashes out we can swap lot for lot and the value is just about the same. City Planner Costanzo said when you redo Maple Avenue, when the Police Dept. leaves, you are not going to need the lot on the corner of Maple. Costanzo does not say sell it, but we would consider those two lots for his two lots, we get him for like value. We would see a little advantage as it is a better exposure 'downtown. Chairman Penna commented we only need one lot, keep the corner lot and exchange the seven unit lot on Baden for the same size .lot on Baden and you have that one taken and there is money available for the Schumann lot. - 5 - 10/10/78 Acquisition of Property on 300 Block of Miller Avenue - Continued Costanzo said they were not considering any lots less than 100 ft., otherwise it's extremely high, but you can see the difference. You might have to use structures with ramps, and by going wider you can take advantage of the topography. The lots drop pretty radically on Baden. Chairman Penna commented that lots on Baden would be easy to acquire because of non- occupancy. City Planner Costanzo said they were investigating the use of the alley right behind Chairman Penna and Commissioner Rosaia's businesses to see if there is a way to obtain an estimate on the backyards of the houses. Chairman Penna commented that those were now being maintained by the owners. City Planner Costanzo showed where Chairman Penna's alley lay and the property on both sides plus the back of the stores. What we are looking at is all one. parcel, but it is a complicated system to maintain. Chairman Penna commented that you would be taking 40 feet away from people on Baden - now you are downgrading them. City Planne~ Costanzo explained that they were 6-unit lots now. We make it a 5-unit lot. Commissioner Ruggeri inquired, you have 40 feet on each side - how wide is the alley? You have to leave 20 feet for the roadway on each side. City Planner Costanzo replied, no 15 feet. Chairman Penna asked if they were going to knock out homes through the alley? City Planner Costanzo .replied you might, if you do you have to buy the Whole thing. The Other thing is that the game plan is to be commercial from the first day of the general plan. In fact we could zone them commercial. We want stores backing up to parking, so you have a larger basis. It's hard to do with commercial businesses to - 6 - 10/10/78 #2 Acquisition of Property on 300 Block of Miller Avenue - Continued warrant someone coming in building more buildings and bringing in more restaurants when the neighborhood is not feasible. Chairman Penna related that he agreed that there wasn]t parking to be provided, but if we go Bfter Baden Avenue we can. City Planner Costanzo informed the Commission that either we go forward and buy the Schumann property, at this time Mr. Penna is not anxious to sell or trade, but if we don't then Schumann will want a permit to build. Mr. Anderson commented that if you get new construction in there you can't buy it. Chairman Penna commented that the Schumann property is commercial, getting the permits excludes our developing. City Planner Costanzo commented that he could come forward to build subject to a use permit. You must realize you have some leverage providing you buy the Schumann lot and the Penna lot, and then declare the two corner lots surplus. When the Commission met last time a swap was discussed. If you don't get the Schumann property you will have a hard time swapping. Then you take your $75,000 and look on the 400 block. Also if your surplus property was bull- dozed some developer like Brosnan would be more interested in swaping or buying properties because of the cost of demolishing property. City Planner Costanzo commented that the financial picture looks good, so when we get the Master Plan. back from D'Amico we can turn Cypress into a parking lot and would recommend turning Cypress into parking from Baden Avenue past Bertolucci's. This way you would have the benefit of filled parking from 11:OO am to 3:00 pm because of Bertolucci's. The other thing is to convert Walnut to parking, this would have you showing a higher income for bonds. This would allow you to start buying lots and building parking facilities. By increasing your net revenue you are increasing your borrowing capacity. COstanza asked that the Commission adopt the Master Plan and then go after the bonds~to buy the lots. Chairman Penna asked which lots? Cdty Planner Costanza replied the lots in the Master Plan. Lots that have single 7 s .............. 10/10/78 #2 Acquisition of Property on 300 Block of Miller Avenue - Continued dwellings on them. You could get $125,000 to build and pave plus landscape say in the 300 block. Chairman Penna asked what this was leading to. · City Planner Costanzo replied, you make the expenditure' for the Schumann property and authorize us to make a trade for the excess lot on Miller and Maple for one or two lots on the 400 block. A discussion followed concerning grading and building up on the Maple and Miller lots as they are standard lots. Chairman Penna stated the Commission had a couple of alternatives. We can work some trades with people that own property on Baden Avenue and it still provides us with the funds in our account that we don't have to touch. He is not saying he is interested or not interested in the Schumann property. City Planner Costanzo informed the Commission they could not trade until the Police Dept. moves. Chairman Penna continued, in that for five years the Commission has been calling the 400 block o~ Grand Ave. as the critical parking area, yet we are getting no help getting Council to come to our thinking - and now the Schuman property is available. Right now the greatest amount of potential for the people employed.in the 300 block, and there is a lot of older property there and we are letting that slip by. As well as, obtain the other lots by condemnation, and you say Schumann wants $96,000 and we will have to condemn, anyway. Mr. Anderson explained to the Commission that only the City Council could obtain those properties as they are out of the District. City Planner Costanzo said this means that you have to expand the District; and to do so you need a master plan. From his stand- point, he doesn't see priority. - 8 - 10/10/78 //2 Acquisition of Property on 300 Block of Miller Avenue - Continued Chairman Penna related that he did not see the difference between one side of the street or the other. He thinks ~t depends on what happens with the developer, i 'think the ....... potential~ of the 400 block is greater. City Planner Costanzo said 'there was a need for ten lots, five of which are in the back, two of those have to be on the four hundred block. We must move forward, expeditiously, in buying the cheapest ones we can get first. We need a tremendous amount of money even now if you decided to go ahead and buy. A discussion followed on another lot available on Maple and Miller, City Planner Costanzo said it is $85,000 and only a 40 foot lot. City Planner Costanzo said you would have apartment houses on the corner and the side. We don't have a million dollars to spend here. Commissioner Rosaia commented that you would .~ be able to buy the lots that have no structures but without giving us a block priority. You are talking about the Schumann, Penna, Lautze properties and these are the only ones available - a half a million dollars - and still no property in the 400 block. City Planner Costanzo explained that if you buy the Schumann property and remodel the street, you are going to have excess lots on the street and you try to unilaterally trade for the two lots on the 200 block. We are here to advise you, we can understand your problems on the 400 block. Chairman Penna expressed concern over the transfer of properties and a contractor having built apartment houses, however the Parking Place Commission knew nothing about the properties being available. Then next door the estate was settled, again we were never notified. The entire parcel was sold-for $1oo,o00. City Planner Costanzo agreed that was the price but added it cost another $40,000 each plus the cost of moving or all costs incurred because of the occupants. Chairman Penna replied even assuming the tenants took four months to move ..... City Planner Costanzo agreed that you have - 9 - 10/10/78 #2 Acquisition of Property on .300 Block of Miller Avenue ~ Continued to pay the tenants moving costs. The reason it wasn't brought to you is because you didn't have $400,000. Chairman Penna said he personally felt it would be' detrimental to the parking needs of the community. As far as he is concerned he can't say, why not go ahead and sell the property and then go across the street and pick up other property. City Planner Costanzo would advise the Commission not to sell any of the property that is in back of the commercial property. Chairman Penna expressed concern about talking without a master plan and without knowing what the consultants have come up with, and we are being asked to move to purchase a piece of property where there is no agreement on'price. Then we are looking at condemnation months down the line. Once we move on it our funds are tied up if something should come up on Baden or anything else. City Planner Costanzo replied that he would have to put the Commission on notice, because you will have destroyed a part of the master plan. Secondly, he thinks you will spend more money and by buying this lot you have the leverage, unless the Commission ihinks the lot on the corner is useless. Chairman Penna showed concern about doing anything until he sees what the report looks like. This is a nice price for Mr. Schumann, let alone the cost of the improvements. City Planner Costanzo reported that Schumann had hired an attorney and he would prefer we condemn the property tomorrow. Chairman Penna said the Commission had appropriated $5,000 for a study. We are not going to change the use of the land. They will need a use permit - which he does not think will be granted. So he does'not see the need for speed. - 10 - 10/10/78 #2 Acquisition of Property on 300 Block of Miller Avenue - Continued City Planner Costanzo informed the Commission that he came to them and was given an option for the property for $100 and $5,000 for .the study. A discussi'on followed where the Commissioners said they had not given permission for the option theY thought the downtown revitalization was doing it on its own. There had been talk of a 90 day option.' A search of prior minutes was made by Mr. Anderson for any such permission, none was found except for the $5,000 study. City Planner Costanzo stated an option had been executed. Chairman Penna stated that if the Commission moved, it is only going to be six months down the line for condemnation. On the 18th of October you tell Schumann you are not interested in the option. It is going to take him two months to formulate plans and another month to get a use permit. Commissioner Rosaia said we can do that because right now we do not have the master plan. The Commission is therefor not committed. City Planner Costanzo stated that eventually you have to'buy some lots. He has the feeling the only place you want~to buy lots is on the 400 block. Chairman Penna stated that that sou6ded like threats for which there is no substance. City Planner Costanzo explained that in 45 days they could build an apartment house. A discussion followed on the procedures for use permits, public hearings, and protesting of same. The amount of work and thought City Planner Costanzo has done to develop the parking was appreciated. City Planner Costanzo stated that if the Commission is not moving forward expeditiously, then you should request a moratorium from the Council until the Master Plan is developed. - 11.- 10/10/78 #2 Acquisition of Property on 300 Block of Miller Avenue - Continued Motion: To proceed with investi- gation of restriping of Walnut and Cypress for a cost not to exceed $5,000 Chairman Penna stated if you think we are only interested in the 400 block take this to Council - cut off Cypress and put in diagonal parking. City Planner Costanzo asked if the Commission will bear the cost of striping Cypress and Walnut. Chairman Penna said that subsequent to a cost like $5,000 - if you can guaranty a cost under $5,000. City Planner Costanzo said ultimately you are going to have the cost of landscape planters. Authorize the Parking Place Commission to investigate the restriping of Walnut and Cypress in accordance with the Master Plan, and proceed if the cost is not prohibitive. Commissioner Rosaia made the above motion. Commissioner Ruggeri seconded the motion. Chairman Penna in discussion asked if they would restripe 50 feet. City Planner Costanzo stated that'Cypress could be prohibitive, it must be studied, but with Walnut we can go ahead. A discussion followed on the feasibility of doing one side of Cypress, doing diagonal parking. City Planner Costanzo said they would end up with a net total of two spaces but if you do both sides you would gain 16 spaces. Commissioner Rosaia stated there was no harm in letting them come back wi th a cost that is not too prohibitive plus we would like to see a preliminary design. Chairman Penna called for a roll call on the motion, and it was unanimous and passed. He then asked City Planner Costanzo to'give the Commission a preliminary plan and design. Chairman Penna said he would like to make a motion along the same lines - study the feasibility of the lot on Baden (Mirri's) and if you have some theory you come back and discuss it with us. - 12 - 10/10/78 //2 Acquisition of Property on 3QO Block of Miller Avenue -. Continued City Planner Costanzo replied he would come back and give estimates of the cost of buying and demolishing, putting a second layer, it might be more advantageous to the District to tier it, you could make more. A discussion followed on the lot on the 300 block of Baden (lot no. 251T. Mirri). The elevation being low enough for three tiers. You have another street access to the third level and an exit and entrance. The avoidance of ramps if at all possible commented Mr. Anderson as they are prohibitive.in cost City Planner CostanzO said he would rather investigate the potential of the 400 block and find out who the owners names are. think your first priority is the 400 block. Chairman Penna mentioned Terry Mir~'s lot on Baden. City Planner Costanzo said he didn't think the Commission could afford it. The Commission stated this parking problem must be taken care of before Grand Avenue is torn up. City Planner CostanzO reiterated that the Commission had to make a motion one way or another on this Schuman property. We have asked you to come up with the $76,000 to buy the property. The City may want to buy it unilaterally from the General Fund. Chairman Penna stated that for the last few years you have tried to get Schumann's property, and we have indicated we have some interest, so Staff needs something from us to go back to Council and this he has been discussing with us. City Planner Costanzo said the motion should be that you don't want to buy the property unless you have the downtown plan, but we don't want to be foreclosed. The Council should not allow any building until the Master Plan is completed. Chairman Penna said we also have the parking needs when they develop Grand Ave. We must investigate because of the elevation of the Baden property, we could look at the acquisition of the 25 ft. look with the possibility of no ramps. - 13- 10/10/78 #2 Acquisition of Property on 300 Block of Miller Avenue - Continued City Planner Costanzo said the City Council will not move forward for any lots until the Master Plan is adopted and that would be consistent with the things we are discussing. Chairman Penna said that ties in with the Cypress and Walnut plans. City Planner Costanzo said that is already done. The second motion: we would acquire the Schuman property and sell or swap property on the Miller properties after the Police Dept. leaves. The Schumann property should be bought because realistically it is in the grand scheme. If you move in that direction, if you are going to hold that you ask the Council to restrict all development in the District until the Master Plan is completed. Chairman Penna said that the first motion is to be that no construction take place . City Planner Costanz~o said the first ,r~tion is that you table the purchase of the Schumann property until after the parking master plan and request City Council to freeze development in the proposed downtown assessment district. Chairman Penna defined from Tamarack to Baden. City Planner Costanzo said to propose, down- town Spruce to Airport, Tamarack to Baden. In response to Commissioner Rosaia's query of why Tamarack, Chairman Penna responded: the opposite side of Miller won't be affected, the other side of Miller has level spots all along Miller except any new construction that has already been approved. He noticed some new development on Spruce and Grand kitty-corner from the old hospital and nothing would be affected at DeTomasi's. City Planner Costanzo replied that DeTomasi would have to get Council to lift the ban on them. The Council has to be, by the methodology - anybody affected by the mora- torium would be affected. Schuman can come forward and ask if the moratorium be lifted. It would affect major builders only. Commissioner Ruggeri seconded the motion. Chairman Penna asked for a roll call of those in favor, the vote was unanimous.
