The Ordinance is now ready for adoption. AN ORDINANCE ADOPTING A DEVELOPMENT AGREEMENT W1TH FAIRFIELD RESIDENTIAL LLC FOR THE MIXED USE; TRANSIT ORIENTED DEVELOPMENT NEARTHE SOUTH SAN FRANCISCO BART STATION WHEREAS, the South San Francisco Municipal Code allows development of the approximately 8 acre vacant site located adjacent to the newly constructed Bay Area Rapid Transit Station located on El Camino Real, subject to fm'ther approvals; and, WHEREAS, Fairfield Residential ("Fairfield") has submitted and received approval for a plan to develop up to 360 housing units and up to 23,000 square feet of retail space constructed on the ground floors of proposed residential buildings along McLellan Drive of which approximatelyl2,000 square feet would consist of a retail-only building (grocery); and, WHEREAS, it is anticipated that retail uses along McLellan Dr~ve would serve project residents, BART passengers and SmTounding neighborhoods. WHEREAS, tine 360 unit, 23,000 square feet commercial/office project ("Project") constitutes the present proposed development and is the project subject to the terms of the Development Agreement ("Agreement"); and, WHEREAS, a Mitigated Negative Declaration and Statement of Overriding Considerations has been prepared which analyzes the anticipated environmental impacts of the proposed Project; and, WHEREAS, the Applicant instructed the City to process the proposed entitlements for the Project; and, WHEREAS, pursuant to Municipal Code section 19.60.050, the Director of Economic and Community Development reviewed the application for the Agreement and found the proposed Agreement to be in the proper form, determined that the application was complete, and referred the application and Agreement to the Planning Commission for a public hearing; and, WHEREAS, on December 4, 2003, the Planning Commission held a property noticed public hearing on the proposed Agreement for the Fairfield Project and recommended that the City Council approve the Project, including this Development Agreement; and, WHEREAS, on January 14, 2004, pursuant to Municipal Code section 19.060.110 the City Council conducted a property noticed public hearing on the proposed Agreement for the project. NOW THEREFORE, the City Council of the City of South San Francisco does hereby ordain as follows: SECTION 1. Findings mo The proposed Development Agreement for the Project is consistent with the objectives, policies, general land uses and programs specified in the General Plan, as amended and adopted. This finding is based upon all evidence in the record as a whole, including, but not limited to: the City Council's independent review of these documents. The Project provides for high density residential development with a strong mixed use retail component in the City's recently adopted Transit Village District. The proposed project complies with all zoning regulations, including set backs, provision for open space, payment of park fees and monetary contributions through payment of the City's child care fee. The City Council has independently reviewed the proposed Development Agreement, the certified and adopted Housing Element, the General Plan, Chapters 20.78 and 20.84 of the Zoning Ordinance',, Title 15 of the Municipal Code, and applicable state and federal law and has determined that the proposed Development Agreement for the Project complies with all applicable zoning, subdivision, and building regulations and with the General Plan. This finding is based upon all evidence in the record as a whole, including, but not limited to: the City Council's independent review of these documents, oral and written evidence submitted at the public hearings on the Project, including advice and recommendations from City staff. The Project includes below market rate units and a marketing plan to target those units to both governmental employees and existing residents of the City. This reflects the general plan policies, including the adopted Housing Element, to provide workforce housing. Co The proposed Development Agreement for the Project states its specific duration. This finding is based upon all evidence in the record as a whole, including, but not limited to: the City Council's independent review of the proposed Development Agreement and its determination that Section 3.2 of the Agreement states that the Agreement shall expire ten years fi-om the effective date of the Agreement. Do The proposed Development Agreement states the permitted uses, density and intensity of use for the property subject thereto. This finding is based upon all evidence in the record as a whole, including, but not limited to: the City Council's independent review of the proposed Development: Agreement and its determination that Sections 3.3 and 3.4of the Agreement set forth the development standards and the documents constituting the Project. E. The proposed Development Agreement states the maximum permitted height and size of proposed buildings on the property subject thereto. This finding is based upon all evidence in the record as a whole, including, but not limited to: the City Council's independent review of the proposed Development Agreement and its determination that Section 3.4 of the Agreement sets forth the documents which state the maximum permitted height and size of buildings. Fo The proposed Development Agreement describes tlhe land which will be dedicated for public purposes from the property subject thereto. This finding is based upon all evidence in the record as a whole, including, but not limited to: the City Council's independent review of the proposed Development Agreement and its determination that Exhibit A to the Agreement and the specific project approvals establish the Project boundaries and the land required for future dedication. SECTION 2. The City Council of the City of South San Francisco hereby approves the proposed Development Agreement with Fairfield Residential LLC, attached hereto as Exhibit 1 and incorporated herein by reference. SECTION 3. Severability. In the event any section or portion of this ordinance shall be determined invalid or unconstitutional, such section or portion shall be deemed severable and all other sections or portions hereof shall remain in full force and effect. SECTION 4. Publication and Effective Date. Pursuant to the provisions of Government Code Section 36933, a summary of this Ordinance shall be prepared by the City Attorney. At least five (5) days prior to the Council meeting at which this Ordinance is scheduled to be adopted, the City Clerk shall (1) publish the Summary, and (2) post in the City Clerk' s Office a certified copy of this Ordinance. Within fifteen (15) days after the adoption of this Ordinance, the City Clerk shall (1) publish the summary, and (2) post in the City Clerk's Office a certified copy of the full text of this Ordinance along with the names; of those City Council members voting for and against this Ordinance or otherwise voting. DOC Staff Report AGENDA ITEM DATE: February 11, 2004 TO: Honorable Mayor and City Council FROM: Library Director SUBJECT: RESOLUTION TO ACCEPT $5,000 1N GRANT FUNDING FROM THE GAP FOUNDATION TO SUPPORT THE SOUTH SAN FRANCISCO PUBLIC LIBRARY CHILDREN'S SERVICES RZ'ADER LEADER PROGRAM AND AMEND THE LIBRARY DEPARTMENT'S 2003/2004 OPERATING BUDGET. RECOMMENDATIONS It is recommended that the City Council approve a resolution authorizing the acceptance of grant funds in the amount of $5,000 to support the South San Francisco Public Library Children's Services Reader Leader program and amending the Library Department's operating budget for fiscal year 2003/2004. BACKGROUND The Library has been awarded a $5,000 grant from the Gap Foundation to support the Children's Services' Reader Leader program at the West Orange and Grand Avenue Libraries. In this program, 6m to 12th graders assist elementary school children in practicing reading skills. The funds will support a part-time coordinator as well as program supplies and promotion. FUNDING: The funds will be used to amend this year's operating budget of the Library Department. Funds not expended at the end of fiscal year 2003/2004 will be carded over into fiscal year 2004/2005. RECOMMENDATIONS It is recommended that the City Council approve a resolution authorizing the acceptance of a $72,828 grant from the Peninsula Partnership for Children, Youth and Families and a $2,600 grant from the Peninsula Community Foundation and amending the 2003/2004 Operating Budget for the Library. BACKGROUND This year's grant award of $72,828 from the Peninsula Partnership for Children, Youth and Families will continue to fund collaborative projects with community partners that support the four goals of the South San Francisco Community Partnership. In addition, the $2,600 award from the Peninsula Community Foundation provides additional funding to support a pilot-tutoring program at Sunshine Gardens Elementary School. Four years ago, the City of South San Francisco partnered with the South San Francisco Unified School District (SSFUSD) and other community organizations to create the South San Francisco Community Partnership (SSFCP). The SSFCP became one of the Peninsula Partnership's nine collaborative sites in San Mateo County working to improve the lives of young children and families. The SSFCP's four goals are: · Creating a Viable, Effective, and Sustainable Community Collaborative · Kindergarten Readiness · Literacy and Social Competency for all by Third Grade · Healthy Children and Families Since joining the Peninsula Partnership, the SSFCP is making great strides towards these goals. Some major accomplishments of the last year include: Kindergarten Readiness Orientations During its Early Registration Campaign 2003, the Parmership was able to reach 180 families through Kindergarten Readiness Orientations. During Orientations, community members asked questions and learned about valuable resources such as the Kindergarten Readiness Guide, Staff Report Subject: Acceptance of grants to support the SSFCP Page 2 Transitional Kindergarten and Community Dialogs that are available to them as they prepare their children for Kindergarten. The Partnership is currently contacting families who participated in Kindergarten Readiness Orientations to evaluate the content and usefulness of the orientations. A recent evaluation by the Center for Applied Local Research of South San Francisco Community Partnership's Kindergarten Readiness Program concluded "this program is successfully helping parents to prepare their children as well as themselves for Kindergarten." Transitional Kindergarten As a Peninsula Partnership site, the SSFCP received funding from the San Mateo County First Five Commission to prepare children for school through a series of Summer Kindergarten Readiness classes at our local elementary schools. This past year's program, conducted in partnership with SSFUSD, took place from June through August 2003 and served a total of 386 children. In addition to the seven classes funded by the First Five Commission, the School District funded four additional classes to local schools that are not part of the Partnership. Community Health Initiative Funded by the Partnership for the Public's Health This fiscal year, the SSFCP has received $80,000 from the Partnership for the Public's Health and $50,322 from the San Marco County Health Services agency to work on outcomes related to improving resident health and quality of life. Major projects include enrolling children and families in low and no-cost health insurance programs and connecting residents to job training services. The SSFCP, in collaboration with Peninsula Works, developed and implemented a "train the trainers" program where local residents receive specialized job skills training- such as how to research jobs, write a resume and interview - and then teach these skills to the greater community. Literacy by Third Grade The SSFCP recently received a $10,000 grant from the Peninsula Community Foundation to develop an after school literacy program for approximately 30 third grade students at Sunshine Gardens Elementary school. The additional $2,600 identified in this staffreport will supplement the original grant award. This pilot program will be used as a model for future expansion to additional schools in the Old Town neighborhood. Family to Family The SSFCP has received a $10,000 grant from the San Mateo County Human Services Agency to work on the San Mateo County "Family to Family Initiative" for foster care solutions. The SSFCP will work with local social service and county agencies to increase the number of foster parents and to encourage family reunification, and adoption. FUNDING: Grant funds received in fiscal year 2003-2004 will be used to amend the Library Department's current operating budget. Grant funds remaining at the end of the fiscal year will be carried forward to the next fiscal year. RECOMMENDATIONS It is recommended that the City Council approve a resolution accepting a grant in the amount of $15,000 from Electronic Arts, Inc. to support Project Read and amending Library Department's 2003/2004 operating budget. BACKGROUND Project Read has been awarded a grant of $15,000 to support Learning Wheels, a program of Project Read. Learning Wheels provides families for literacy services in hard-to-reach neighborhoods in North San Mateo County. Programming on the Learning Wheels van includes free story times, access to interactive educational toys, access to a state-of-the-art computer loaded with kid-friendly software, parenting information, community referrals and free books for children. Yearly, Learning Wheels serves over 3,000 residents who live in South San Francisco, Daly City, Pacifica, and San Bruno. FUNDING: Grant funds received in fiscal year 2003/2004 will be used to amend the Library Department's current budget. Funds not expended by the end of fiscal year 2003/2004 will be carried over into fiscal year 2004/2005. BACKGROUND/DISCUSSION: Every three years, the California Building Standards Commission, along with other state agencies, reviews and amends Title 24 of the California Code of Regulations, a.k.a, the California Building Standards Code (the "CBSC"). The CBSC contains several subcodes - the California Building Code, California Electrical Code, etc. - that are applicable and enforceable at the local level. Once adopted by the state, local jurisdictions may amend the CBSC as necessitated by local climatic, geographical or topographical conditions. The City last adopted and amended the California Building, Electrical, Mechanical and Plumbing Codes on December 8, 1999. Those subcodes were part of the 1998 edition of the CBSC. In 2002, the 2001 edition of the California Building Standards Code went into effect throughout the State. Staff has determined that amendments to the 2001 edition are necessary in order to better reflect the climatic, geographical and topological conditions in the City. In order to adopt and amend the 2001 editions of the California Building, Electrical, Mechanical, and Plumbing Codes, the Council will need to adopt the attached resolutions making findings and determining the need to modify the 2001 editions of those subcodes due to local climatic, geographical and topographical conditions. The Council will also need to adopt ordinances putting those changes into effect. Once adopted, copies of both the resolutions and the ordinances will be filed with the state as required by law. Finally, staff has determined that as a result of the adoption and amendment of the 2001 edition of the CaIifomia Building Standards Code, it will also be necessary to update other building standards adopted by the City- the Uniform Administrative Code and the Uniform Housing Code- in order to ensure the consistent, uniform enforcement of all the City's adopted building standards. California Building Code It is proposed that the 2001 California Building Code, Vol. 1 & 2 and the California Building Standards Code be adopted as the code regulating site preparation and construction, alteration, moving, demolition, repair, maintenance, use and occupancy of all buildings and structures within this jurisdiction. Section 1402.6, Weather Protection: This section establishes specific weather protection for metal hardware such as bolts, nails, hinges, locks and other similar hardware exposed to the weather and used on the exterior of residential buildings located west of Interstate Highway 280. Section 1900.4.4, Minimum Slab Thickness: This establishes that residential concrete floor slabs shall be a minimum of 3 72 inches thick and that a waterproof membrane be installed to prevent moisture infiltration into the building. Additionally it establishes that wire mesh reinforcing be installed into the slab. Section 1804.7 & 1804.7.1, Grading and Drainage: These sections establish that the exterior grade immediately adjacent to a building be graded so that water will flow away from the building foundation, and that water, which may accumulate in a crawl space, will be drained to an outlet or sump pump. Section 3404.1, Moved Buildings: This establishes the minimum requirements for maintaining public ways during the moving of buildings within the City and the length of time a building can remain on temporary blocking. Appendix Chapter 33, Excavation and Grading: Establishes that the City Engineer is the enforcement official for this section in addition to creating specific requirements for hours of grading operations, transportation routes, fees, and restrictions during rainy season. Staffproposes to adopt the following new amendments to the California Building Code: Section 310.16.3, Smoke Detectors Revise section 310.16.3, which requires the installation of smoke detectors in single family homes as a condition of sale. The wording in this code section, as written, only requires a detector in the hallways. The proposed amendment would require the installation of detectors in other areas of the dwelling unit as well. This would be consistent with other sections in the code, which require detectors in these areas. Section 904.2, Automatic Fire-Extinguishing Systems Revise section 904.2 to direct certain occupancies to the Fire Code for the proper installation standards. The Fire Department is amending Fire Code standards regulating the installation of fire-extinguishing systems. The standards being changed in the Fire Code also appear in the Building Code on an almost word-for-word basis. This amendment would ensure that uniform standards are used and that no conflict between the Building Code and the Fire Code occurs. APpendix Chapter 15, Reroof'mg Recommend the adoption of Appendix Chapter 15, which provides detailed requirements for the installation of roof coverings over existing coverings. Appendix Section 1521, Spark Arresters Add this section to require that all new roof'mg installations and all reroofing installations shall include the installation of an approved spark arrester on all chimneys. Appendix Chapter 29, Minimum Plumbing Fixtures Recommend the adoption of Appendix Chapter 29, which provides listings for each occupancy type indicating the minimum number of plumbing fixtures necessary for proper sanitation. Appendix Chapter 31, Division III Recommend the adoption of Appendix Chapter 31, Division 1/I only, which deals with detailed requirements for patio covers. This information is not covered in other portions of the code. California Plumbing Code It is proposed that the 2001 California Plumbing Code be adopted as the code regulating installation, erection, alteration, repair, relocation, replacement, addition to, use or maintenance of plumbing systems within this jurisdiction. Section 903.1.2 Venting Materials: Establishes specific limits for the use of ABS and PVC piping for venting of plumbing systems to residential structures not exceeding two (2) stories in height. Section 604.1 Water Piping Material: Establishes that the use of CPVC water piping is limited to cold water supplypiping, outside of a building. Staffproposes to adopt the following new amendments to the California Plumbing Code: Table 4-1, "Minimum Plumbing Facilities": Staff recommends the deletion of this table. The issue of minimum plumbing fixtures is better addressed in Appendix Chapter 29 of the California Building Code, and adoption of that appendix is recommended in that adoptive ordinance. o Section 1211.4 "Installation of Gas Piping": Deletes the new code provision which would allow gas piping to be installed in the ground underneath a building or structure. Because of our likelihood for earthquakes, this presents an undesirable hazard. Staffproposes to adopt the following appendices to the California Plumbing Code: Adoption of new Appendix "D" Appendix D, "Sizing Stormwater Drainage Systems" has been expanded to provide much better direction and quantitative factors to assist in sizing rainwater systems for roof drainage. This information was not as comprehensive in previous editions. Adoption of Appendix "H": Appendix H, "Recommended Procedures for Design, Construction and Installation of Commercial Kitchen Grease Interceptors," also has been expanded to be more detailed, providing the division with some good quantifiable parameters for the sizing of grease interceptors in restaurant and other food establishments. This is an important feature in keeping the City's sanitary sewers from becoming constricted by grease-laden discharge. California Mechanical Code It is proposed that the 2001 California Mechanical Code be adopted as the code regulating design, construction, installation, quality of material, location, operation, alteration, moving, demolition, repair, of all heating, cooling, ventilating, refi-igeration systems, incinerators and other miscellaneous heat producing appliances within this jurisdiction. Administrative Amendments to the 1997 Uniform Housin~ Code: Staff proposes to amend the following section of the 1997, Uniform Housing Code as follows: 1. The most significant change is that requiring a waterproof membrane under the slab floor. Similarly, Section 1402.6, Weather-Resistive Barriers, is amended due to local weather conditions, particularly rain, salt air, wind and dampness. Section 1521 in Appendix chapter 15 is added to require Spark arresters to be installed on all chimneys when reroofing is performed. This is to help prevent spread of embers to adjacent roof areas due to our local windy conditions. .. b) Grading and drainage requirements have been expanded. Section 1804.7.1, Foundation Investigation, is amended due to wet conditions caused by the City's wet and rainy climate. Appendix chapter 33, Excavation and Grading, is amended to impose specific requirements as to hours of grading operations, transportation routes, and rainy season restrictions, due to potential drainage problems associated with the City's rainy climate and hilly topography. Appendix Section 3307, Hazards, and Section 3309, Grading Permit Requirements, are modified to expand on requirements found in the Uniform Building Code in light of local soil types such as clay strata, and local hilly terrain. c) Matters Not Addressed in California Building Code. Since the Uniform Building Code does not address moving buildings, a provision identified as Section 3404.1 has been added, since the City's proximity to the San Andreas Fault and consequent earthquake risk limit the length of time before a permanent foundation must be installed in order to ensure public safety. Section 3319, Restriction of Work During Rainy Season, has been added to address local weather conditions, specifically the City's frequently rainy climate. 3. California Building Code Provisions Deleted. The fee provisions in Appendix Tables A33-A and A33-B are more appropriately covered in the City's master fee schedule and are therefore deleted. CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOL[J 1 IOi FINDING AND DETERMINING THE NEED FOR CHANGES OR MODIFICATIONS TO THE CALIFORNIA PLUMBING CODE, 20()1 EDITION WHEREAS, Section 17958 of the Health & Safety Code requires the adoption by the City of South San Francisco of regulations imposing the requirements of certain uniform industry codes as specified in Health & Safety Code §17922; and WI-iEREAS, Health & Safety Code §17958.5 permits a city to make such changes or modifications to the uniform codes as deemed reasonable because of local climatic, geological, or topographical conditions; and WHEREAS, Government Code §50022.4 provides that when a code is adopted by reference, penalty clauses are not deemed adopted by reference but may be enacted only if set forth in full in the adopting ordinance. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that pursuant to the requirements of Health & Safety Code §17958.7 and Government Code §50022.4, the City Council finds and determines there is a need to adopt the following changes or modifications to the California Plumbing Code 2001 Edition, (Municipal Code Chapter 15.12) by reason of local conditions: 1. Administrative Changes. Section 102.3.1 and 102.3.2, Violations and Penalties, are restated in light of Government Code §50022.4 to be consistent with other Municipal Code provisions with regard to penalties by specifying that violations are infractions rather than misdemeanors; to streamline enforcement procedures and facilitate non-judicial enforcement and to increase compliance levels and encourage voluntary compliance. The Schedule of Fees referenced in Table 1-1 is deleted, and is replaced by the City' s Master Fee Schedule, in order to conform to other fee provisions in the Uniform Codes by providing a single fee source for all codes. 2. Climatic, Geological, and Topographical Changes. a. Provisions on plumbing systems are added to Sections 701 and 903 limiting the use of plastic piping to certain residential structures and prohibiting the use of such piping in industrial and commercial buildings, due to the fire risk caused by the City's proximity to the San Andreas Fault. Similarly, an addition to Section 903 and a modification to Section 604 and the modification to section 1211 are made in order to avoid indoor leakage problems and to reduce the risk of toxic fumes or gas in case of fires, due to the increased fire risk caused by the City's proximity to the San Andreas Fault. Section 15.08.020 Amendments, General. Set forth below are the amendments, additions and deletions to tt'/e 2001 California Building Code, volume 1 8,: 2,2001 Edition. Chapter, section and table numbers used herein are those of the California Building Code and Uniform Building Code Standards. Section 15.08.030 Violations. Section 103 Violations. It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure or cause or permit the same to be done in violation of this code. Each day during any portion of which any violation is committed or continued by any person, firm or corporation shall constitute a separate offense and shall be punishable as herein provided. Section 15.08.040 Penalties. Section 103.3 Penalties. Any person, firm or corporation violating any of the provisions of this code shall be punished as provided for in Section 15.06.040 of this code. Section 15.08.050 Smoke Detectors and Fire-Extinguishing Systems. Section 310.16.3 (a) On or after January 1, 1986, every single-family dwelling and factory-built housing, as defined in section 19971 of the Health and Safety Code, which is sold shall have an operable smoke detector. The detector shall be approved and listed by the state fire marshal and installed in accordance with section 310.9.1.4. A battery-operated smoke detector shall be deemed to satisfy the requirements of this section. Section 904.2.1 Where Required. Except for the occupancies listed in subsections 904.2.2 through 904.2.10.1, an automatic fire-extinguishing system shall be installed in the occupancies and locations as set forth in this section. For those occupancies set forth in subsections 904.2.2 through 904.2.10.1, see Section 1003.2 of the Fire Code for the applicable installation standards. For special provisions on hazardous chemicals and magnesium, and calcium carbide, see the Fire Code. For provisions on special hazards and hazardous materials, see the Fire Code. Section 15.08.060 Weather Protection. Section 1402.6 Exterior Metal Hardware, Galvanizing Required. Metal railings, cabinets, bolts, nails, hinges, locks and any similar parts exposed to weather on residential buildings located west of Interstate Highway 280 shall be galvanized. Galvanizing of products fabricated from rolled, pressed and forged steel shapes, plates, bars and strip 1/8-inch thick or thicker, shall conform to the specifications of ASTM Designation: A123. Except for pregalvanized standard pipe, galvanizing of material 1/8-inch thick or thicker shall be performed after fabrication into the largest practical sections. Material thinner than 1/8-inch shall either be galvanized before fabrication in conformance'with the requirements of ASTM Designation; A525, Coating Designation: G210 or after fabrication, in conformance with the requirements of ASTM Designation: A123, whichever results in the greatest resistance to rust, except th,at the weight of zinc coating shall average not less than 1.2 ounces per square foot of actual surface area with no individual specimen having a weight of less than 1.0 ounce. Galvanized surfaces that are abraded or damaged at any time after the application of the zinc coating shall be repaired by thoroughly wire brushing the damaged areas and removing all loose and cracked coating, after which the cleaned areas shall be painted with 2 applications of Zinc-Rich Primer without thinner. Galvanizing is not required for stainless steel, non-ferrous metals and similar equally corrosion resistant metals. Section 15.08.070 Foundations. Section 1804.7 Drainage Provisions shall be made for the control and drainage of surface water around buildings. The exterior grade around every building shall be sloped away from the building by a minimum grade of one-quarter inch per foot (1/4" per 1') for a distance of at least thirty inches (30"). Grading for drainage shall be arranged so as to drain toward the public sidewalk or street gutter, .and not onto adjoining properties, except where alternate methods are approved by the Chief Building Official. Section 1804.7.1 Underfloor Drainage The underfloor grade beneath the floor system of a building shall be graded to a Iow point so as to provide positive drainage to the exterior in the event of water intrusion. If the exterior grade is higher than the grade beneath the floor system, a positive drainage system or sump shall be installed subject to approval of the Chief Building Official. Section 15.08.080 Concrete Slab Design. Section 1900.4.4 Minimum Slab Thickness. The minimum thickness of concrete floor slabs supported directly on the ground shall be not less than three and one-half inches (3-1/2") and shall be reinforced as stipulated in (b) 4 of this Section. Section 1900.4.4.1 Slab on Grade in Habitable Areas. Concrete slabs supported directly on the ground and used as a finished floor or as a base for other floor finishes in habitable rooms shall meet the following requirements: The minimum thickness of reinforced concrete shall be three and one-half inches (3- 1/2"). A waterproof membrane of polyethylene film of 10 mil minimum thickness or alternate material, approved by the building official shall extend to the exterior walls or beyond the limits of habitable rooms and be turned up to top of slab. A granular material, such as sand, approved by the building official, a minimum of 2" in depth shall be placed between the concrete and waterproof membrane to retard capillary action. Steel reinforcement equivalent to 6" x 6" x 10 ga.. welded wire mesh over granular material placed approximately mid-depth within the 3 1/2" thick concrete. Blocks or chairs shall be provided in order to maintain the reinforcement in the center of the slab. Section 15.08.090 Moved Buildings. Section 3404.1 Moved Buildings and Temporary Buildings Buildings or structures moved into or within the jurisdiction shall comply with the provisions of this code for new buildings or structures. In addition to all other requirements of the building code relative to the moving of buildings and structures, no permit for the moving of a building or structure shall be granted until the applicant has filed with the Chief Building Official: A performance bond in favor of the city, of not less than one thousand dollars ($1,000.00) nor more than one hundred thousand dollars ($100,000.00), as the Chief Building Official may determine, shall be conditioned to require the applicant to strictly comply with all conditions and provisions of this chapter, and of any provision of the municipal code relating to the moving of buildings or structures, and of any order, rule or regulation which may be hereafter passed or adopted by the City Council. The applicant also shall be required to pay any and all damages to any fence, hedge, tree, pavement, sidewalk, street, curb, gas, sewer or water pipe, electric wire or pole supporting the same, or to any public or private property which may result from moving the building or structure; and An undertaking to indemnify, defend and hold harmless the city and its elective officers, agents and employees against all liabilities, claims, actions, judgments, cost or any expense which may for any reason arise out of the issuance of said permit or moving of such buildings or structures. All removals made under any permit granted for such moving shall be done over and along only the street or streets designated in such permit, and at the times therein specified, and shall be done in a careful manner to the satisfaction of the Chief Building Official, Superintendent of Public Works and the City Engineer. No person owning or having charge of the removal of street, shall permit such building or structure to be, or block for a period of more than twenty-four (24) hours. any building or structure being moved over any stand, on anT. street within the limits of any one No person owning or having charge of the removal of any building or structure being moved over any street, shall allow or cause injury to any fence, hedge, tree, pavement, street, sidewalk, curb, gas pipe, water pipe, sewer pipe, electric wire or pole supporting same, or any other public or private property by reason of such removal. Temporary structures such as reviewing stands and other miscellaneous structures, sheds, construction trailers, canopies or fences used for the protection of the public and/or in conjunction with construction work may be erected by special permit from the Fire Marshal/Chief Building Official for a limited period of time. Such buildings or structures need not comply with the type of construction or fire- resistive time periods required by this code. Temporary buildings or structures shall be completely removed upon the expiration of the time limit stated in the permit. Section 15.08.100 Spark Arresters. Appendix Section 152[ Spark Arresters Required Chimneys attached I~o any appliance or fireplace that_bums solid fuel shall be equipped with an approved spark an'ester. The net free area of the spark arrester shall not be less than 4 times the net free area of the outlet of the chimney. The spark an-ester screen shall be heat and corrosion resistant equivalent to 19- gauge galvanized or 24-gauge stainless steel. Openings shall not permit the passage of spheres having a diameter larger than V2 inch and shall not block the passage of spheres having a diameter of less than 3/8 inch. Section 15.08.110 Excavation and Grading. Appendix Section 3305.1 Excavation and Grading- City Engineer. For the purposes of grading and excavation permits and related requirements, all references in the Uniform Building Code to Building Official shall be considered as references to the City Engineer. Section 15.08.120 Permits Required. Appendix Section 3306.2 Exempted Work 10. Grading for the purpose of agricultural irrigation or cultivation. Section 15.08.130 Hazards. Appendix Section 3307 Hazards. The owner of any property on which an excavation or fill has been made, shall maintain in good condition and repair all retaining walls, cribbing, drainage structures, planted slopes, natural water courses and surface drainage. Whenever the city engineer determines that any existing excavation or embankment or fill on private property has become a hazard to life and limb, or endangers property or adversely affects the safety, use or stability of a public way or drainage channel, the owner of the property upon which the excavation or fill is located, or other person or agent in control of said property, upon receipt of notice in writing from the city engineer shall within the period specified therein repair or eliminate such excavation or embankment so as to eliminate the hazard to be in conformance with the requirements of this code. Section 15.08.140 Grading Permit Requirements. Appendix Section 3309 Gradin,~ Permit Requirements. 3309.5 Soils Engineering Report. The soil engineering report shall include data regarding the nature, distribution and strength of existing soils, conclusions and recommendations for grading procedures and design criteria for corrective measures, including buttress fills, when necessary, and opinions and recommendations covering adequacy of sites to be developed by the proposed grading, including the stabilities of slopes. The soil engineering report on engineering grading shall include results of at least one triaxial compression test or a direct shear test, where applicable; sieve analysis of coarse and fine aggregates; indicate the location of water tables, and the location of test bore holes and compaction tests. Where public improvements involve streets, the soils report shall include results of R value tests, taken for the native material over which the improvement is to be made. R-values' at both 300 psi exudation pressure and the expansive pressure shall be included. A thorough analysis for slope stability for all slope areas shall be provided which contains calculated slope stability factors of safety. Where clay strata exist, the soil engineering report shall include the thickness of clay strata, its depth below surface and its effect with regard to settlement of foundations or improvements and shall be supported by consolidation test results. The city engineer may require additional tests, as necessary, and the costs of these tests shall be borne by the developer. The result of these tests will be included in the soil engineering report. Recommendations included in the report and approved by the City Engineer shall be incorporated in the grading plans or specifications. 3309.6 Engineering Geology Report. The engineering geology report shall include an adequate description of the geology of the site, and conclusions and recommendations regarding the effect of geologic conditions on the proposed gading. When springs and ground water are encountered upon excavation, the engineering geology report shall describe, in detail, measures for the permanent drainage of water from the proposed construction site. Where borings show extensively thick soft strata or clay, a map showing the boundaries of such strata and its thickness also shall be a part of engineering geology report. Recommendations included in the report and approved by the City Engineer shall be incorporated in the grading plans or specifications. 3309.10 Transportation Routes. The city engineer shall designate the routes along which fill and grading material will be transported. 3309.12 Further Subdivision Grading. In subdivision work where grading is completed in accordance with the plans and specifications, and further grading is proposed, a new grading permit may be required and all such grading shall be in conformance with this chapter and other related provisions of the Cali.fornia Building Code. 3309.13 Hours. No grading or any work in connection therewith, including, but not limited to, the import and export of earth or other materials and the delivery, servicing or operation of grading equipment, shall be conducted between the hours of 6:00 p.m. and 8:00 a.m. within or adjacent to residential zones, or between the hours of 6:00 p.m. and 7:00 a.m. within all other areas of the City, of any day, nor on Saturday, Sunday or Municipal holidays at any time without prior written approval of the Director of Public Works. 3309.14 Grading in Public Right-of-Way. No person shall do any grading in the public right-of-way or in a public easement without first obtaining an encroachment permit from the City Engineer as set forth in Chapter 13.04. Section 15.08.150 Grading Fees. Appendix Tables A33-A and A33-B from the California Building Code, 2001 Edition, are deleted and are replaced with the following: General. Fees shall be as set forth in the master fee schedule, as amended from time to time by resolution of the City Council. Plan Review Fee. For excavation and fill on the same site, the fee shall be based on the volume of the excavation or fill, whichever is greater. Before accepting a set of plans and specifications for checking, the City Engineer shall collect a plan-checking fee. Separate pmTnits and fees shall apply to retaining walls or major drainage structures as indicated elsewhere in this code. There shall be no separate charge for standard terrace drains and similar facilities. Grading Permit Fees. Grading permit fees shall be paid prior to the issuance of the permit. Separate permits and fees shall apply to retaining walls or major drainage structures as required elsewhere in this code. There shall be no separate charge for standard terrace repairs and similar facilities. Section 15.08.160 Performance Bonds, Nuisance and Hazardoi~s Conditions. Appendix Section 3311 Bonds and Insurance. (a) The applicant shall conduct the grading work in such a manner as not to create a present public nuisance or immediate public hazard and shall file a performance bond with the city engineer in a sum not less than $50,000 to assure remedial work required to abate any present public nuisance or immediate public hazard so created, if such a bond is required by the City Engineer. The City Engineer may reasonably reduce the amount of the performance bond based on the discretionary determination as to the scope of any anticipated remedial work, but in no case to a sum of less than $10,000. (b) In lieu of a bond the applicant may deposit cash or other acceptable instrument of credit as security with the city engineer in an amount equal to that which would be required in the bond. (c) The City Engineer may, before issuing the permit, require that the applicant for a permit file a certificate showing that he is insured against claims for damages for personal injury as well as claims for property damage, including damage to the city for deposit or washing of material into city streets or other public improvements, which may arise from or out of the performance of the work, whether such performance be by himself, his sub~bntractor or any person directly or indirectly employed by him and the amount of such insurance shall be at least $1,000,000.00 public liability and an additional $500,000.00 property damage. Any such insurance shall include protection against liability arising from completed operations provided the cause of action therefore existed at the time of project completion. Any such insurance shall be subject to the approval of the City Attorney as to form, amount and carrier and shall insure the city, its elected and appointed officers, agents and employees against any loss or liability which may arise from any occurrence during the performance of or which may result from any work required to be done. Section 15.08.170 Restriction of Work During Rainy Season. Appendix Section 3319 Restriction of Work During Rainy Season. The period between November 1 and May 1 is hereby determined to be the period in which heavy rainfall normally occurs in the city. During this period no grading work in excess of 200 cubic yards will be authorized on any single grading site under permit where the City Engineer determines that such work will adversely impact the public health, safety or welfare. Previously authorized grading work, which'extends into the rainy season, shall be protected by incorporating temporary erosion control devices. Plans of erosion control devices shall be submitted to the City Engineer no later than September l, and design approval obtained not later than October 1, prior to the rainy season. The design of desilting basins which discharge into city streets or natural water courses shall be under the control of the city engineer. Temporary erosion controls and devices including desilting basins shall be installed no later than November 1. The City Engineer, in the performance of his duties, may add: 1. Regulations as to the use of public streets and places in the course of the work. 2. Requirements for safe and adequate drainage of the site. A requirement that approval of the city engineer be secured before any work, which has been commenced, may be discontinued. A requirement that men and equipment be provided at the site during storms to prevent incomplete work from endangering life or property. Requirements for fencing of excavation or fills which would be hazardous without such fencing. Section 15.08.180 Liability. Appendix Section 3320 Liability The City of South San Francisco relies upon Section 17956 of the Health and Safety Code in enacting Appendix Chapter 33, as amended herein of the California Building Code, 2001 edition, which provides that the city shall not be liable for any injury which arises out of any act or omission of the city or other enforcement agency or a public employee or any other person under Sections 17953, 17954 or 17955 of the Health and Safety Code. Section 15]08.190 California Building Code Appendices Adopted. The following Appendix chapters are hereby adopted: Chapter 3, Division 1/ Chapter 12, Division 1I Chapter 15 Chapter 29 Chapter 31, Division Chapter 33" SECTION 3. SEVERABILITY. In the event any section or portion of this ordinance shall be determined invalid or unconstitutional, such section or portion shall be deemed severable and all other sections or portions hereof shall remain in full force and effect. SECTION 4. PUBLICATION & EFFECTIVE DATE Pursuant to the provisions of Government Code Section 36933, a summary of this Ordinance shall be prepared by the City Attorney. At least five (5) days prior to the Council meeting at which this Ordinance is scheduled to be adopted, the City Clerk shall (1) publish the summary, and (2) post in the City Clerk's office a certified copy of this Ordinance. Within fifteen (15) days after the adoption of this ordinance, the City Clerk shall (1) publish the summary, and (2) post in the City Clerk's office a certified copy of the full text of this Ordinance along with the names of those City Council members voting for and against this Ordinance or otherwise voting. Section 701.1.2 The use of ABS and PVC piping materials for drainage and sewer installations shall be limited to residential structures not exceeding two (2) stories in height, as defined in Section 220 of the California Building Code, 2001 edition. EXCEPTION: Upon approval of the Chief Building Official, ABS and PVC piping may be used for underground drainage and sewer applications., in other than residential structures, when it can be shown that unusual soil conditions would cause corrosion of metal piping materials. Section 604.1 Water pipe and fittings shall be of brass, copper, cast iron, galvanized malleable iron, galvanized wrought iron, galvanized steel, or other approved materials. Asbestos-cement, CPVC, PE, or PVC water pipe manufactured to recognized standards may be used for cold water distribution systems outside a building. All materials used in the water supply system, except valves and similar devices shall be of a like material, except where otherwise approved by the Administrative Authority. Section 903.1.2 The use of ABS and PVC piping for venting shall be limited to residential structures not exceeding two (2) stores in height, as defined in Section 220 of the California Building Code, 2001 edition. RECOMMENDATION It is recommended that the City Council: (1) conduct a public hearing; (2) adopt a resolution stating findings related to the fire code updates; and (3) waive the first reading and introduce an Ordinance repealing the 1997 Edition of the Uniform Fire Code, Municipal Code Chapters 15.24, 15.32 and 15.44 in their entirety and adOpting the 2001 Edition, Volume 1, with state mandated amendments, Appendices IA through VI-I referred to as the 2001 California Fire Code. BACKGROUND/DISCUSSION The City last adopted the Uniform Fire Code and the Fire Standards on November 10, 1999. Every three years, the California Building Standards Commission, along with other state agencies, reviews the Uniform Fire Code and adopts and amends it as part of Title 24 of the California Code of Regulations. This amended code, known as the California Fire Code is to be enforced at the local level. Once adopted by the state, local jurisdictions may then adopt additional amendments to the California Fire Code as necessitated by local climatic, geographical or topographical conditions. The purpose of your actions on January 28, 2004, is to introduce these ordinances repealing the City's previous adoption of the 1998 "Fire Code", as amended, and adopting and amending the 2001 edition of the California Fire Code. It is proposed that the 2001 California Fire Code, Volume 1, with state mandated amendments, Appendices IA through Vid be adopted as the code prescribing regulations consistent with nationally recognized good practices for the safeguarding to a reasonable degree of life and property from the hazards of fire, explosion, and dangerous conditions arising from the storage of hazardous materials and devices, and from conditions hazardous to life or property in the use or occupancy of buildings or premises, and provisions to assist emergency response personnel. STAFF REPORT TO: Honorable May and City Council SUBJECT: Resolution and Ordinance Repealing Chapters 15.24, 15.32 and 15.44 of the South San Francisco Municipal Code, and Adding Chapter 15.24 DATE: February 11, 2004 Page 2 Chamzes Chapters 15.32 Fire Alarm Systems and 15.44 Building Numbering were chapters of the municipal code that are now obsolete. Municipal fire alarm systems are no longer in use and. minimum standards for building numbering are being amended. Section 15.24.110 Fire Extinguishing Systems have been expanded to include the requirement that all new buildings have automatic fire extinguishing systems (fire sprinklers) installed. This section will also require that, with certain exceptions, existing buildings install automatic fire extinguishing systems when the gross square footage of an existing building is increased by: 50% or more for residences (R-3) except for 50% increases resulting in less than 2,000 square feet. 25% or more for all other occupancies A $4.5 million dollar warehouse fire and a fatality in a single family home in 2003 would have been prevented with the installation of fire sprinklers. However, City of South San Francisco remains one of the few remaining cities on the Peninsula that does not require automatic fire extinguishing systems on all new construction or for existing buildings. Proposed amendments to the California Fire Code are listed below and in the attached ordinance. Proposed findings are set forth in the attached resolution, which is to be adopted at the same time as the ordinance. Once adopted, copies of both the ordinance and the resolution will be filed with the state as required by law. 1. 15.24.030, Division of Fire Prevention-Established-Enforcement Duties--Added This section establishes the formation of a local fire prevention division and appointment of a Fire Marshal under the supervision of the Fire Chief. The function of this division shall be to assist the Chief in the administration and enforcement of the provisions of the fire code and the South San Francisco Municipal Code. 2. 15.24.040, Authority To Cite--Amended This section is amended to include the use of administrative citation in addition to other legal remedies, criminal or civil, which may be pursued by the city to address any violations of the fire code. 3. 15.24.050, Violations and Penalties--No Change This section establishes that it is unlawful to violate the code. Permits constitute permission to build, alter, remove fire protection systems, maintain, store, use or handle materials, or to conduct processes which produce conditions hazardous to life or property. 6. 15.24.080 Permits Required--Amended a. This section deals with the additional listing of permits to those already described in Section 105 of the California Fire Code. b. Christmas Tree Lot. To operate a Christmas tree lot for the seasonal sale of Christmas trees. c. Fire Alarm. To operate a manually or automatically actuated fire alarm in any building. Exception: smoke detectors in one and two family dwellings. d. Institutions and Day Care. To operate any and all occupancies that are set forth under Group I occupancies, and Group E, Division 3 occupancy of Title 24 of the California Code of Regulations. e. Large Family Day Care. To operate any occupancy as a large family day care facility as set forth under Group R, Division 3 occupancies of Title 24 of the California Code of Regulations. f. Permit-required Confined Space. To operate a facility that contains permit-required confined spaces as set forth in Section 5156, 5157 or 5158 of Title 8 of the California Code of Regulations. o Tar Kettle. To operate a portable tar kettle used to heat tar during roof surfacing, sealing and/or repair. 7. 15.24.090, Fire Apparatus Access Roads--Added This section requires specific markings of fire access roads to assist in faster response of emergency response personnel whose route of travel includes nan'ow and winding streets with congested traffic. It also defines stroke and height requirement for the number or letter designation. This section will assist in faster response for emergency response personnel due to climatic conditions (i:og) which inhibit visibility or locating a victim within a multi-tenant building. 9. 15.24.110, Fire Extinguishing Systems--Amended Climatic, geographical and topographical conditions all warrant more stringent requirements for requiring automatic fire extinguishing systems in the City of South San Francisco. Fog, wind, hilly terrain, floods, emxhquakes, etc. all attribute to slower response times for firefighters. The time delayed is offset by the installation of fire sprinkler systems to enable escape from fire and minimization of fire damage. In 2003, the City experienced one fatality and a $4.5 million warehouse fire all which would have been preventable with fire sprinklers. An automatic fire spr/nkler system will increase the chances of either extinguishing the fire or controlling it until firefighters can arrive and extinguish it. Automatic fire sprinklers have been proven an effective method of saving lives and property. 10.15.24.120, Requirements for Buildings Two or More Stories in Height, but less than State- Mandated High-Rise Buildings (seventy-five feet)--Added This section deals with the requirement for these types of buildings to be equipped with standpipes. Standpipes provide water for firefighting on each floor of the building. A standpipe will eliminate the need to drag long lengths of hose from street level to fight fires on upper floors. This will decrease the amount of time it will take before firefighters can begin extinguishing efforts. 11.15.24.130 Requirements for Buildings Four or More Stories in Height, but less than State Mandated High-Rise Buildings (seventy-five feet)--Amended This section deals with the special problems associated with fires in multi-storied buildings. Due to the vertical nature of multi-story building fires, they require significantly more resources than other types of rims. Requirements for standby power will ensure critical building systems such as fire pumps and elevators will continue to operate this combined with emergency lighting and smoke control will significantly improve survivability for building occupants in the event of fire. However, audibility is often limited where buildings are significantly set back into properties. Hearing impaired individuals often are not able to identify the activation of an alarm. This section requires the installation of audible and visual devices such as horn/strobes to notify the fire department of sprinkler activation. In addition to the audible component the visual flashing of lights assist firefighters responding at night to approach the target building. The flashing of lights inside a building is beneficial to the hearing impaired. 13.15.24.150, Fire Alarm Systems--Added There are three components to this section. The first allows fire alarm signals to be transmitted to the fire department by monitoring companies or constantly attended locations. The second component requires labeling of the fire alarm control panel to provide information as to who maintains the equipment. Lastly, a "maintenance/inspection contract" requires all fire alarm system owners to have a contract to maintain their system to prevent unwanted or false alarms. i4. I5.24.I60, Gas Meters and Piping--Added This section deals with the difficulty associated with quickly controlling gas and utility services in multi- tenant buildings following an earthquake or fire to prevent the increase or severity of fire and other hazards. 15.15.24.170, Prohibition--Added The more particular ordinance, found within Chapter 10.50 of the Municipal Code, controls (Prohibition of the sale and discharge of fireworks) and this amendment is made to make the California Fire Code consistent with the remaining codes of the City. 16.15.24.180, Emergency Procedures--Added This section deals with the need for employees of residentially based, licensed, adult day care, infant care and other similar facilities to be knowledgeable of emergency plans and procedures to ensure a prompt and efficient response of firefighting personnel and equipment. 17.15.24.190, Number and Distribution of Fire Hydrants--No Change This section remains unchanged from the prior code adopted by the City. These changes describe the maximum spacing between fire hydrants. CLIMATIC: South San Francisco receives an annual average rainfall of approximately 12.1 inches between October and April. During the summer months fi'om June to September, the City experiences a gmat deal of fog and wind. Winds generally prevail from the west at velocities ranging from approximately 5 to 50 mph. Average velocities are approximately 15 to 25 mph. Temperatures range from approximately 32 to 90 degrees Fahrenheit. In summary, due to these climatic conditions, driving is extremely hazardous and visibility very poor. Therefore arriving on scene at an emergency may require a long response time. Winds can have an impact on structure fires of buildings in close proximity to one another, common to South San Francisco. In building fires, winds can literally force fires back into the building and create a blow-torch effect, in addition to preventing "natural" ventilation and cross~ventilation efforts. b. GEOGRAPHICAL: South San Francisco resides on the San Andreas Fault and is subject to seismic activity. An earthquake can occur at any time, causing severe stress on the fire department's ability to provide emergency response, e.g. water mains and natural gas lines may rupture contributing to the rapid spread of fire. Streets may become blocked by debris which will cause traffic congestion and a delayed response of firefighting personnel and equipment. Non-native vegetation in and near open spaces such as French Bloom, Eucalyptus, Monterey Pine, and grasses combined with steep sloped terrain pose a significant threat of wildfire. The City responds to wildland fires on San Bruno Mountain on an annual basis. The City is bordered to the north by Daly City, Colma and Brisbane. The City of Pacifica is to the west and San Bruno to the south. To the east is San Francisco Bay. To the southeast is San Francisco International Airport that subjects the City to frequent over flights of large commercial aircraft. As a result the City is the potential site for a significant off- airport incident involving a large loss of life and widespread property damage due to fire. Consequently, automatic or mutual aid from other cities may be overwhelmed or unavailable, since Colma, Brisbane, Pacifica and San Bruno fire departments are staffed by volunteers or consist of one and two stations respecti vel y. c. TOPOGRAPHICAL: South San Francisco is built on portions of land ranging from Bay fill, lowland flood plain to gently sloping areas and steep hillsides. Many alleys and streets are narrow and winding with congested vehicle parking. New construction is inevitably built on steep hillsides or in areas where access is difficult. Narrow roads make response times longer and make it difficult to place fire apparatus and equipment close to a fire scene. Additionally, some areas have structures built on zero lot lines creating difficulty in controlling fire spread and exposure. Delays in response may also be attributed to traffic patterns where major thoroughfares are often congested with traffic. In order to mitigate the problems that prevent a quick and efficient response to a fire regardless of its cause, use of emergency plans and procedures, fire permits, built-in automatic fire-extinguishing systems, standpipes systems, fire alarm systems, fire apparatus access roads and gas meter markings are required over and above state code requirements. Emergency plans and procedures will assist employees who are responsible for the elderly or infirm to notify' the fire department in the event of an emergency, isolate the fire and evacuate the building occupants. Fire permits will insure proper design, installation of fire protection and life safety systems or the proper use or storage of materials to minimize the incidence or severity of fire. The requirement for installation of fire protection and life safety systems will allow faster notification to occupants to evacuate and allow the fire to be controlled before the firefighters mTive. Fire apparatus access roads and maximum spacing between fire hydrants will ensure that fire apparatus and equipment can place close to a fire scene. Labeling of gas and utility services in multi-tenant buildings will ensure that they can be easily located and shut-off to prevent the likelihood of fire and/or explosion. Additional standpipe outlets will allow firefighters access to a water supply once inside a structure. 2. In addition to the general findings above, the following specific findings are made with respect to the following individual sections contained in Chapter 15.24 of the South San Francisco Municipal Code, adopting and amending the California Fire Code, 2001 Edition: 15.24.010 Fire Code. Findings of Fact: Every three years the Western Fire Chiefs Association publishes a new edition of the Uniform Fire Code. The City of South San Francisco is presently using the 1997 edition. The State of California also uses the Uniform Fire Code as a reference and by adding its own amendments, has adopted it as the California Fire Code. Title 24 of the California Code of Regulations, contains all of the Building Standards of the State of California and is divided into ten parts including Part 2, California Building Code (References Uniform Building Code) and Part 9, California Fire Code (References Uniform Fire Code). The City of South San Francisco is presently using the 1998 edition. To maintain consistent cmTent practices in the field of fire safety and building technology, changes in materials, processes, and construction, we recommend adoption of the 2001 edition of the California Fire Code and appendices as indicated. 15.24.020 Amendments, General. These changes confirm permits, appeals, processes, imposition of costs and fees, and are administrative rather than technical in nature. 15.24.080 Permits Required. Findings of Fact: The above stated climatic, geographical and topographical conditions warrant more stringent requirements for additional listing of renewable permits (annually renewed) to those already described in Section 105 of the California Fire Code which provides permission to maintain, store, use or handle materials, or to conduct processes which produce conditions hazardous to life or property, or to install equipment used in conjunction with such activities. Properly constructed and maintained Christmas tree lots will insure the safety of patrons as well as decrease the incidenc6 and severity of fire. A properly functioning fire alarm system gives early warning to building occupants to leave the affected area promptly. When fire occurs in institutions and large family day care facilities multiple fatalities can occur. Proper exiting and other related fire safety issues can only be addressed through a fire inspection. Permit-required confined spaces contain oxygen deficient and flammable atmospheres or other hazardous conditions. Over 50% of fatalities that occur in these locations involve would be rescuers. The fire department is mandated to be knowledgeable of their location and special problems they present during a rescue. Portable tar kettles used to heat tar during roof surfacing, sealing and/or repair may overheat and cause a fire or boil over if safety controls are not in place and operating. Inspection and the issuance of a permit will help prevent these types of incidents. 15.24.090 Fire Apparatus Access Roads. Findings of Fact: This section is amended to include the use of'signage, curb color and markings to insure emergency vehicle access. Geology: South San Francisco sets over 2 miles of the San Andreas earthquake fault. This fault can create major ground shaking resulting in multiple fires throughout our community. With only five Engine Companies and no mutual-aid immediately available after an earthquake, we must rely on built-in fire protection to quickly extinguish a large number of incipient fires. Topography: The remaining area of South San Francisco to be built on is largely limited to steep slopes and hillsides. Many streets are narrow and winding with congested parking. This makes is more difficult to place fire apparatus and equipment close to a fire scene. Slopes also make it difficult to place ladders for rescue and to advance hose lines. Response time is increased due to steep grades, nan'ow streets, and congested traffic. In addition, many buildings are built upon zero lot lines and h'ave no direct rear yard access. Initial fire attack is possible fi'om the front side of the building only. The time it may take for firefighter to reach the seat of the fire is greatly increased. The opportunity for occupants to safely exit the building is limited as well. The time delay decreases the survival chances of victims in the building and increases the potential for property damage. Fire spread between buildings is more probable. An automatic fire sprinkler system will either extinguish the fire or control it until firefighters can arrive and extinguish it. Automatic fire sprinklers are the proven most effective method of saving lives and property. In order to ensure uniform standards, these changes shall also apply to the fire- extinguishing system requirements set forth in California Building Code Sections 904.2 - 904.2.10.1. 15.24.120 Requirements for Buildings Two or More Stories in Height, but less than State-Mandated High-Rise Buildings (seventy-five feet). 15.24.130 Requirements for Buildings Four or More Stories in Height, but less than State-Mandated High-Rise Buildings (seventy-five feet). Unless otherwise noted, references to "this Code" or "The Code" are to the South San Francisco Fire Code. 15.24.030 Division of Fire Prevention-Established-Enforcement Duties. Sections 103.2.2.1 and 103.2.2.2 are deleted and Section 103.2.2, "Organization of the Fire Prevention Bureau" is amended to read as follows: This Code and the South San Francisco Municipal Code shall be enforced by the Division of Fire Prevention in the Fire Department and shall be operated under the supervision of the Fire Chief. The Fire Marshal in charge of the division of fire prevention shall be appointed by the city manager on the basis of examination to determine his/her qualifications. 15.24.040 Authority to cite. Section 103.4.4, "Citations" is amended to read as follows: The Fire Chief, the Fire Marshal, and/or the Safety Inspector may, in accordance with Chapter 1.25 of the South San Francisco Municipal Code and/or Section 836.5 of the Penal Code, cite a person, firm or corporation whenever he/she has reasonable cause to believe that the person, firm or corporation has committed an infraction or misdemeanor in his/her presence which is a violation of the this Code or any other California or federal regulation which the Fire Chief and/or Fire Marshal have the duty to enforce. 15.24.050 Violations and Penalties. Section 103.4.4.1, "Violations and Penalties" is added to read as follows:. It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure or cause or permit the same to be done in violation of the Fire Code. Each day during any portion of which any violation is committed or continued by any person, firm or corporation shall constitute a separate offense and shall be punishable as herein provided. The imposition of one penalty for any violation sha]l not excuse the violation or permit it to continue; and all such persons, finns, or corporations shall be required to correct or remedy such violations or defects. Any person, firm or corporation violating any of the provisions of this Code shall be punished as provided for in Section 15.06.040 of this Code. 15.24.060 Appeals. A. Section 103.1.4.1 is amended to read as follows: To determine the suitability of alternative materials and types of construction and to provide for reasonable interpretations of the provisions of this Code, there shall be and hereby is created a Board of Appeals consisting of five members who are qualified by experience and training to pass judgment upon pertinent matters. The Chief shall be an ex officio member and shall act as Secretary of the Board. The Board of Appeals shall be appointed by the City Manager and shall hold office pursuant to terms and conditions set by the City Manager. The Board shall adopt reasonable rules and regulations for conducting its investigations and shall render decisions and findings in writing to the Fire Chief, with a duplicate copy to the appellant. B. Section 103.1.4.3, "Appeals Procedure" is added to read as follows: 1. If any person is aggrieved by a decision of the Fire Chief or Fire Marshal, he/she shall have the right to appeal said decision to the Appeals Board. 2. Said appeal shall be in writing and shall be submitted to the Fire Marshal within ten days of the decision of the Fire Chief or Fire Marshal. 3. A copy of the notice of hearing shall be mailed to the appellant not less than ten days before the date of hearing by the appeals board. 4. The time of hearing may be continued at the request of the party aggrieved at any time, which continuance shall not exceed a maximum of sixty days from the date originally set for hearing. 5. Said right of continuance shall be subject to approval by the appeals board and the decision of the appeals board shall be final. 6. Notice of the decision of the appeals board shall be delivered to appellant personally, or sent by certified mail, return receipt requested. 7. The effective date of such decision shall be the date of mailing of such notice of the decision, or the date the same is personally delivered to the appellant. 8. Failure of any person to file an appeal in accordance with the provision of this Code shall constitute a waiver of his/her right to an administrative hearing an adjudication of the notice and order, or to any portion thereof. 15.24.070 Permit and service fees. Section 106, "Permit and Service Fees" is added to read as follows: When an inspection or plan review is conducted by the Fire Prevention Division to ensure proper design, installation or permit compliance a fee in accordance with the city's master fee schedule shall be paid to the division of fire prevention at the time of application for: 1. Renewable permit 2. An installation or removal and alteration permit 3. Activity permit 4. Any other service 5. Any records, photographs or documents 6. Hazardous materials storage permit Fees are payable upon permit application. Failure to pay for permit, plan review or inspection fees imposed by this fee schedule, within the time period specified, shall render such permit null and void. 15.24.080 Permits required. Section 105.8, "Permit Required" is amended to include the following additional activities, operation, practices or functions: 1. Christmas Tree Lot. To operate a Christmas tree lot for the seasonal sale of Christmas trees. 2. Fire Alarm. To operate a manually or automatically actuated fire alarm in any building. Exception: smoke detectors in one and two family dwellings. 3. Institutions and Day Care. To operate any and all occupancies that are set forth under Group i occupancies, and Group E Division 3 Occupancy of Title 24 of the California Code of Regulations. 4. Residential Care Facilities and Residential Care Facilities for the Elderly. To operate any and all occupancies that are set forth under Group R, Division 2 occupancies, of Title 24 of the California Code of Regulations. 5. Large Family Day Care. To operate any occupancy as a Large Family Day care facility as set forth under Group R, Division 3 Occupancies of Title 24 of the California Code of Regulations. 6. Permit-Required Confined Space. To operate a facility that contains permit- required confined spaces as set forth in Section 5157 Permit-Required Confined Spaces, Title 8 of the California Code of Regulations. 7. Tar Kettle. To operate a portable tar kettle used to heat tar during roof surfacing, sealing and/or repair. 15.24.090 Fire Apparatus Access Roads. Section 901.4.2, "Fire Apparatus Access Roads" is amended to read as follows: Marking of fire apparatus access roads shall be by one of the following: 1. A white sign measuring a minimum of 12 inches wide by 18 inches high posted immediately adjacent thereto and spaced at 100 feet intervals and clearly visible. Posting shall be in red letters not less than one inch high and stroke width appropriate to letter height. Sign shall state "Fire Lane" and "Parking Prohibited"; or 2. By a red curb or red outline on ground stating, "Fire Lane-No Parking" followed by "SSFPD" spaced at 50 feet intervals. 15.24.100 Premises Identification. Section 901.4.4, "Premises Identification" is amended to read as follows: All buildings fronting upon any public street, avenue, lane, place, drive or highway in the city shall bear a number in accordance with the street numbering maps of the city, which are maintained in the office of the chief building official. All the streets, avenues; lanes, places, drives and highways shall have the numbers of the right-hand side starting from the point of the beginning, which numbers shall be even numbers, and the numbers on the left-hand side shall be odd numbers. If the number of building entrances exceeds the numbers allocated for the parcel, alphabetical designations may be appended to the number. Approved numbers or addresses shall be provided for all new and existing buildings in such a position as to be plainly visible and legible.from the street or road fronting the property. Said numbers shall contrast with their background and shall be either internally or externally illuminated. 1. Numbers or addresses shall be installed near building main entry as follows: (a) Minimum one-half inch stroke by three inches high; or (b) When the building is 35 feet or more from the access road, a minimum of one half-inch stroke by six inches high; or (c) When the building is 50 feet or more from the access road a minimum of one half-inch stroke by 9 inches high; or (d) May install address monument within 25 feet of the access road. 2. Multi-tenant/occupancies Buildings shall have numbers or letters installed on all entry doors for all tenant/occupancies within the building. (a) Minimum size shall be one-quarter inch stroke by two inches high and on a contrasting background. (b) Directional addresses signs shall be installed in each lobby or stairway for each floor. Said signs shall be posted no higher than 5 feet 6 inches above the finished floor. 15.24.110 Fire Extinguishing Systems. Sections 1003.2 through 1003.2.10 are deleted. Installations" is hereby added to read as follows: Section 1003.2, "Required An approved automatic sprinkler system shall be installed in all occupancies and locations as set forth in this section. For special provisions on special hazards and hazardous materials, see section 1001.9 and Articles 79, 80 and 81. 1. All occupancies and buildings shall be protected throughout by an automatic sprinkler system installed in accordance with UBC Standard 9-1. Exceptions: (a) Automatic fire sprinkler systems may be connected to the domestic water supply when approved by the Fire Chief Group R, Division 1 occupancies may be approved and installed in accordance with UBC Standard 9-3, Group R, Division 3 occupancies may be approved and installed in accordance with N.F.P.A. 13D. (b) Detached carports and greenhouses. (c) Group U occupancies less than 200 square feet. 2. Existing buildings: When the gross square footage of an existing building is increased by: (a) 50% or more for Group R, Division 3 occupancies (single family homes and townhomes). Exception: Group R, Division 3 occupancies where the 50% or more increase in gross square footage does not involve either of the following: i) the addition or expansion of a second or higher story/level; or ii) a final gross square footage exceeding 2,000 square feet. (b) 25% or more for all other occupancies except detached carports, greenhouses and Group U occupancies less than 200 square feet unless the increase results in a gross square footage exceeding 200 square feet. (c) In making this determination, the following calculation shall be used: ARR x 100 OGA Where, ARR represents the total area to be added thereto, as reflected on the plans submitted by the applicant; and OGA represents the existing square footage of the building as it exists at the time of permit application. 3. Other Areas. An automatic fire sprinkler system shall be installed in all garbage compartments, dumb waiter shafts, and storage rooms when located in all occupancies except Group R, Division 3, detached carports, greenhouses and Group U occupancies less than 200 square feet. An accessible indicating shut off valve shall also be installed. 4. Change of Occupancy or Use. An automatic fire extinguishing system shall be installed in a building whenever its occupancy or use is changed. This shall include condominium conversions. Use of the phrase "Change of Occupancy or Use" shall be read in a manner consistent with how that concept is addressed in Section 3405 of the California Building Code. 15.24.120 Requirements for Buildings Two or More Stories in Height, but less than State-Mandated High-Rise Buildings (seventy-five feet). Section 1003.2.1, "Buildings Two or More Stories but Less Than 75 Feet" is added to read as follows: In addition to the requirements of Section 1003.2 and 1004.2, all buildings two or more stories in height shall comply with the following: 1. Shutoff valves and a water-flow device shall be provided for each floor. 2. Class III combination standpipe-sprinkler system conforming to NFPA 13. Exception' Groups R, Division 3, and U occupancies. 15.24.130 Requirements for Buildings Four or More Stories in Height, but less than State-Mandated High-Rise Buildings (seventy-five feet). Section 1003.2.2, "Buildings Four or More Stories But Less Than 75 Feet" is added to read as follows: In addition to the requirements of Section 1003.2.1 and 1004.4.2 respectively, buildings that are four or more stories in height, but not 75 feet or more in height, shall also comply with the following: Products of combustion detectors shall be provided in all mechanical equipment, electrical, transformer, telephone equipment, elevator machine or similar rooms. Detector(s) shall be located in the air conditioning system. Activation of any detector shall initiate the fire alarm system and place into operation all equipment necessary to prevent the recirculation of smoke. 2. A smoke control system meeting the requirements of Chapter 9 and Section 1005.3.3.7 of the Uniform Building Code shall be prov..ided. o A manual fire alarm system shall be provided that will alarm both' audibly/visually throughout the building if activated and also alert the Fire Department via an approved monitoring station. The fire alarm system shall be provided with a public address system and an outside remote annunciator. 4. Standby power shall be provided and must conform to Section 403.8 of the California Building Code. Exception: Groups R, Division 3, S-4 and U occupancies. 15.24.140 Sprinkler Systems and Monitoring and Alarms. Section 1003.3.2, "Alarms" is amended to read as follows: An approved audible and visual sprinkler flow alarm shall be provided on the exterior of the building in an approved location. A single approved sprinkler flow alarm shall be provided on the interior of the building in a normally occupied location. 15.24.150 Fire Alarm Systems. A. Section 1006.3.3.6.1, "General" is amended to read as follows: All fire alarm systems shall be monitored by an approved central, remote or proprietary station service or a local alarm which gives both audible and visual signals at a constantly attended location. B. Section 1006.3.4.4, "Labeling" is added to read as follows: Each fire alarm system shall have posted at the main control panel instructions for silencing and resetting the system, the day and night telephone numbers of the person responsible for the property, and the company or individual providing maintenance services for the alarm system. C. Section 1006.4, "Maintenance/Inspection Contract" is added to read as follows: Each operator of a fire alarm system is required to have a maintenance/inspection contract with a company or individual licensed by the California Department of Consumer Affairs to perform work on a fire alarm system. Individuals performing maintenance or inspection services must be an appropriately licensed contractor. A current copy of the maintenance/inspection contract shall be submitted to the fire department each year before issuance of an annual fire alarm permit. This contract shall provide for inspections and service in accordance with N.F.P.A. 72. 15.24.160 Gas Meters and Piping. Section 1106.1, "Utility Marking" is hereby added to read as follows: All new and existing gas and electric utility services in multi-tenant buildings shall be visibly and legibly marked with the unit identification. 15.24.170 Prohibition. Section 7802.3, "Prohibition" is amended to read as follows: The manufacture of fireworks, safe and sane fireworks, or safe and sane/or regulated fireworks is prohibited. It is unlawful for any person to sell, offer for sale, solicit, solicit for the sale of, possess, purchase, use, or ignite fireworks, safe and sane fireworks, or safe and/or regulated fireworks within the City of South San Francisco except as provided Title 10, Chapter 10.50 of the South San Francisco Municipal Code. Article 78-Fireworks and Pyrotechnical Effects Material The foregoing provision of Article 78 shall be subject to the provisions of Title 10, Chapter 10.50 of the South San Francisco Municipal Code "Sale and Use of Fireworks Prohibited" wherever same are in conflict therewith. 15.24.180 Emergency Procedures. Section 1303.3.7, "Emergency Procedures" is added to read as follows: All Group R, Division 2 and 3 Occupancies (large family day care facilities) shall comply with all plans and procedure requirements set forth in Section 1303 for a Group I occupancy. 10 15.25.190 Number and Distribution of Fire Hydrants. BACKGROUND/DISCUSSION: The purpose of this Public Hearing is to: (1) obtain citizens' views on housing and community development needs for the City's One Year Action Plan; (2) to review activities that are under consideration for funding and past program performance; and (3) to give City Council an opportunity to provide direction to staff regarding funding priorities for fiscal year 2004-2005. Organizations seeking CDBG funds can make a brief presentation to Council regarding their projects and City Council has this opportunity to ask them questions regarding the proposed activities. Federal legislation requires citizen participation in all phases of the development of a locality's CDBG Program. Accordingly, two public hearings have been scheduled, the first to obtain citizens' views of community needs and the second to adopt the City's Action Plan and make final allocations for CDBG fimding. This public hearing was announced in the San Mateo Times on January 28, 2004. CDBG applications were distributed to the City's standard mailing list and to all community organizations that expressed an interest. Additionally, an invitation to submit proposals was published in the San Mateo Times on January 3, 2004, pursuant to federal legislation and the City's adopted Citizen Participation Plan. STAFF REPORT To: Honorable Mayor and City Council Subject: Annual Plan for Community Development Block Grant Program Date: February 11, 2004 Page 2 The City has not yet received notification from the Department of Housing and Urban Development (HUD) regarding its fiscal year 2004-2005 Community Development Block Grant entitlement amount; however, it is anticipated to be the same or slightly less than last year's amount of $747,000. If that is so, a total of$112,050 or 15 % may be allocated for public service activities; and a total of $149,400 or 20 % may be allocated for administration activities. Spending limits in those two categories are established by congressional statute and may not be exceeded. The balance of the entitlement amount, or 65 % of the total CDBG entitlement, is allocated for housing and commercial activities which include improvements to public facilities. By the time of the final public hearing on April 14, 2004, at which City Council makes final funding allocations, HUD will have informed the City of its entitlement amount. SUMMARY OF PROPOSALS RECEIVED: Two new public services have requested funds this year and all public services funded during the current fiscal year have requested continued funding. The new requests are from Ombudsman Program of San Mateo ($5,000) and Mills Peninsula Senior Focus ($5,000). All agencies currently receiving grant funds were asked to submit an application in the same amount as the current year's allocation. Although only two new public services have requested funding, the total amount requested in the public service category totals $185,500 while the total amount available is $112,050. It may be possible that sufficient program income has been generated during the current year to increase the total amount available for public services. The April staff report will have final numbers for program income of which 15% may be allocated in that category. The combined category of housing, commercial and public facilities consists of the city- sponsored Housing Program which administers housing development activities and acquisition and rehabilitation projects; and the city-sponsored Commercial Rehabilitation Program. Also included in this category is C.I.D.'s Housing Access program, Rebuilding Together, and a new request from Community Gatepath. REDEVELOPMENT AND HOME FUNDS: Redevelopment Agency housing funds have historically been allocated for housing projects such as Safe Harbor (emergency shelter), the transitional housing operations of Shelter Network, and the Human Investment Project's house sharing activities. These projects actually provide housing to homeless clients and persons or families at risk of becoming homeless. Those housing units count toward the Agency's legal requirement to provide affordable housing as mandated by the State. In fiscal year 2004-2005 these projects will be handled in the same manner; taking advantage of the CDBG allocation process to solicit and award grants. The County of San Mateo HOME Consortium provides yearly administration funds to the City from the HOME Program, based on a percentage of the County's federal HOME entitlement. In prior years, the City Council has targeted these funds to undertake fair housing activities that are required by federal legislation. This strategy enables the City to free up public service dollars, subject to federal spending limits, for non legal activities. This year the allocated amount is expected to be $18,000 and will enable the City to continue funding La Raza Centro Legal and Project Sentinel. PRELIMINARY FUNDING RECOMMENDATIONS CDBG SUBCOMMITTEE: The City Council's CDBG Subcommittee will meet to review all proposals, discuss program accomplishments and prioritize activities for funding. The Subcommittee is meeting on February l 7, 2004, to review applications and prepare preliminary funding recommendations to be presented to City Council at the April 14, 2004 public hearing. At that meeting, City Council will adopt the Annual Plan and make final funding allocations for the CDBG Program and for available HOME and Redevelopment funds that are to be incorporated with the CDBG budget. Staff has prepared a worksheet titled "Community Development Block Grant Program Summary of Funding Requests". The worksheet is attached to this report as Exhibit "B" and provides a three year summary of all projects, the funding level for each of the two prior fiscal years, the funding requests for fiscal year 2004-2005, and a blank column that City Council may use for comments or recommendations. It would be very helpful to the Subcommittee if Council Members would write in any funding recommendations or comments/questions they may have in the notes column at the far right. The Subcommittee will use these worksheets as the basis of their funding recommendations to City Council at their meeting of February 17th. Please note that Council Members are requested to submit their worksheets to the Subcommittee directly or via the Redevelopment Manager, no later than Friday, February 13th. The Subcommittee must make their final recommendations to Council no later than mid-March. The publication deadline for the newspaper to publish preliminary funding recommendations for community review is due on March 26th, and the staff report to the City Manager (with final funding recommendations) is due on March 29th. The City is required to publish preliminary funding recommendations at least ten days prior to the public heating. This time schedule will allow for publication in the San Mateo Times on March 31, 2004.
