HomeMy WebLinkAboutOrd 153-1930 AN ORDINANCE CALLIN~ A SPECIAL ~L~CTION TO .~E HELD IN ~PO THE CITY 0~ ~0U~B ~AN FRANCIS00, COU~TY 0F SAE MATE0, STATE ".:..Q 0F CALIFORNIA, ON THE 25TH DAY 0~~ FEBRUARY, 1930, FOR THE PURPOSE OF ~UBY~ITTING TO THE QUALIFIED ELECTORS 0F SAID CITY TWO CERTAIN PROPOSITIONS TO INCUR A BONDED INDEBTEDNESS TO PAY THE COST OF CERTAIN MUNICIPAL IMPROVEMENTS AND ACQUISI- TIONS IN LND FOR SAID CITY ZS FOLLOWS: (l~ THE ACQUISITION 0F LAND F0~ TH~iEE PARK ~ITES IN THE CITY 0~'~ SOUTH SAN Fi~N~ISC0, THE IMPROVEMENT OF THE PA!~K SITE NOW 0~I~D BY SAID CITY 0~ SOUTH SAN FHAi~CISC0, AND THE LAND P~t0POSED~ T0 BE ACQUIRED BY SAID CITY ~0R PARK PURPOSES, ~ND THE I~P~0VEMENT OF A PORTION OF 0~GE ~VENUE IN SAID CITY; (21 THE CONSTRUCTION AND COMPLETION OF z PUBLIC ~WIM- MING POOL AND THE ACQUISITION 0~~ A ~ITE ON WHICH TO CONSTRU~,0T SUCH PUBLIC SWIMMI~G POOL; ~,1~ RECITING THE ~EVERAL OBJECTS AND PURPOSES FOR v~HICH SAID ", INDEBTEDNESS IS PROPOSED TO hE INCUttRED; THE ~oTI~T~D C0~T THEREOF, AI~D l_~ ~,,~0UNT 0~' TM~ INDEBTEDNESS PROPOSED TO BE INCURRED THEREFOR; ESTABLISHING EL~CTION PRECINCTS A~D APPOINT- IN~ OFFICERS OF ~ ~CTION. ~L~WEREAS the City of ~outh ~an ~rancisco is a municipal cor- poration incorporated under the laws of the orate of California, and the legislative branch of said ~ity of oouth ~an ~rancisco is designat- ed as the ~lty Council of said City of South San ~rancisco and consists of five members, and the Mayor of said City is the chief executive of said municipality; and ~GtEREAS the legislative branch of said Oity of South San Francisco, County of San Mateo, State of California, to-wits the City Council, of said City of South San Francisco did, on the 2£nd day January, 1930, by an affirmative vote of more than two-thirds of its members, to-wit: the five members of said legislative branch, determine in due and proper form,~by resolution that public interest and necessity demand the acquisition, construction and completion of certain municipal improvements in and for said City of South San ~rancisco, to-wit: the acquisition of land for three park sites in the 0ity of South San Francisco, the improvement of the park site now owned by said City of South San ~rancisco, and the land proposed to be acquired by said City for park purposes, and the improvement of the portion of orange Avenue from the Baden Branch of the Southern Pacii'ic ~Jompany to the Valencia Street line of said Southern Pacific Oompany in said City; that the cost of said municipal improvement will be too great to be paid out of -1- the ordinary annual income and revenue of said City of South San Francisco, and will, in addition to the other expenditures of said City of South San ~raneisco, exceed the income and revenue proviaed for any one year; and ~HEREAS the legislative branch of the ~ity of South San Francisco, County of San Mateo, State of California, to-wit: the City Council of said City of oouth San Francisco, did, on the E£nd day of January, 1930, by an affirmative vote of more than two-thirds of its members, to-wit: the five members of said legislative branch, determine in due and proper form by resolution that public interest and necessity demand the acquisition, construction and completion of a certain municipal improvement in and for said City of South San Francisco, to-wit: the construction and completion of a public swim- ming pool and the acquisition ol' a site on which to construct such public swimming pool; that the cost of said municipal improvement will be too great to be pai~ out of the ordinary annual income and revenue of said Oity of South San ~rancisco, and will, in addition to the other expenditures of said City of South San ~ra~cisco, exceed the income and revenue provided for any one year; and ~H?J~EAS the executive, the I~ayor of said Oity of South San Francisco, County of ~an Mateo, ~tate of California, did, on the ££nd day of January, 1930, duly and regularly approve each of said resolu- tions; and ~HEREAS the total assessed value of all the real and personal property within said City of South San Francisco is the sum of $6,72~.~80.00 and the present indebtedness for improvements already in- curred by said dity of South San z~rancisco, together with the indebted- ness herein proposed to be incurred for said municipal improvements, will not, in the aggregate, exceed fifteen (l~) per cent of the assessed value o~ all the real and personal property of said City oi~ South San Francisco; NOW, TP~REFORE, the City Council of the City of South San Francisco do ordain as follows: Section I. A special election is hereby called and shall be held in the City of oouth San ~'rancisoo, County of San l~ateo, State cf California, on Tuesday, the 2~th day of February, 1930, for the purpose of submitting, and at which there shall be submitted to the qualified electors of the City of ~outh ~an ~'rancisco, the proposition to incur a bonded indebtedness for the several purposes respectively hereinafter stated; And the last mentioned date, to-wit: the 2§th day of February, 1930, is hereby fixed as the date for holding such special election and notice of said election is hereby given and the said proposition to incur said bonded indebtedness by said City of South San mrancisco is hereby submitted to the qualified voters of said Oity of South San Francisco for their determination at said election. Section Il. That the objects and purposes for which said indebtedness is proposed to be incurred are respectively the follow- ing, to-wit: First: The acquisition of lan8 for three park sites in the City of South San Francisco, the improvement of the park site now owned by said Oity of.~outh san ~rancisoo, and the land proposed to be acquired by said City for lmrk purposes, and the improvement of the portion of Orange Avenue from the Baden Branch of the ~outhern Pacific Oompany to the Valencia Street line of said Southern Pacific Company in said City; Second: The construction and completion of a public swim- ming pool and the acquisition of a site on which to construct such public swimming pool. Section III. That the estimated cost of the municipal im- provement first above described, to-wit: the acquisition of land for three park sites in the City of South man Francisco, the improvement of the park site now owned by said City of South San Francisco, and the land proposed to be acquired by said City for park purposes, and the improvement of the portion of Orange ~venue from the Baden Branch of the ~outhern Pacific Company to the Valencia $~reet line of said Southern Pacific Company in said City, is the sum of One Hundred and --S- Thirty-five Thousand Dollars ($135,000.00), and that the cost 'thereof is and will be too great to be paid out of the ordinary annual income and revenue of said City of South San ~rancisco; that the amount of. the principal indebtedness to be incurred therefor is One Hundred and Thirty-five Thousand Dollars ($135,000.00); that the rate of interest to be paid on said indebtedness shall be five ~5) per cent per annum, and that said interest shall be payable semi-annually. Section IV. That the estimated cost of the municipal im- provement second above described, to-wit: The construction and com- pletion of a public swimming pool and the acquisition of a site on which to construct such public swimming pool, is the sum of Fifty Thousand Dollars ($50,000.00), and that the cost thereof is and will be too great to be paid out of the ordinary annual income and revenue of said City of South San ~rancisco; that the amount of the principal indebtedness to be incurred therefor is Fifty Thousand Dollars ($~0,000.00t that the rate of interest to be paid on said indebtedness shall be five (5) per cent per annum, and that said interest shall be payable semi-annual ly. Section V. And it is further ordained and ordered as follows: (a) That bonds of said ~ity of ~outh ~an ~rancisco to the amount of One Hundred and Thirty-five Thousand Dollars ($1J5,000.00) shall be issued and sold to pay for the acquisition of land i'or three park sites in the City of youth Ban ~rancisco, the improvement of the park site now owned by said City of ~outh San ~rancisco, and the land proposed to be acquired by said City for perk purposes, and the improve- ment of the portion of Orange avenue i'rom the Baden Branch of the oouthern Pacific uompan2 to the Valencia ~treet line of said Southern Pacific Com- pany in said City; provided said proposition of incurrin~ said indebted- ness for said purpose first above set out, so submitted at said special election, shall receive ~he requisite number of votes, to-wit, the affirm- ative votes of two-thirds of all the qualified voters voting at said special election. (b) That bonds of said uity of oouth ~an ~'rancisco to the amount of Fifty %~housand Dollars ($50,000.00) shall be issued and sold to pay for the construction and completion o~ a public swimming pool and the ,acquisition of a site on which to construct such public swimming pool; provided said proposition of incurring said indebtedness for said purpose second above set out, so submitted at said special election, shall receive the requisite number of votes, to-wit, the affirmative votes of two-thirds of all the qualified voters voting at said special election. Section VI. The bonds authorized to be issued pursuant to said election shall bear interest from the date of their issuance until paid at a rate of interest which shall be five (5) per cent per annum, payable semi-annually, and the principal and interest of said bonds shall be payable in gold coin of United States of ~merica in the following manner, that is to say: one-~wentieth (ll£O) part of the whole amount of the principal of said indebtedness created under either or both of said two propositions hereinbefore set forth in subdivisions lettered ~a" and "b" of Section V of this ordinance shall be paid each and every year at the ~ity Treasury of said City of south San ~rancisco on a day or date to be fized by the legislative branch of said municipality, together with the interest on all sums unpaid at such date, provided that the interest on Such bonds shall be paid semi-annually so that there shall be a payment of interest on all sums then unpaid in each and every half year, one cf such semi-annual payments being at the date of the payment of the annual installments of the principal of such indebtedness, as aforesaid; and Provided further that said interest shall be evidenced by the proper coupons attache~ to said bonds, a separate coupon being attached to each bond for each semi-annual payment of the interest to bec~me due \ on such bond; and That the total indebtedness authorized to be created at said election shall be represented by bonds payable in the manner aforesaid, and that said bonds shall be issued in such denominations as the legislative branch of said City of South San ~rancisco may determine. except that no bonds shall be of a less denomination than One Nundred Dollars ($100,00) nor of a greater denomination than One Thousand Dollars ($1000.00), and that said bonds shall be known as municipal improvement bonds, Series 1930. VII. It is further ordained that the manner of holding said special election and of voting thereat £or and against said proposition of incurring said indebtedness, shall be as provided in this ordi~anoe and that in all particulars not recited herein such special election shall be held as provided for by law for holding municipal elections in said City of South San ~rancisco, and that in all particulars not recited herein and not provided for by law for holding such municipal elections, the general election laws of the State of California, so far as the same may be applicable, shall apply; That for the purpose of said special election said City of South San ~'rancisco has been, and now is divided into four IA) election precincts respectively to be known as Consolidated Voting PrecilAct "A", Consolidated Voting Precinct "B", Consolidated Voting Precinct "C", and Consolidated Voting Preoinc~ "D". Consolidated Voting Precinct "A" shall include all the ~/~~ territory described in South San ~'rancisco Precinct No. 1 and South J~ San Francisco Precinct No. A, as established by Ordinance 2~o. 383 of the Board of Supervisors of the Oounty cZ San Mateo, State of California, adopted on the 1Eth day o£ December, 19E?, dividing said county into election precincts and establishing the boundaries thereof, and the polling place for said Consolidated Voting Precinct "A" shall be in Brawn's Garage at No. 6E8 Miller Avenue, in said City of South San ~'ranclsco. Consolidated Vo~ing Precinct "B" shall include all the territory described in South San ~rancisco Precinct No. E, South San Francisco Precinct ~o. §, ~outh San z~rancisco Precinc~ I~o. 6 and South San ~rsncisoo Precinct No. ?, as established by said ordinance of the Board of oupervisors of said County of San Marco, and the polling place for said Consolidated Voting Precinct "B" shall be in e eI I the basement of the City Hall of said City. Consolidate8 Voting Precinct "C" shall include all the ~ territory described in South San Francisco Precinct No. 3, South San Francisco Precinct No. 8 and South San Francisco Precinct No. 9, as established by sai~ ordinance of the Board of Supervisors of said County cf San Nateo, and the polling place for said Consolidated Voting Precinct "C" shall be at No. 218 Linden Avenue, in said Ci~yo Consolidated Voting Precinct "D" shall include all the territory described in South San ~rancisco Precinct No. lC, South San Francisco Precinct No. ll and Sou~h San Francisco Precinct No. 12, as established by said ordinance of the Board of Supervisors of said County of San Mateo, and the polling place i'or said aonsolida- /~ted Voting Precinct "D" shall be in Burn~s~Garage, at No. 109 Cali£ornia Avenue, near the southeast corner cf Cypress Avenue and California ~venue in said City. That said election shell be conducted by boards of election consisting of one Il) inspector, one (1) judge and two (~) clerks for each precinc~ whose duties and powers shall be and are the same as those of boards of election and of such election o£ficers, respectively, under the law governing municipal elections of said City of South San Francisco, and in particulars not covered~by such law, then under ~he general election laws of the S~ate ol' Oalifornia. If any of the members of sai~ Boerd of Election hereinafter named fail to attend at the open- ing o£ the polls on the morning of such election, the qualified electors of that precinct present at that hour, including members of the boards, may supply the place of any such absent member by appointment, as pro- vialed by said general election laws. ~t said special election, the polls shall be open at six o'clock of the morning of such election and shall be kept open until seven o'clock in the afternoon of the same day when the said polls shall be closed. In said consolidated voting precincts the polls shall be held in the places aforesaid, and the election conducte~ as aforesaid, by said -7- inspector, Judge an~ clerks respectively, hereinafter named, as follows, to-wit: In Consolidated Votin~ 2recinct "A" the inspector shall be Elsie Dotson, the Judge sh~ll be Kate A. Maynard, and the clerks shall be Annie ~link and Alice M. Young. In Consolidated Votin~ ]~reoinct "B" the inspector shall be James E. Sullivan, the Judge shall be Ann Perry, and the clerks shall be Angelo Canziani and ~nnie Conrad. In 0onSolidated Voting Precinct "0" the inspector shall be Rebecca Eay, the Judge shall be Robert M?~.~i.~t, and the clerks shall be ~eorge Ro~.l and ~ntoinette Eozlowski. In.0onsolidated Voting ~recinct "D" the inspector shall be D. Palany, the Judge shal± be ~rances Sarcia, and the clerks shall be Fay ~arren and Fibrins ~eltrami. And Said pollin~ places shove designated have been found and are hereby determined to be suitable and props r places for holding such special election, and said several persons above designated as members of the respective Boards of Election have been found and are hereby determined to be ~ualified for said respective positions on said Boards of Election as required ~y law and they shall and will be a~d are hereby appointed as such officers to conduct such.and said election and con- stitute said Boards of Election, and said Boards of Election and said officers shall conduct and are hereby directed to conduct said election as by law a~d this ordinance provided and to canv~ss~ the votes given and cast at said special election and to make and deliver returns thereof in accordance with the provisions of this ordinance and of the law the said 0ity 0ouncil of the City of ~outh San Francisco s~all meet and canvess~said returns when received and declare the result of said special election in the manner provided for by law. Section VIII. A sufficient number of ballots shall be and is hereby directed to be prepared and caused to be printed for said precincts as provided for by law and upon the proper kind of paper, to-wit: The same as used at general elections in the 5tare of California, by the Clerk of the City of South ~an ~¥ancisco and be furnished and provided for the use oi' the voters at said special election at the expense of the City of South San ~rancisco and to have the following matter printed thereon in addition to such other matter as may be required by law, to-wit: ~ special election submitting to the qualified voters of the City of South San Francisco, County o±' ~an Marco, State of California, the following propOsitions, to-wit: Proposition 1~o. 1. The proposition to incur a bonded indebtedness of One Hundred and Thirty-five Thousand Dollars ($135,000,00) in ~old Coin of the United States of America for the object and purpose of acquiring land for three part~ sites in the ~ity of South Ban Francisco, the improvement of the park site now owned b2 said City of youth San ~'rancisco, and the land proposed to be acquired by said City for perk purposes, and the improvement of the portion of Orange ~venue from the Baden Branch of the ~outhern Pacific Company to the Valencia Street line of said Southern Pacific Company in said City. l~or said proposition to incur a bonded indebtedness of One Hundred and Thirty-five Thous- and Dollars ($135,000.00) in Gold Coin of the United States of America for the object and purpose of ac- quiring land for three park sites in the City of YE~ South San ~rancisoo, the improvement of the park site now owned by said City of South San ~'rancisco, and the land proposed to be acquired by said City for park pur- poses, and the improvement of the portion of Orange Avenue from the Baden Branch of the Southern Pacific NO Company to the Valencia Street line of said Southern Pacific Company in said City. Proposition No. 2 The proposition to incur a bonded indebtedness of ~ifty Thousand Dollars /$50,000.00) in Gold Coin of the United States of America for the object and purpose of constructing and completing a public swimming pool and acquiring a site on which to construct such public swimming pool. For said proposition to incur a bonded indebtedness of Fifty Thousand Dollars ( $50, 000. 00) in Gold Coin of the United States of America for the object and purpose of constructing and completing a public swimming pool end acquiring a site on which ~ NO to construct such public swimming pool. Any voter who desires to vote in favor of either of said propositions and to accept such proposition may do so by stamping a cross (X) in the voting square on the right hand margin of his ballot, after and opposite the word "Yes", and after such ballot shall be so stamped and deposited in the ballot box it shall be counted as provided.. by law as a vote in favor of such proposition and accepting the same. Any voter who desires to vote against either of said proposi- tions and to reject such proposition may do so by stamping a cross (XI in the voting square on the right hand margin of the ballot and opposite' the word "No"; and after such ballot shall be so stamped and deposited in the ballot box, it shall be canvassed and counted as provided by law as a vote against such proposition and rejecting the same. $eoticn IX. The manner of voting for or against the proposi- tions of incurring said indebtedness shall be as follows, to-wi~: Au2 voter who desires to vote for and in favor of either of said propositions to incur said indebtedness as aforesaid and to accept mush proposition may do so at said special election as stated in said form of ticket by stamping a cross (X) in the voting square in the right hand margin of a ballot, received from one of the aforesaid Boards of Election, after and opposite the word "Yes", and after said ballot shall -10- have 1~een so stamped and deposite~ in the ballot box, it shall be can- vassed and counted as required by law as a vote in favor of such proposition and accepting the same. And any voter who desires to vote against either of said propositions to incur said indebtedness as aforesaid, and to reject such proposition, ma7 do sc at said special election, as stated in said form of ticket, by stamping a cross (X) in the voting square in the right hand margin of his l~allot, received from one of the aforesaid Boards of Election, after and opposite the word "~o", and after said ballot shall be so stamped and deposited in the ballot box. it shall be canvassed and counted as provided for by law as a vote against such proposition, and rejecting the same. Such marking or stamping of said cross(X) on said ballot shall be done only with the s~amp, which, with necessary pads and ink, shall be provided for each booth in said four designated polling places. ~eotion X. Ail persons qualified, at the time of holding said election, to vote at municipal elections in and for the City of South ~an Francisco. or entitled by law governing such special election, shall be qualified to vote at such special election. ~eotion £I. This ordinance shall be published once a week for two (E) weeks in "The EnterPrise and The South San ~:ranoisco Journal", a newspaper of general circulation, printed and published and circulated one da2 a week in said ~ity of ~outh ~an ~'rancisoo. No other notice of such election need be given. Section XII. Ail ordinances or parts of ordinances in con- flict herewith are hereby repealed. ~eotlon XIII. This ordirmnce shall take effect and shall be in force and effect ~rom and after its passage and approval. Introduced this 2?th day of January, 19~0.
