HomeMy WebLinkAboutOrd 164-1933 / 0R~INANCE NO. !//~,~i ~'"~"~:'~ AN 0RDINANOE OF THE CITY OF SOUTH ~ FRA~NCISC0 PROHIBITING THE OPERATION AND CONINOT OF FOOD STORE~, ~f~.AT MARKETS, DRY GOODS STORES, GLOTHING STORES, VEGETABLE STORES, SHOE STORE~, H~DWAHE STOP, F~ 0R ST01tE$ IN I~iICH SHOE REPAIRING IS DONE, WITHIN ~AID CITY ON ANY S~FNDAY OR OTHER LEGAL HOLIDAY. The City Council of the 01fy of South San Francisco do ordain as follows: Section 1. It shall be unlawful for any person, persons, firm, corporation or association to keep open, within the corporate limits of the City of South San Francisco, upon any ~day or other legal holiday, any meat market, clothing store, shoe store, dry goods store, Vegetable ~tore, hardware store, or store where shoe repairing is done. The wox~l "food", as used herein, ahaI1 be construed to mean the kinds of food for human consumption customarily sold in grocery stores. ~ection 2. The provisions of this ordinance shall not apply to or be construed to apply to any person, persons, firm, corporation or association,' who, on any Sunday, keep open bona fide hotels, boarding houses, lodging houses, restaurants, retail drug stores, confectlonary stores or ice cream parlors, newspaper or periodical agencies for the legitimate business of each; provided however, that in case any one or more of the excepte~ types of business hereinbefore mentioned is carried on in acme room with any business coming within the purview of thlsc~rdinanoe and required to be kept closed on ~hxnday or any other legal holiday, the part of the room in which such excepted business is carried on shall be separate and set apart from the business required to be closed by this ordinance, as aforesaid, by a permanent l~artltion or pe _rw~nent screen, not less than seven (?) feet in height, which such permanent partition or per- manent screen shall enclose and separate said place, where said excepted business is carried on, from the remaining part of the room wherein the business required to be closed under Section 1 of this ordinance is operated. Section 3. if any section, sentence, clause or phrase if this ordinance, shall, for any reason, be held to be invalid or unconstitutional, ~meh invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance, it being hereby expresaly declared that this ordinance and each section, sentence, clause and phrase thereof would have been enacted, irrespective of the fact that any one or more other sections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 4. A~y person, persons, firm or corporation who shall violate any portion of this ordinance shall be ~eemed guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine not exceeding One H-~u~red Dollars ($I00.00), or by imprisonment for a period not exceeding Thirty ($0) days, or by Both such fine and imprisonment. ~ection ~.
