HomeMy WebLinkAboutOrd 169-1934 AN ORDINANCE OF THE CITY OP SOUTH SAN FRANCISCO REQUIRING FOOD, FRUIT, MEAT, DRY GOODS, CLOTHING, JEWELRY, HARDWARE, SPORTING GOODS, SHOE STORES, SHOE REPAIRING STORES AND BARBER SHOPS TO RENAIN CLOSED DURING CERTAIN HOURS, AND REP~A~ING ORDINANCE NO. 163 ENTITLED "AN ORDINANCE OF THE CITY 01~ SOUTH SAN FRANCISCO REQUIRING FOOD, FRUIT, ~EAT, DRY GOODS, CY~OTHING, JEWELRY, HARD- WARE, SPORTING GOODS, SHOE STORES AND SHOE REPAIRING STORES and BARBER SHOPS TO REMAIN CLOSED DURING CERTAIN HOU~ ", passed August 14, 1933. The City Council of the City of South San Francisco do ordain as follows: Section 1. Ail stores in the City of South San Francisco in which any food, fruit, and meat are sold at retail, shall be closed at the hour of ?:00 o'clock p.m. of each business day, except as here- inafter provided, and shall remain closed until the hour of 5:00 o'clock a.m. of the next succeeding day. The word "food", as used herein, shall be construed to mean the kinds of food for human consumption cus- tomarily sold in grocerystores. The word "feed", as used herein shall not apply to any place where bona fide meals are served. Section 2. Ail stores in.the City of South San Francisco in which any dry goods, clothing, jewelry, hardware and sporting goods are sold at retail and stores in which shoe repairing is done shall be closed at the hour of ?:00 o'clock p.m. of each business day, except as hereinafter provided, and shall remain closed until 5:00 o'clock a.m. of the next succeeding day. Section Z. Ail barber shops in said City of South San Francisco shall be closed at the hour of ?:00 o'clock p.m. of .~ach business day, except as hereinafter provided, and shall remain closed until 5:00 o'clock a.m. of the next succeeding day. Section 4. On Saturdays and on any other day, except Sundays, which shall precede a legal holiday, all such stores and barber shops may remain open until the hour of 9:00 o'clock p.m. and shall be closed at that time. During the ten (10) business days next preceding 0hristmas day of each year, any store or other place of business here- inbefore mentioned may remain open ~ntil 10:00 o'clock p.m. on any such business day, excepting that on the business day next before Christmas day any such stores or~ other places of business may remain open as l~e as 12:00 o'clock midnight. Section 6. l~othing contained in this ordinan~e shall prevent the sale of merchandise to, or rendering service to all persons who have actually entered such stores or barber shops prior to the time herein fixed for closing. Section 7. Any person, firm or corporation who or which shall violate any provision of this ordinance shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine not exceeding One Hundred Dollars ($100.00), or by imprisonment for a .period not exceeding thirty (30) days, or by both such fine and imprisonment. Section 8. Ordinance No. 16~ entitled "An Ordinance of the 0ity of South San ~rancisco Requiring ~oo~, ~ruit, Meat, Dry Goo~s, 01othing, Jewelry, Hardware, Sporting Goods, Shoe Stores and Shoe Repairing Stores and Barber Shops to Remain 01ose~ During 0ertain Hours," passed Augus~ 14, 1933, is hereby repealed. Section 9. If any section, sentence, clause or phrase of this ordinance is for any reason held to be invalid, or unconstitutional, such decision shall not affect the validity cf the remaining portien cf this ordinance and the 0ity Council of the City of South San Eran- cisco hereby declares that it would have passed this ordinance and each section, sentence, clause and phrase thereof, irrespective of the fact that any one or more other sections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 10. This ordinance shall be publishe~ once in "The ~nterprise and the South San ~rancisco Journal", a newspaper -2- of general circulation, published and circulated in the Oity of South San Francisco, and shall take effect and be in force from and after the expiration of thirty {$0) days after its passage and adoption.
