An auxiliary police force is hereby established, to be a volunteer organization, composed of not to exceed one hundred (100) members, separate and distinct from the police department of this city, but to be headed by the chief of police° Section 2: Chief of police to have control. The chief of police of this city shall have complete authority, control and con, and, subject to the provisions of this ordinance, over the auxiliary police force° He may appoint as members thereof any persons whom he may deem to be qualified, and he may reject any application for membership. He may provide for the training of candidates for membership, and for the further 'training of members. Section 3: Method of appointment. ~'~o person shall be deemed a member of the au::iliary police force until he has been registered as such in a roster to be kept by the chief of police, aud until he has taken his oath that he will observe and obey the co~stitution of the United States, the constitution of this state, and the laws of this nation, this state and this city, and that he will carry out the duties of a member of the a~axiliary police foT~ce of this city to the best of his ability. Section 4: Duties. The duties of the auxiliary police force, subject at all times to the direction, supervision and control of the chief of police, shall be to assist the regtd[ar members of the police. department of this city in the e:~forcement of law and the ~.uaintenance of peace and order during the emerge~:cy of ',var and great co~.m~on peril. The chief may by order establish rules and regulations to govern the auxiliary police force, to fix 'the specific duties of its members, and to provide for the maintenm~ce of disciplin~o He nmy chaiage such -1- orders from time to time, and he may co~.~nuand members of the auxiliary force to obey the instructions of regular police officers in carrying out their duties. The chief may prescribe other duties than those mentioned herein to be performed by the auxiliary police force, not inconsistent with the provisions hereof. Section 5: Identification. An idet~tification card and such other insignia or evidence of idei~tity as the chief may prescribe shall be issued to each member who must carry the cards and o ohe_~aei~ifica- tion at all times ~vhile on duty, and he must surrender them upon the termination of his membership. _Section 6: Removal from ~uembership - resignation. The ~-~lember- ship of any person may be terminated by the chief of police at any time, and any member may resign from the au:~itiary police force at any time, but it shall be his duty to notify the chief of his reo~natmon. Section 7: Carryil~g of firearms. ['[o member of the auxiliary police force shall while on duty carry or use any firearm except upon the express writte~'~ order of the chief of police. Section 8: Breaking - entering, i~,~o member of the auxiliary police force shall break into or other~ise forcibly enter upon any private property or enter a dwelling or habitation of another without the consent of the owner or occupant, except when i~;~_modiately accompanied by a regular member of the police department of this city, who then and there requests his aid in the e~forcement of the law. S ~ cc,ion 9: Power of arrest. A member of the auxiliary police force shall have the following pov~ers of arrest and none other: 1. He may arrest for a public offense coi~nuitted in his presence; 2. He may arrest a person who has in ~ * · ac~ committed a felony, although not in his prese~ce; 3. When a felony has in fact beeu conn~aitted, he may make an arrest when he has reasonable cause for believing the person arrested to have core.mitred.it. Provided, however, that the chief of police may i~,ake it the duty of any member of the auxiliary police force to lend physical aid to any regular member of the police depart~.'?.ent in making a~ly lawful arrest. Section 10: Diminishing the force. The a~hief of police may by order diminish or expand thc membership of the auxiliary police force as emergency may require, within the limit hereinbefore established. Section 11: Summary dismissal and publication. In addition to the penalties provided by the law, any violation of law under color of the performance of his duties as a member of the auxiliary police force, and any breach of the rules and regulations establish- ed by the chief shall subject a~ay member to stu'~mary expulsion and the fact thereo£ may be published at the order of the chief. Section t~: ~a!se perso~ation. It shall be a misdemeanor punishable by imprisonment for a period not to exceed three (~) months, or by a fine not to exceed Three Hundred Dollars (~$00.00), or by both, for any person to wear, carry or display an auxiliary police force identification card or insignia or otherwise deceitfully represent himself to be connected with that force~ unless he is in fact a member thereof. Section 15o This ordi~ance is hereby declared to be an emergency measure n~essary for the immediate preservation of the public peace, health and safety and the following is the statement of facts constitut- ing such urgency: The United States is at war and this city is in great and continuing danger of attack by the enemy. The exigencies of war and the imminence of great public peril have thrown unprecedented burdens upon the regular employees of this city. The danger is st~h as to admit of no delay in providing add~itional support and aid~ voluntarily offered by citizens, i~ the ~".'lai~tenance of public safety. Section 14. The city clerk shall certify to the adoption of this ordinance and cause it to be published once in "The Enterprise", a news- paper of ge~er~! circulation printed and published in this city, and henceforth and thereafter the same shall be in full force and effect. -o-o-o-o-o- Passed and adopted as an ordinance of t~he City of South San Fran- cisco at a regular r~eeting of the city council of said city on the ~ day of ~arch, 19~E, by the following vote: I~oe s, Count i!r~len Absent, Counc il~en ~ ~ayor of the City of South ~an ~'r~ucisco.
