The City Council of the City ~South San Francisco do orda~ as .~ follows: Section 1. For the duration of the war, and six (6) ~nths thereafter, it shall be unlawful for ~y minor under 3he age een (18) years to be in or an any public street, park, square, or a~ public ~ce between the hours of ten o'clock p.m. and dayli~t i~e- diately following, except where the said minor is acao~apanied by a parent, legal guerdon or other .adult person hav~g the care a~ c~- tody of s~d mih~r, or where the presence of s~d minor in said place or places is connected with or required by some legitimate bus,ess, trade, profession or occupation, by reason of, e~ployment., inclusive of time necessary for going to and returning f~m such place of' busi- ness in which said minor is engaged. Section 2. ~y~rent ~ other person assisting, aiding, ab~ t~g, psrmitting, or encouraging any minsr 6nder t~ age of eighteen (18) years to violate the provisions of section i hereof, shall be guilty of a ~isdemeanor. Section 3. Each owner, agent, manager or keeper of a hotel, boarding house, lodging house, tenement house, motor court, or apart- ment house shall i~ediately report to the office of the chief of po- lice of said City the presence therein of ~y and all minors, whom he has reasons to believe to be under the age of ei~teen (18) years, unless such minor or minors is or are accompanied by the p~ent,guar- dian, or other adult person ha~ng the care a~d custody of such minor or minors, and in maki~ such~eport shall state to the office of said chief of police tho name, age, last-~o~m place of abode, and the~es and res~ences of the parents, guarSians, or other custodians ~f such minor or minors, so far as such information can be ascertained from said minor or minors, or othe~vise. Section 4. It shall be unlawful within the City of South San Francisco for any proprietor, keeps, clerk, or auy other per- son, having charge or control of any cafe, tavern, restaurant, bar, eating place, or public dance hall, to permit any person under t~e age of eighteen (18) years to re~ain in said public place between the hours of ten o'clock p.m. and daylight i~mlediately follov~ng, unless such person is accompanied by a parent, guardia~ , or other adult person, having the care and custody of such minor. Section O. ~uy adult person ~ho shall violate any of the provisions of this ordinance shall be guilty of a misdemeanor an~ , upon conviction"~thereof, s~ll be sub~ect ~o1 a fine of not more than Three Hundred Dollars (~00.00), or to i~prison~ent for a period of not more than three ($) months, or to both such fine and such imp~onment. Any ~uinor, who shall violate any of the provi- sions of this ordinance~ shall be guilty of a m~demeanor a~d sub- ject ~ the provisions of Chapter E, Division S, of t~ Welfare and InstSutions Code ~f the State of California. Section O. If any section, subsection, sentence,clause or phrase of this ordinance is for any reason held to be unconstitu- tional,such decision shall not affect the w~lidity of t~ remaining portions ~of this ordinance° The City Council hereby declares that it would hav~ passed this ordinance and each section,subsection,sen- tence,clause and phrase thereof, irrespective of the fact that any one or mc~e sections ,subsections,sentences,clauses or phrases be de- clared unconstitutional. Section 9. This ordinance is hereby declared to be an emer- gency me~sure necessary for the i~ediate preservation of ~he public peace and safety, and the following is a statement of t~ facts con- stituting such emergency: the war, in which the United State~ is now engaged, has produced such conditions in the City of South ~San F~an- cisco that it is necessary to preserve the public peace, safety,morals and we~are by restricting the presence of minors in the streets and other public places for the purpose of curtailing juvenil~ delinquency. Section 8. The City Clerk shall certify to t~ adoption of this ordinance and cause it to be published once in "The Enterprise", a newspaper of general circulation printed and published in said City, and thenceforth the same shall be in full force and effect.
