Report regarding a resolution approving budget amendment number 22.071 to appropriate $2,147,000 in funds for a one-time payment of additional compensation to City of South San Francisco employees and authorizing the City Manager to execute related Letters of Agreement with recognized employee bargaining units.(Leah Lockhart, Human Resources Director) RECOMMENDATION Staff Recommends City Council adopt a resolution to: 1.Approve budget amendment 22.071 appropriating funds for a one-time payments of additional compensation to City of South San Francisco employees,in the amount of $4,800 per full-time employee and regular part-time employee in the City’s competitive service; and 2.Approve and authorize the City Manager to execute Letters of Agreement with the City’s recognized bargaining units outlining the terms and conditions for a one-time payment of additional compensation. BACKGROUND/DISCUSSION During the COVID-19 pandemic,City of South San Francisco employees served as essential workers and maintained critical services to the South San Francisco community.On March 16,2020,the County of San Mateo issued an emergency Shelter-in-Place order due to the emerging pandemic conditions,and the State of California issued a stay-at-home order followed shortly thereafter.City staff promptly developed and implemented a COVID-19 preparedness and response plan in order to ensure that essential public services and operations could safely continue.While some non-essential services were temporarily suspended,the vast majority of City services maintained full or modified operations throughout the duration of the State and County orders.By August,2020,all City facilities and services were reopened,with continued modifications in place to protect the health and safety of employees and the public. During the two years since the beginning of the COVID-19 pandemic,City employees have continued to work for the community and have put forth extraordinary efforts to respond to community needs and safely maintain essential services.Front-line workers continued to provide critical services such as police,fire,and EMS emergency response,infrastructure repair and maintenance,childcare and education assistance,facility cleaning and disinfection,wastewater treatment operations,and other essential City functions.In addition,management and administrative staff served in critical roles to maintain the City’s Emergency Operations Center,establish and manage the City’s COVID-19 safety and response protocols,and develop and provide community relief and assistance programs such as support to local businesses and renters,emergency food distribution events, coordinating community vaccination and testing sites,and more.Staff at all levels also demonstrated creativity, resourcefulness,and technical skill in converting programs,services,and public meetings to an online,hybrid, or other modified format within a short period of time,and the use of these alternative formats have proved successful and will enhance City services for years to come. During the past two fiscal years,the City also implemented hiring and spending freezes and other budget reductions to weather the loss of revenue resulting from the pandemic-related economic impacts.While the availability of State and Federal relief funds has helped to offset these losses and provide relief services to the community,no additional compensation for City employees has been granted.As the City ultimately realized aCity of South San Francisco Printed on 6/6/2022Page 1 of 2 powered by Legistar™5 File #:22-461 Agenda Date:6/8/2022 Version:1 Item #:1. community,no additional compensation for City employees has been granted.As the City ultimately realized a general fund surplus in fiscal year 2021 and expects to end fiscal year 2022 in a surplus position,staff recommends the authorization of a portion of the City’s reserve funds for a one-time payment of additional compensation to City workers. At the direction of City Council,staff met and conferred with the City’s recognized bargaining units regarding the amount,terms and conditions of a one-time payment of additional compensation to City employees.As a result of these discussions,staff reached tentative agreement with American Federation of State,County,and Municipal Employees (AFSCME)Local 829,Teamsters Local 856 (Mid-Management and Confidential Units, International Union of Operating Engineers (IUOE)Local 39.The proposed resolution authorizes the City Manager to execute a Letter of Agreement with each of these units to confirm these terms.The agreements provide for a one-time payment in the amount of $4,800 for each current employee,provided that they are on the City’s payroll as of June 1,2022.Staff anticipates tentative agreement on similar terms with Police Association,International Association of Firefighters Local 1507,and Public Safety Managers,which will be brought before Council for approval at a later date. The proposed resolution provides funding for $4,800 in one-time,non-pensionable,lump-sum compensation for each of the City’s regular full-time employees in the classified service,as well as $4,800 for the City’s five (5)regular part-time employees represented by AFSCME Local 829.Funding is not included for the City’s unrepresented and at-will employees,including Executive Management and part-time hourly employees. Recommendations for unrepresented employees may be brought before City Council at a later date. FISCAL IMPACT The proposed resolution includes an appropriation of $2,147,000 in one-time funds,to be transferred from the City’s infrastructure reserve fund to the General Fund for the purpose of one-time payment of additional compensation.Staff anticipates that surplus general fund revenues from fiscal year 2022 will be available to replenish the infrastructure reserve fund after the close of the fiscal year.The requested appropriation covers all related expenses for a one-time payment of $4,800 for employees in the City’s competitive service, including City contributions to Social Security and Medicare associated with this payment. RELATIONSHIP TO STRATEGIC PLAN This action supports the City Council’s strategic priority of Workforce Development by providing a competitive compensation package to reward and retain a high-performing workforce. CONCLUSION The proposed resolution and Letters of Agreement with each City bargaining unit will provide for a one-time payment of additional compensation to City employees.Staff recommends City Council approval in order to reward and recognize City staff for extraordinary ongoing and future efforts to provide continued and enhanced services to the South San Francisco community. In recognition of the extraordinary and ongoing efforts of Local 39-represented employees, every bargaining unit employee shall receive a one-time only, non- pensionable, lump-sum recognition bonus of four thousand eight hundred dollars ($4,800). 2. This payment shall be provided following ratification by Local 39 and approval of the City Council, which shall be paid in full by the City to all Local 39-represented employees with the first full pay period following City Council approval. 3. To be eligible for payment, the bargaining unit employee must be employed by the City as of the date of Local 39 ratification, as confirmed to the City in writing by Local 39. 4. In the event the City agrees to pay an employee or employee group not represented by Local 39 a one-time recognition bonus, COVID-19 hazard pay, or any other COVID- 19-related premium in an amount greater than that set forth in this Letter of Agreement, the City agrees to pay Local 39-represented employees the same amount by paying the difference no less than two pay periods after the City’s agreement to the greater bonus or premium amount. This provision shall not apply to lump-sum payments granted in lieu of a wage increase, or in direct exchange for other non- COVID-19-related benefits, that have been duly bargained and agreed to through successor MOU negotiations. 5.
