HomeMy WebLinkAboutOrd 1005-1986ORDINANCE NO. 1005-86 AN ORDINANCE ESTABLISHING SEWER CHARGES AND PROCEDURES RELATED THERETO AND AMENDING ORD- INANCE NO. 396, AS AMENDED, AND CHAPTER 14.12 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION 1. SUBSECTION 14.12.045A OF THE MUNICIPAL CODE AND SECTIONS 3.4 AND 3.4.1 OF ORDINANCE NO. 396 AMENDED The first sentence of Subsection 14.12.045A of the South San Francisco Muni- cipal Code, and the Titles to Sections 3.4 and 3.4.1 of Ordinance No. 396, as amended by Ordinance No. 988 are hereby amended so that the reference therein to fiscal year "1985-86" is changed to read "1986-87". SECTION 2. SUBSECTION 14.12.045B OF THE MUNICIPAL CODE AND SECTION 3.4.2 OF ORDINANCE NO. 396 AMENDED Subsection 14.12.045B of the South San Francisco Municipal Code and Section 3.4.2 of Ordinance No. 396, as amended by Ordinance No. 988, are hereby amended so that the reference therein to fiscal year "1985-86" is changed to read "1986- SECTION 3. SECTION 14.12.050 OF THE MUNICIPAL CODE AND SECTION 3.5 OF ORDINANCE NO. 396 AMENDED Section 14.12.050 of the South San Francisco Municipal Code and Section 3.5 of Ordinance No. 396, as amended, are hereby amended to read as follows: "14.12.050 CHARGES - SCHEDULE To Parcels By Use Classification A. Residential Class Single-Family Dwelling Multi-Family Dwelling (duplexes, flats, apartments, and similar class of uses) Trailer Courts and similar class of uses Annual Rate $69.00 per dwelling $69.00 per dwelling unit $62.00 per dwelling unit Ce Institutional Class Schools, colleges, rest homes, hospitals, clubs, lodges and similar classes of uses (1) Minimum charge, or (2) Volume charge based on water consumed (metered inflow), or Volume charge based on water consumed (metered effluent) Commercial and non-monitored Industrial Class 1. Light Strength Uses Bars (without dining facilities) Car Washes, Department and Retail Stores, Hotels, Motels (without dining facilities), Laundromats, Professional and Business Offices, Banks, Savings and Loan Associations, Warehouses, Auto Rentals (without repair shops) Newspapers, Commercial Printing Shops, Freight and Drayage Services, Barbershops, Shoe Repair Shops, Camera Shops, Plating Shops, Wood and Furniture Fabricators, Heat- ing and Appliance Stores, Drug Stores, Auto Supply Stores, General Contractor's Offices, Public Administration Offices, Health Services, Legal Services, Dry Cleaners, Metal Fabricators, Lumber Companies, Laundry Services, Sheet Metal Shops and similar classes of uses with wastewater $69.00 per year $0.620 per 100 cubic feet of water consumed $0.689 per 100 cubic feet of water consumed -2- strengths less than or approx- imately equivalent to residen- tial strength (COD = 403 ppm and Suspended Solids = 178 ppm): Basic Charge: (a) Minimum Charge, or (b) Volume charge based on water consumed (metered inflow), or Volume charge based on water consumed (metered) effluent) 2. Moderate Strength Uses Auto/Gas Service Stations, Auto Steam Cleaners, Auto Rentals (with repair shops), Auto Paint Shops, Bakeries, Beauty and Hair Salons, Commercial Launderies, Mortuaries, Lodges (with dining facilities), Radiator Repair Shops, Markets (with garbage disposals), Ice Cream Parlors, Candy Manufacturers, Food Preparation and Caterers, Sandwich Shops, Drive-In Theatres, Creameries, Roofers, Chemical Preparations, Paint Preparations, Machine Shops, Photo - Film Processors, Rug, Carpet, Upholstery Cleaners, Foundaries, Ceramics Studios, Oil Services, Transmission Services, Sanitation Services, Furriers, Drum and Barrel Cleaners and similar classes of users with wastewater strengths significantly greater $69.00 per year $0.612 per 100 cubic feet of water consumed $0.680 per 100 cubic feet of water consumed -3- e e than residential strength (COD = 403 ppm, SS : 178 ppm). The user will be reclassified to the Light Strength Uses Classification if he adequately demonstrates to the Deputy City Manager/City Engineer he is discharging only segregated domestic wastes from sanitary conveniences or wastewater equivalent in strength to residential wastewater. (a) Minimum charge, or (b) Volume charge based on water consumed (metered inflow), or (c) Volume charge based on water consumed (metered) effluent) Restaurants, Cafes and Other Eating Places (a) Minimum charge, or (b) Volume charge based on water consumed (metered inflow), or Volume charge based on water consumed (metered effluent) Monitored Industrial Class Manufacturers, processors, producers, laundries, photo finishers, painting services, packagers and similar classes of uses whose wastewater are monitored by the City: (a) Minimum charge, or combination of the fol 1 owing: $69.00 per year $1.134 per 100 cubic feet of water consumed $1.260 per 100 cubic feet of water consumed $69.00 per year $1.584 per 100 cubic feet of water consumed $1.760 per 100 cubic feet of water consumed $69.00 per year -4- (b) Volume charge based on water consumed (metered inflow) or $0,362 per 100 cubic feet of water consumed e Volume charge based on water consumed (metered effluent) (c) Surcharge for Suspended Solids (d) Surcharge for Chemical Oxygen Demand (COD) Septage Waste Haulers Commerical Businesses which haul to and dispose of septage waste at the Water Quality Control Plant: (a) Minimum charge (b) Volume charge based on wastewater discharged $0.402 per 100 cubic feet of water consumed $0.202 per pound of suspended solids discharged $0.057 per pound of COD discharged $69.00 per year $0.31 per gallon discharged" SECTION 4. SECTION 14.12.060 OF THE MUNICIPAL CODE AND SECTION 5 OF ORDINANCE NO. 396 AMENDED Section 14.12.060 of the South San Francisco Municipal Code and Section 5 of Ordinance No. 396 are hereby readopted in accordance with Section 5473 of the Health and Safety Code and shall read as follows: "All sewer rentals and charges hereinbefore provided for shall be collected on the official municipal tax roll, together with regular municipal real property taxes. Said charges and rentals shall constitute liens upon the particular lots or parcels of land affected, such liens to be effective at the same time and to the same extent as is provided for by law in the case of municipal real property taxes, with like penalties for delinquencies, all as provided for by Section 5473.5 to Section 5473.8, inclusive, of the aforementioned Health and Safety Code." -5- SECTION 5~ SEVERABILITY~ If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION 6. PUBLICATION AND EFFECTIVE DATE. This Ordinance shall be published once, with the names of those City Council members voting for or against it, in the Enterprise-Journal, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective immediately pursuant to the provisions of Government Code Section 36937(d).
