AN ORDINANCE AMENDING CHAPTER 20.85 OF THE
SOUTH SAN FRANCISCO MUNICIPAL CODE PERTAINING
TO DESIGN REVIEW PROCEDURES
THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS:
SECTION 1. CHAPTER 20.85 AMENDED
Section 20.85.060 and Section 20.85.070 of the South San Francisco
Municipal Code are hereby amended to read:
Section 20.85.060 Design Review Action
(a)
The planning commission shall have design review authority for all
projects requiring planning commission approval (such as PUD
permits, use permits, and variances) and all new commercial, office
and multi-family developments. The commission shall consider the
design review board's recommendations and shall approve,
conditionally approve, or disapprove the application.
(b)
For items not requiring planning commission approval, the planning
director shall consider the recommendations of the design review
board and shall approve, conditionally approve, or disapprove the
design review application. Conditions shall be reasonable, and
designed to assure attainment of the standards established by this
title. If the planning director disapproves the application,
standards or conditions which have not been met shall be specified.
If the planning director fails to approve, approve with conditions,
or disapprove the application as submitted by the applicant within
ninety days following the date the recommendation is received from
the design review board, the application, as submitted, shall be
deemend approved, unless the planning commission grants the planning
director a reasonable extension of time therefor. The determination
by the planning director shall be subject to review by the planning
commission either on appeal by the applicant or upon motion of the
planning commission. If the planning commission fails to make an
order to review the planning director's determination at its next
regular meeting after the determination, then the planning
director's determination shall be final.
Section 20.85.070 Appeals
A decision of the planning director may be appealed to the planning
commission and a decision of the planning commission may be appealed to
the city council as provided in Chapter 20.90.
SECTION 2. PUBLICATION AND EFFECTIVE DATE
This ordinance shall be published once, with the vote of the City
Council, in the Enterprise Journal, as required by law, and shall become
effective thirty (30) days after its adoption.
